I have reviewed the response made by the business in reference to complaint ID 10928651, and find that this resolution is satisfactory to me.

Due to the age and balance size of the account we are simply closing the account and will remove from credit.

We have reviewed the account in question and would like to clarify a few points. 1.) We have not purchased his debt. We are simply servicing the debt for [redacted] Bank2.) We have not called the consumer every day 3.) We have not received feedback from the consumer that he wouldnt be able to pay anything...

until he is discharged until now. 4.) We record all calls and notations in our system and we have repeatedly advised the consumer of this. 5.) We are allowed to call consumers between the hours of 8am and 9pm and have never deviated from those times. 6.) We will stop any further calls to the consumer since he has requested to have no calls from us.7.) We will follow up with the co-debtor from this point forward as he is equally responsible for the defaulted loan and has requested us to follow up with him as he is responsible for the debt.   If the consumer has any other concerns he may contact us at any time.

They always issued me monthly statements reflecting payments with balances and the same account number. The last statement was for the amount of less than $60. Now they are stating I have an outstanding balance of almost $1400.00 yet the refuse to provide me with any detail statements showing what this "new" balance and supposed "new" act. I gave authorization for withdrawals on the old acts. Never was I informed of this new one yet its coincidental it arise as I just paid of the debt. I do not authorized no withdrawal from ATG in any future accounts

I am rejecting this response because:This debt was not paid to your organization, no itemized lists were provided upon asking, debt was not validated as per the request of the customer, refusal to discuss debt, refusal to contact customer or accept calls from customer violates the FDCPA Act under inability to validate debt, original creditor, and lack of written verification of debt upon dispute of the report.The collection report under the credit bureaus is falsely reported under these circumstances. Please move forward with removing this report, as the balance was not paid in full to your organization.

The first representative that I spoke with (female) specifically said that I would have to contact the credit bureau to have the entry removed from my file, which I did indeed do. However the entry was not removed. In addition I have not received any notice regarding the supposed debt nor did I receive any phone calls. I have only one phone number and have access to review my incoming call records. I advised the representative that the first time that I saw the information was on my credit report. As I mentioned as well, I have medical insurance and pay all my payments at the time of service so there should not have been any amount owed to anyone. If you in fact have the ability to report negative information on my credit report I ask that you furnish me with a copy of the billing for services received and your right to report said debt.

As previously stated notification was in fact made. It was also made by the original creditor. In addition we have reviewed the recorded calls. At no time was the complainant told that we would remove from her credit. We did direct her to where to go in the case that she wanted to dispute this charge on her credit, but we never indicated that it would be removed. We are required to comply with the FCRA in regard to our credit reporting. This account is valid and is paid in full. It is being reported as paid in full as well. We have verified this through the CRA's. We will mail another copy of the itemization to the complainant per her request.

The consumer would not have a contract with ATG Credit because we are a collection agency attempting to collect a debt from her. Obviously she would not need nor have a contract with us. Our customer, the creditor, has a contract with us. The contract she signed was with the creditor who we work for and a copy of that contract would be mailed to her.

The dispute was submitted via the [redacted] program through the credit reporting agencies. We responded that the charge was valid therefore it is still reporting. Due to this new complaint we will now send a copy of the Enrollment Agreement and the Itemization of the charges for the consumer. These...

We have never spoken to the complainant. This could probably have been resolved earlier if the complainant simply called our offices. Our number is XXX-XXX-XXXX.

As requested, I called the number provided and spoke to a representative over a recorded line. There are inconsistencies around what I received from the provider vs what is in ATG records. It was communicated to me that account/event I am referring to is different from what ATG Credit has. Also, the address referred to by ATG is different unit number in the same building.
At this point, my contention is that I did not receive communication around the amount in question and what is reported to credit agencies. As the amount is small and inconsequential, it would have been paid on request. To reiterate again, I do not take my credit lightly and have never missed a payment in 15 years nor do have a collection reported apart from this one.
Based on input from ATG Credit representative, I have paid the amount today under ATG Credit reference number XXXXXX.
Could you please provide documentation on the communication sent to me regarding this account to prove that
I was indeed contacted(which I am refuting) or implement the original resolution requested where the incorrect entry is removed from my credit reports.

I agree with the resolution proposed by ATG and appreciate the courtesy extended given the fact I was not notified.
I have checked all my three credit reports and entry has been removed from[redacted] and [redacted] However,[redacted] is marked as updated because account is showing as closed. However, it is not removed.
Could you please re-verify update sent to[redacted]. I expect the issue to be resolved given my experience on the phone and with ATG representative here. As a result, I am marking this issue as "resolution accepted".

The harassing phone calls made last week were for [redacted], who hasn't lived here in over TEN YEARS. I've informed them of this fact DOZENS of times and yet the nasty calls keep coming. They are lying to you and, like many other bogus companies, they don't care about your opinion.

contract. The debtor should be aware of this debt as she made payments in the past to the original creditor, our client. We do not own the debt we are simply servicing the debt.
We have confirmed this debt is valid through our client. But if there is a specific dispute or specific questions regarding the debt we are happy to address those. We just need the debtor to tell us what information she needs from us in order to resolve this.
We have also reviewed the call that the debtor made to our office on 08/20/2013. She did speak to a rep named [redacted] At no time did anyone refer to to the debtor as a liar nor were they rude.
If there is any information the debtor needs in order to resolve this we are more than happy to provide that to her.

Once again, I would like ATG to provide me with documentation of exactly what I am supposed to have purchased and all the details pertaining to the transaction. I have requested this information on other occasions and have yet to receive it. There is no point telling me to contact [redacted] as they cannot be reached in regard to this as ATG is well aware. Why not just provide a valid order for the product and proof that it was shipped and received by me. Make a good faith effort instead of contacting people for products that were supposedly purchased years ago. I question why so many people have had the exact same experience. Something is rotten in the State of [redacted] in spite of all of ATG's clever rhetoric.
