I am rejecting this response because: the direct and blatant arrogance that MrK [redacted] has shown in this reply is the same total disregard to the Estate and the Probate Court Order that was shown upon first sending BMW Financial Services the Death certificate, Judge's Order, and Power of Attorney for the Legal Heir of the Estate of [redacted] The Estate of [redacted] holds firm that BMW Financial Services did in fact with intention undermined a court order and denied the Estate the total payoff of this account's balance in fullAdditionally BMW Fincancial Service contributed mostly to the repossession of this vehicleOn September 9, when I called to confirm BMW financial services receipt of the Death Certificate, Judge's Order and POA, I informed the representative that I was calling to payoff the account and needed the payoff amountThe agent told me that he was advised that I would be calling and he further had been advised that he could ONLY accept a payment but could NOT give me any details of the account such as balance , the current status, etcI was told by the agent that the legal department needed to review the documents, then someone would give me a call to arrange the final pay off amountIn which, that never happened until after BMW Financial Services repossessed the car on the assumptions that The Estate had no authority to pay the car off Therefore, in efforts to negotiate some type of compromise, I made the offer to make a $payment to bring the account currentAnd await to hear back from BMWTherefore, BMW Financial the assumption that refinancing was necessary is mere arrogance to assume ANY such financing was needed because it was notThe money was sitting in the bank upon my initial contact with BMWI nor the Estate of [redacted] ever expected, requested or considered asking BMW FINANCIAL for nothing more than the pay off balance on September 9, These fact can be proven in the phone conversation on September and will be proven by the phone recordings when and if necessary BMW FINANCIAL with intention and total disregard of the Probate Judge's Order giving the authority of the Estate of [redacted] to take possession of the Heir's property, repossessed this car as a result of its own negligence and unprofessional arroganceAnd because of BMW Financial Services contributory negligence, this account went into default to the point of repossessionAnd further, BMW FINANCIAL again failed to honor the Judge's Order and contact the Estate with regard to this account as the Vehicle is clearly named in the Estate It seems to be more about the money for MrK [redacted] In that, I would not be surprise if the assumption that this all was orchestrated by BMW Financial Services as a way to recoup some of the lost interest on this account as a result of it being paid off almost two (2) years early It just seems odd that the estate contacted BMW Financial Service to pay the car off and it ended up being repossessedAnd a court order can be disregardedAnd the Estate is to blame for a repossession for trying to payoff the balance early To think, this is the service BMW Financial Services choses to call world class [redacted]

I am rejecting this response because: BMW's response to my complaint does not acknowledge that on December 14, 2015, a BMW representative granted verbal permission to ship our leased vehicle overseasFurther, in mid-September 2016, another BMW representative granted verbal permission to ship our leased vehicle overseas and requested that I provide documents in order to process an authorization letter from BMW to ship the vehicle overseasIf it is in fact corporate policy to deny requests to ship leased vehicles overseas, it makes no sense whatsoever to have me submit documents in support of a request that is against corporate policyThis reflects a severe lack of training among BMW representatives, which led to multiple BMW representatives providing incorrect information to customers verballyLastly, BMW representative Chelsea W [redacted] acknowledged that in BMW's records, she saw a record that BMW had in fact stated that I could ship my leased vehicle overseas on December 14, 2015, which directly contradicts BMW's response to my complaint, which reads "According to our records, no further information was provided to confirm you were approved to ship the vehicle to Germany." I am rejecting this response because:I spoke to Cameron in Financial Services and he was advised that my wife did not change the due date, I am not sure who did but I would not have changed a date to go back when my pay day is on the first of the month, not the 31stI feel that my wife and I were lied on and even though we were making the payments on the first of each month I was still being charged unfair late feesEven if the payment did not make the due date BMW indicated, is there no such thing as a grace period and then to say I was late months out of the course of the loan is ridiculousWill not purchase or use this company again Regards, [redacted] ***

Your most recent correspondence regarding the increase of sales/use tax due to your move to Arizona references Arizona department of Revenue Publication 610: "Casual sales between individuals are not subject to the use tax. Property purchased by a nonresident individual whose first actual use or consumption of the property occurred outside the state is not subject to the use tax if the property is not used in conducting a business. If you purchase a vehicle from an out-of-state dealer or manufacturer, the Department of Transportation will require, at the time of vehicle registration, proof that tax was paid in the state of purchase and that the amount of state tax paid is equal to or greater than the applicable Arizona use tax rate. If tax was not paid in the state of purchase or was less than the Arizona use tax, the Department of Transportation will require that the use tax be paid at the time you register the vehicle. " Mr. [redacted] , as referenced in our previous response, your above referenced account is a Motor Vehicle Lease Agreement (Lease) and not a Motor Vehicle Retail Installment Contract. The type of financial agreement you entered into is the equivalent of renting a Vehicle. The Publication 610 as referenced in your correspondence would only apply to you if you had purchased the above referenced Vehicle. In this case, you did not. Accordingly, the Arizona Publication 606 applies to you based on your Lease. As referenced in our previous correspondence, pursuant to Arizona Publication 606, “Personal Property Rentals”, subsection – “Who Must Pay”, states “Anyone in the business of renting tangible personal property to others is subject to transaction privilege tax ” Motor vehicles are considered an example of a taxable rental item whose income is subject to the Arizona transaction privilege tax. Additionally, Arizona Publication 606, “Personal Property Rentals”, subsection – “Special Situations”, bullet point 7, Taxes Paid to Another State, “Arizona does not allow a rental business to take a deduction or credit for taxes paid in another state on a lease or rental of tangible personal property.” The transaction privilege tax is imposed on the income received by the lessor as a result of its leasing business in Arizona. The lessor seeks reimbursement for this tax from the lessee under Section 24 of the Lease in which the lessee agreed to pay all official fees and taxes assessed by government authorities in connection with the Lease. Accordingly, BMW Financial Services has added a monthly amount of $40.22 for sales/use tax to be remitted by you, as the lessee. We hope the following information and explanation will answer the issues addressed in your complaint. Ms.... [redacted] , as of today October 8, 2015 our records show 12 monthly Account Statements mailed around the 2nd of each month. The Account Statements were sent to the billing address on file of [redacted] CA. Our records also indicate the Account Statements reference the late fees incurred on the account. Enclosed with this letter are the Account Statements we sent. As you can see, your September 2015 Account Statement shows both the August and September late fees billed. After your installment due date, your Retail Installment Contract (Contract) provides for a ten day grace period. Payments received in excess of ten days past due are subject to a late charge. There were a total of 15 installments that were received in excess of ten days past due. Additionally, our records reflect our collections department spoke with you via telephone 13 times during the last 12 months. The dates of these phone calls are as follows: October 11, 2014, October 15, 2014, October 29, 2014, November 7, 2014, December 8, 2014, January 13, 2015, January 30, 2015, February 24, 2015, May 6, 2015, May 7, 2015, July 1, 2015, August 11, 2015, and October 5, 2015.
