you are aware, on January 30, 2015, you initiated a loan request with AvantCredit of Texas, LLC (“Avant”). That same day, you signed a loan agreement with Avant for a 36-month installment loan in the amount of $1,300.00, with a 39.16% Annual Percentage Rate. You agreed to make 35 consecutive monthly payments in the amount of $62.11 beginning March 7, 2015, with a final payment of $62.15 initially scheduled on February 7, 2018. The terms of your installment loan were clearly and fully disclosed to you on the Avant website, during the application process, and in the loan agreement prior to signing. As with your initial loan request, your requests for refinance are considered in accordance with our established credit policy. Rates are once again determined on an individual basis and are based on a number of factors including your credit score, repayment history, debt to income ratio, etc.We are confident we comply with all applicable state and federal rules, laws, and regulations. We have reviewed your payment history and determined that all payments have allocated correctly per the terms of your loan agreement. Dear [redacted] Thank you for your comments. Please be advised, the maximum amount that can be paid via debit or credit card for current customers is the amount of your monthly payment, rounded to the nearest $10.00. Please note that additional payments in excess of your minimum monthly payment, including full payoff, can be made anytime via ACH, RCC, paper check or money order.As explained in our initial response to your Revdex.com complaint, Avant reviewed the call from January 27, 2016, and determined that you explicitly authorized an additional debit card payment in the amount of $175.70. That same day, you contacted Avant requesting a refund, stating you intended to make the earlier payment in the amount of $100.00. As a courtesy, Avant attempted to issue a refund to the bank account on file. This courtesy refund returned on January 29, 2016, as the bank account information on file for your customer account did not belong to an active bank account. Per the instructions provided by you in a call on February 12, 2016, Avant applied the full amount of your January 27, 2016 payment to your upcoming installment payment due February 23, 2016. As you know, you sent in a paper check on March 21, 2016, in an effort to pay off your loan balance. Following receipt of this payment, your account has been paid in full. We trust this explanation resolves this matter. I am rejecting this response because:As stated:  I was contacted on the phone, and provided the information, a delay of 10 days was introduced.  All of the sudden my application was declined for delay, but I was told all the information was provided, when they asked me for employment information, I sent the proof of payment and get receipts that they had them.   the website did not allowed me to attach a document and follow the process to send emails. There were too many fundamental mistakes, and flaws, in the process, because it is not true that I did not furnish informaion on time.  In addition which is worth another complain, their waiting times on the line are ridiculously long.  The chat feature never works because, nobody is available to do chat.  Support is impossible, for a working person.

seriously.As you are aware, on January 13, 2014, you initiated a loan request with Avant via a marketing affiliate, [redacted] That same day you signed a loan agreement detailing the rates and terms of your installment loan. Per your loan agreement, daily interest accrues on the principal balance of your loan. On September 23, 2014, you contacted Avant via chat to utilize a one-time courtesy payment deferment, moving your installment payment scheduled September 25, 2014 to the end of your loan schedule. You were informed that you would continue to accrue interest based on the unpaid principal during this period prior to your authorization of the payment movement.On November 14, 2014, you contacted Avant via chat and requested a grace period deferment to move your installment scheduled November 17, 2014 to November 20, 2014. Once again, you were informed that you would continue to accrue interest based on the unpaid principal during this period prior to your authorization of the payment movement.According to our records, you then utilized courtesy payment deferments for five (5) additional installment payments over the life of your loan. Following your final scheduled installment payment on August 17, 2015, a balance of $200.98 remained on your account as a result of the additional interest that had accrued on the principal through the use of payment deferments. On September 15, 2015, Avant received notice via the e-OSCAR system that you were disputing information reported to the credit bureaus for your account, including your account status. On October 12, 2015, Avant responded to this dispute confirming the reported information was found to have been accurate, including your open account status. Your credit reporting information was updated to the date the response was filed, and your account continued to be reported as open. On July 25, 2016, Avant emailed a courtesy communication to ensure you were aware of the remaining balance on your open account. Please be advised that no additional interest has been charged following the date of your final installment payment. However, your loan will remain open until your balance is paid in full.We trust this explanation resolves this matter. We pride ourselves in providing excellent service to all customers and take all feedback seriously.   As you are aware, on December 15, 2016 you submitted an inquiry for credit for a Regions loan via the Regions Powered by Avant website. The application you submitted was considered in accordance with Regions’ established credit policy. Please note that Regions is the credit-issuer and servicer of your loan.After investigating the delay in funding your loan, we discovered a technical issue in the processing of loan proceeds for online accounts. Your loan was part of a small number of accounts whose loan proceeds were not issued on time. Following the correction of the issue, loan funds were transferred to your deposit account no later than 12/21/2016. Additionally, a credit in the amount of $15.01 for the interest assessed from the contract date to the funding date was applied to your loan account.  Lastly, you indicated that you would like your monthly payments automatically drafted from your checking account. We have confirmed that this feature was established and your monthly payment will be debited on the 15th of each month.  We apologize for any inconvenience this issue may have caused and will work to mitigate any future occurrences. seriously. As you are aware, on February 12, 2015, you initiated an inquiry for credit for a [redacted] installment loan via the Avant Platform. [redacted] is the credit-issuer for the Avant Platform, a closed-end installment loan program, where Avant operates as the administrator and servicer of the program. In your loan agreement, you elected to have your scheduled installment payments be initiated automatically via ACH transactions. As clearly disclosed in your loan agreement, you have the ability to opt out of recurring ACH payments by providing written notice. Payments are also accepted via remotely created check, paper check, money order, debit card, or credit card. [redacted] and Avant are confident that each complies with all applicable state and federal rules, laws, and regulations. On January 8, 2016, you emailed Avant and provided notice that you were revoking your consent for recurring ACH payments, and your account was updated accordingly. Please be advised, you have the ability to schedule ACH payments online via your Customer Dashboard at www.Avant.com as well as by contacting Customer Support via phone or email. Due to the time required to schedule and process this type of transaction, ACH payment arrangements must be made at least one business day prior to the scheduled payment date, before 7:00 P.M. CST. On your Customer Dashboard, you have the option to edit upcoming scheduled payments, including installment payments, as well as schedule additional payments to satisfy your required installment payment amounts. If you are having difficulty using your Dashboard, please do not hesitate to contact Customer Support via email, phone, or chat and our friendly, understanding representatives will be happy to assist you. On November 15, 2016, at your request, Avant emailed you a breakdown of all payments made on your account, and provided an explanation of your past due balance. As detailed in this email, your account had entered into a late status due to your September 9, 2016 and September 30, 2016 installment payments not being satisfied as scheduled. These payments were initially scheduled August 18, 2016 and September 18, 2016 per the agreed loan terms, and had been moved by you through the use of two courtesy full schedule changes. Additionally, a grace period movement had been applied by you to your installment payment originally scheduled August 18, 2016. On December 16, you set up and consented to a short term payment plan via your Customer Dashboard in order to repay your past due balance. The short term payment plan breaks up your past due balance into partial payments, based on the payment amount, payment frequency, and payment date you selected. As a benefit of the payment plan, no fees or interest are charged while the plan is active, and any regularly scheduled installment payments that become due while the payment plan is active are moved to the end of your loan term.On December 18, 2016, you contacted Avant and requested clarification as to why two payments were scheduled in January, and requested confirmation that your account remained opted out of ACH payments while on the payment plan. You repeated these inquiries via email on December 20, 2016. On December 20, 2016, Avant responded via email informing you that your account was opted out of ACH payments, which is why your December 19, 2016 payment plan payment had not been automatically attempted and remained unsatisfied. Avant confirmed that payment plan payments must be satisfied within ten days of the scheduled payment date in order for your payment plan to remain active. Additionally, Avant confirmed that, upon completion of your short term payment plan, the underlying terms of your loan agreement are reinstated. Accordingly, following your final payment plan payment on January 19, 2017, your upcoming installment payment scheduled January 30, 2017 will be due as agreed. In the email, Avant advised you that you were welcome to utilize a grace period movement of up to 10 days for your January 30, 2017 installment payment, if needed. Per the terms of your loan agreement, information regarding your account, including late payments, missed payments, or other defaults, may be reported to the credit bureaus. Avant has reported your account to the credit bureaus on a monthly basis following receipt of your first installment payment scheduled March 20, 2015.  Please note that a short term payment plan does not prevent Avant from reporting your account as past due. However, upon successful completion of your short term payment plan, your past due balance will be satisfied and your account status will return to current.We have reviewed your account and determined that the information reported to the credit reporting bureaus on behalf of your account is accurate. The Fair Credit Reporting Act (FCRA) prevents us from removing any information from your credit report which is found to be accurate and complete. We trust this explanation resolves this matter. [redacted] is the credit issuer for the Avant Platform, a closed-end installment loan program, where Avant operates as the administrator and servicer of the program.  Note that this review process may change the status of your loan. Please be advised that this condition was clearly disclosed to you during the application process. As you know, in order to consider your child support and pay stubs, which have a different last name than what is listed on your application, a court order outlining the amount and frequency of the child support you receive and a copy of your marriage certificate were requested on January 27th, 2017 via phone. Please note that, during this call, you indicated that you would be unable to provide the requested documentation. Accordingly, your application was evaluated based on the documentation you had provided,  and it was determined, due to our inability to verify your income, that you were no longer eligible for the terms offered to you. Consequently, your loan request was declined and a Notice of Adverse Action was provided to you via email.Additionally, please be advised that, as was disclosed to you during the application process, a hard credit inquiry is conducted once an applicant submits their application for final review.  As this hard inquiry was authorized and properly agreed to, we are unable to remove it from your credit report.Furthermore, we adamantly deny the use of any fraudulent or deceptive business practices. Please be assured that we are indeed a legitimate business. Avant has been in operation since January of 2013 and has issued and serviced over 450,000 personal loans. We obtain any applicable licensing and are accredited by the Revdex.com. We are confident that we comply with all applicable state and federal rules, laws, and regulations. All information we gather is used only in accordance with our privacy policy, which can be found at the bottom of each page of our website, and is protected by data encryption software. This software ensures that, even in the event of a security breach, the information will be unintelligible. Please be advised that all financial companies choose how they share your personal information. Federal law gives consumers the right to limit some but not all sharing.  Per your request, we have limited your personal information shared with our marketing affiliates. Finally, please note that you are still eligible to apply for a loan if the aforementioned requests can be met. seriously.As you are aware, you contacted Avant via telephone on June 21, 2016 in an attempt to update your bank account. During this call, the Customer Support representative correctly informed you that documentation is required to update the bank account on file. The representative emailed you instructions for how to submit acceptable documentation. You were advised that you could schedule payments via credit or debit card while your bank account on file was being updated. The Customer Support representative offered you the option to utilize a grace period movement for your installment payment scheduled June 24, 2016, to allow additional time for your bank account to be updated. At this time, you authorized the movement of your June 24, 2016 installment payment to June 28, 2016. Per your loan agreement, you have the ability to opt out of recurring ACH payments by providing written notice. As no such notice was received prior to your updated installment payment date of June 28, 2016, a payment from the bank account on file was attempted as agreed. On June 30, 2016, the installment payment returned due to insufficient funds. Please note, your loan agreement clearly states that a Dishonored Payment Fee of $15.00 will be assessed each time a scheduled payment returns. Accordingly, a Dishonored Payment Fee was correctly applied to your account.We trust this explanation resolves this matter. All applications for credit are considered in accordance with [redacted] established credit policy.In order to fulfill [redacted] commitment to responsible lending, all loan requests go through an online final review process after determining potential eligibility. The website clearly disclosed that final approval of your loan request was subject to verification of the information you provided in your application. On May 23, 2017, Avant contacted you in order to verify information you provided in your loan request. Please note, at the close of the call, the representative informed you that a decision for your application would be communicated shortly and advised you of when and how funds are issued if the decision was made to approve your loan. We have thoroughly reviewed this call and confirmed that at no time were you advised that your loan request was approved.Based on the information we were able to verify, it was determined that you did not qualify for a product at that time. all feedback seriously.As you know, on December 22, 2015, you contacted Avant telephonically and made a payment via debit card for your January installment, which was due on January 4, 2016. On December 23, 2015, you again contacted Avant via telephone and received a payoff quote for January 15, 2016 in the amount of $10,490.14. Due to an isolated system issue, this quote incorrectly assumed that your installment due on January 4, 2016 was still outstanding, and that this installment would be paid in addition to the quoted payoff amount. On January 19, 2016, Avant received a check in the amount of $10,490.14. As a result of the above-referenced issue, a remaining balance in the amount of your January installment was left on your account after this check was processed. In order to resolve this matter, Avant has waived this balance, and your account is now paid in full. On January 29, 2016, Avant contacted you telephonically and you indicated that you were satisfied with this result.
