Just know that you are not dealing with a shallow uneducated individual so please don't insult my intelligence.

I purchased my automobile through [redacted]. I had already made the purchase and had accepted delivery. Why one month later are these companies popping up out of nowhere. I clearly had no need of them at all. I want a written contract with my actual signature. I will take this up with civil court because there are so many companies that did a hard inquires. I have stated I am working with [redacted] to remove companies that cause these problems. This company needs to understand I am not going away and will fight until they all remove the information from my credit reportsRegards,[redacted]

In the state of California, the vehicle may be repossessed when an account becomes past due by one (1) day. In your case, the vehicle was impounded by the police department because a misdemeanor crime was committed, which was a breach in the contract that was signed by you and Mr. [redacted]. on 11/02/2014. On the contract, page 2, number 2 section b. USING THE VEHICLE – you agree not to expose the vehicle to misuse, seizure, confiscation, or involuntary transfer.   Also note, per the Notice of Intent Letter that was sent out to you on 08/14/2015 via certified mail and was received/signed on 08/17/2015, it stated that the vehicle was repossessed on 08/13/2015, and you may NOT reinstate the contract because “the buyer has knowingly used the Vehicle, or has knowingly permitted it to be used, in connection with the commission of a criminal offense, other than an infraction, as a consequence of which the Vehicle has been seized by a federal, state or local agency.” Please keep in mind, we made an exception and ALLOWED you to reinstate the contract, instead of paying off the vehicle (which the Notice of Intent implied). CarFinance strives to deliver excellent service to every customer. We have reviewed your account and we are unable to grant the extension request. Your account will not be eligible for an extension until 12 full payments have been made on the account. The representatives that initially submitted your request will be coached to ensure this does not happen again. We have also pulled the calls, and there was no mention on the calls that if a payment arrangement were set up, a late mark would not be assessed. The account was due for the 03/24/2016 payment, and it was not made in full until 05/02/2016 when the account was 39 days past due. The late mark will remain on the account.  As a courtesy, we have submitted a request to waive $100.00 of the late charges that are on the account, leaving only $61.86. 2014.

At the time of the accident (09/26/2016), your account was current and the next payment was due on 10/24/2016. On 10/25/2016, we had received the insurance check, and it was applied to your loan. In the case of any insurance claim, ALL proceeds received (insurance check, GAP refund) are applied ONLY to the Principal balance of the loan. The customer is still responsible for maintaining the account in good standing throughout this process. I thank Carfinance.com for the quick response and helping to correct the mistake on my [redacted] credit report.  The account shows updated but the negative mark of charge off, fail to pay on October of 2015 remains.  Again this mark needs to be removed as it is incorrect.

I never submitted an application to [redacted] Lending. The other companies such as [redacted] admitte they had no receipt or knowledge of an actual application. This was simply an inquiry by [redacted] to input the amount of your current car loan and interest rate, then [redacted] Lending pops up and states they can lower it, but what they don't tell you is that they increase the loan term by 4 yrs. and when the same info is used your payment actually increases. The other companies have all issued a letter stating this was third party info they relied on and assumed I had filled out a credit app. If they do not want to do this, produce the credit app.

Please be advised that we do not hold checks when they are received. Our payment processing office processes payments the same day they are received. In your complaint, it was stated we have not processed a payment that was sent out on 8/1/16. Please be advised we had processed that payment on 8/6/16, check number [redacted]. We have also received a $1,400.00 payment on 10/12/16, check number [redacted]. In regards to late charges, there are none on the account. Also, be advised that since you are in the state of Ohio, per Ohio state law, finance companies are required to collect on any late fees that an account is due for when a payment is made. This was advised to you in our first response back in July. We have also offered to you other payment options (automatic monthly payments via our website) to assist you in alleviating future late fees/late payments on your account. In the complaint, you have also mentioned correcting your credit report. As stated in your complaint, you wanted to ensure that there is not a
late payment being reported to the credit bureaus, and there is not. You also
inquired on a refund of the processing charges for the check by phone. We are
unfortunately unable to reverse the processing fee. We have however, waived the
$10 late charge that was assessed to the loan. That has already been taken care
of. The two month extension request has also been submitted on the account and
will be on the account officially in about 48 hours (for processing time).
