Ms. Smith questions the legality of CashNetUSA being able to provide financial services to...

residents of Tennessee. CashNetUSA is licensed to provide a Flex loan under the Flexible Credit Act. Our license number is XXXXXX. At all relevant times, our lending, fees, interest, and charges have complied with the applicable laws.
It should be noted that we stopped offering our payday loan product to residents of Tennessee as of June 2015.
On July 6, 2015, Ms. Smith opened a Flex Loan account with CashNetUSA with a credit limit of $1,250.00. Contrary to Ms. Smith's assertion, we do not give financial advice. CashNetUSA advised Ms. [redacted] that we have a new product to offer to residents of Tennessee and provided features the Flex loan plan has to offer.
Before she became bound by the agreement, CashNetUSA disclosed the terms & conditions and the charging structure of the Flex Loan Plan. Ms. Smith signed her Flex loan agreement stating she understood and agreed to the terms and conditions associated with the Flex loan. The interest and fees applicable to her line of credit were clearly set forth in the agreement.
Over the course of Ms. Smith's relationship with CashNetUSA, she has taken two (2) advances and made minimum monthly payments on her account, and additional payments without any penalty.
As set forth in Ms. Smith's Flex Loan agreement, interest will be charged each day on the principal that is scheduled to be outstanding. The daily periodic rate applied to her account is 0.XXXXX%. There is also a customary fee of 0.069% that is based on the daily principal balance and the number of days outstanding during each billing cycle.
Ms. Smith will be required to make minimum payments every billing period she carries a balance. The minimum amount due on each due date will be the greater of 5% of the outstanding Principal Balance plus all fees and accrued interest or $35, not to exceed the account balance. The due date and minimum payment amount are shown on each periodic billing statement.

the terms and conditions associated with the installment loan. On July 5, 2016, CashNetUSA received Ms. [redacted]’s request to adjust the due date of her upcoming payment of $111.34 due on July 8, 2016. However, due to an administrative error, Ms. [redacted]’s request to adjust the due date was not executed; as such her bank account was debited. We apologize for the inconvenience this matter may have caused Ms. [redacted]. CashNetUSA has submitted a request to reimburse the payment of $111.34 to her bank account. We ask that she please allow 3-5 business days for the transaction to appear in her account. In addition, we are willing to waive $111.34 off the account balance.  Further, we are willing to reimburse her for any bank fees she may have incurred due to our debit on July 8, 2016. Based on the description of the complaint, it appears that Mr. [redacted]’s complaint centers on a rebate that he believes he should have received upon full...

repayment of his loan. On September 7, 2017, CashNetUSA originated a $600.00 Installment loan for Mr. [redacted]. Before he entered into the agreement, CashNetUSA disclosed the Terms and Conditions associated with the loan, including the Loan Duration, Annual Percentage Rate, Finance Charge, Amount Financed, Total of Payments and the Payment Schedule. Mr. [redacted] then signed his loan agreement acknowledging that he understood and accepted the terms and conditions associated with the installment loan. On October 12, 2017, Mr. [redacted] paid off the full account balance. On October 16, 2017, when he contacted us about his rebate, he was advised that a promo code was never applied. On October 24, 2017, Mr. [redacted]’s concern was elevated within our internal resolution process and resolved in a way that he found acceptable. To make things right, we honored the rebate as a onetime courtesy. For future reference, promo codes/coupons must be applied during the application process or within 5 business days of funding. We apologize for the confusion this matter may have caused Mr. [redacted]. We hope that this response resolves this complaint and answers any questions that your office has. I am rejecting this response because:there is truth to the statements of accounts and their terms ..of course as this is their policy but when I signed up they gave me a detail of account and amount because I asked what would be the fee amount of the loan for 750.00. and I also had to supply them with a date on which I would be making a payment ..this was chosen by me and in order to give me the amount of the loan they would have to give me the amount for that particular amount of time as they have a billing cycle which charges by rate of time on the loan. also it was asked in my initial application how much I would be paying on that date payment which was the full amount of the loan for that period of time...it is complete deception whether it be fault of mine fro being unaware that these questions were designed to decieve me or not.also they admitted to me that they changed the form of amount of payment after the loan was verified .they said it was standard procedure to do that change..and also their claim to contact me by phone is completly false..I contacted them after they failed to take the amount of money agreed to...and after I contacted them because they failed to return my phone calls they told me in order to pay the full amount of the loan it had increased by more than double...they did send me emails regularly but the important one concerning how much they took out of my account, like I said ,I could not respond quick enough in order to allow them to take the proper amount of money out to close out this loan without further interest.. even now after this time trying to deal with this deception they continue to incur charges..and regularly send emails concerning my failure to answer phone calls or return their emails..yet in response to my email they claimed I had no such mention of how much money was to be removed from my bank account even though I must make mention of it in my initial appliction...please inform me quickly in this matter or I will have to pay more and more which was their initial plan I believe...

I am rejecting this response because: I have received this from my college that my refund money will be in two parts and not one single payment, as I was made to believe. I will now have to wait until after 04/19/2016 to receive my second part of my refund. I ask cashnet if they would extend it for another 30 days. I am just as frustrated with my college they told me two different stories, so now I have to save my refund money. Or if cashnet would accept $500  and I will pay the rest of the settlement of $833   in 30 days from 04/04/2016.

and conditions associated with the installment loan.  Subsequently, Ms. [redacted] contacted our customer service department to obtain further clarification of how the coupon operated. However, our records do not indicate that she applied the coupon code when she applied for her loan. At CashNetUSA, wepride ourselves on looking afterourcustomer’s by attempting to resolve any issues in a straightforward, efficient and amicable manner –weput ourcustomersfirst. As a gesture of goodwill, we have processed a rebate in the amount of $348.61 to Ms. [redacted]'s bank account. agreement, CashNetUSA provided the applicable disclosures and [redacted] signed her Line of Credit agreement acknowledging that she understood and accepted the terms and conditions associated with the Line of Credit. On March 22, 2017, [redacted] inquired about updating her pay frequency. We advised that in order for her pay frequency to be updated, proof of her new pay frequency would be needed to support her request. This can include the 2017 benefit award letter, or a bank statement showing direct deposit entries on the new pay dates. On April 28, 2017, [redacted] submitted the requested documentation; therefore, we updated her pay frequency in our system. However, CashNetUSA advised [redacted] that the change can take 2-3 billing cycles to complete. In the meantime, we advised [redacted] to please monitor her statements, and if needed, contact us so that we may manually adjust an upcoming due date to match her pay day. [redacted] contacted us to have her due date adjusted, however, due to human error, the payment was processed on the incorrect date. Subsequently, this matter was escalated within our internal dispute resolution process and resolved in a way that [redacted] found satisfactory. In addition, the fees and interest applicable to a cash advance were fully set forth in the loan agreement, a copy of which was provided to her (via email) when she opened the account. In addition to disclosing the charging structure from the outset, we keep our customers informed by supplying periodic statements. Amongst other loan details, the due date, minimum payment amount, and account balance are shown on each periodic statement. ­­­­­­ Our records do not indicate that we advised Ms. [redacted] that all her minimum payments would be $131.00. CashNetUSA cannot provide specific dollar amounts for the amounts that would be due throughout the life of the line of credit because the amount due at any given due date will be dependent upon the customer’s usage of the line of credit, including for example whether they made any draws and if so, the amount, and the amount of any payments by the customer. On June 8, 2017, per Ms. [redacted]’s request, she was funded a $2,000.00 advance. Ms. [redacted] always has the option to make additional payments or repay the amount outstanding in full at any time without penalty. were available and provided to her prior to signing the agreement, which also clearly disclosed the payment terms and dates.  On January 26, 2018, Ms. [redacted] was funded an $800.00 Installment Payday loan with CashNetUSA. Before she entered the agreement, CashNetUSA disclosed the Terms and Conditions associated with the loan, including the Annual Percentage Rate, Finance Charge, Amount Financed, Total of Payments, and the Payment Schedule in the form of Truth In Lending Disclosures. Ms. [redacted] then signed her loan agreement acknowledging that she understood and accepted the terms and conditions associated with the Installment Payday loan. On January 25, 2018, after review and approval of Ms. [redacted]’ application, CashNetUSA sent Ms. [redacted] a loan approval email, which included an attachment of her signed loan agreement, to the email address on file. Based on our review, nothing has come to our attention that causes us to believe that we have breached applicable regulations or standards. We urge Ms. [redacted] to review the loan agreement provided to her for information regarding her loan terms. $600.00 installment loan with CashNetUSA. Mr. [redacted] electronically signed his Installment loan agreement stating he understood and agreed to the terms and regulations associated with the Installment loan. The fees and interest applicable to her loan were fully set forth in the loan agreement.
On May 13, 2015, Mr. [redacted] spoke with our compliance department and addressed his concerns. In addition, Mr. [redacted] has agreed to a new payment arrangement that will allow him to pay off his outstanding balance.

After the account was in delinquency status for over 180 days, on May 28, 2008, CashNetUSA sold the account to a third party debt buyer, [redacted]. As a result of her account history with us, we would not offer additional financial services to Ms. [redacted]. Our records do not indicate Mr. [redacted] is nor was a customer of CashNetUSA. Please be advised that CashNetUSA does not provide financial services for residents of the state of New York.
CashNetUSA is not associated in any way with the persons referenced in this complaint who are posing as consumer lenders. These persons are fraudulently using our trade name in an attempt to extort money from consumers by claiming to offer consumer loan services to these consumers.
CashNetUSA has no knowledge of, or control over, these individuals falsely posing as lenders and possibly demanding a down payment or advance before extending a loan. Therefore, and unfortunately, CashNetUSA cannot prevent them from calling the consumer.
Hopefully, this information will appropriately address the concerns the complainant has with CashNetUSA.

I am rejecting this response because I am still lost on this debt. I cannot recall the assigned person that worked with me, but this debt was resolved. I even noticed that CashNet did not show a payment in April 2014 *(see copy).I do not have all of my records. Acting upon her concerns, the matter was elevated within our internal dispute resolution process and resolved in a way that she found satisfactory on November 10, 2015.
