I have reviewed the response made by the business in reference to complaint ID ***, and have determined the response would not resolve my complaint. For your reference, details of the offer I reviewed appear below
The
business has failed to address the issue that they routinely (as evidenced by
other homes being completed near me in addition to my own) fail to remove
construction debris from the area around the homesI have photographic
evidence of the business using a mini bulldozer to level the ground around
newly built homes without ever grading or raking the ground
At
my home there are pieces of masonry, concrete, construction barrier, 2x2, 2x4,
pea gravel, pave gravel, and metal in my yardAll of which came to be there
from the construction companyThe business has not addressed the issue of
getting ALL the debris out of my yard
The
solution offered by the business of sod for purchase is unacceptableThe
places where grass doesn't grow in my yard are due to the debris left behind by
the construction company and the neglect from the landscaping company
I
hereby reject the offer to purchase sod and re-request my resolution of PROPER
grading/tilling/raking of the yard prior to seeding
Regards,
*** ***

I have attached a copy of the final inspection report that shows that a final grade and seed was NOT done at the time of closing as you just statedIt also states there were large stones left in the yard and it was not completed at the time due to "weather conditions." Also attached, is a letter from my mortgage company saying that when final landscaping is complete they will release funds to Arbor homesThese were all docs signed at the time of my closing This is not negligence on my part the work was never doneI also have estimates and statements from landscapers who also agree that my yard never had the final grading done and I'm prepared to release those as wellYou told me several times you would be out to complete it and now all of a sudden the work has been completed after I report you to the Revdex.comThis is infuriating that you would blatantly lie like this to save a dollar. All I wanted was the work completed nothing more nothing less I also have every right to leave a review about your company on social media that is what the review option is forIf you want positive reviews then do right by your customersNow that I know that you are now saying the work was already done and you got paid for it fraudulently I will be taking further actionRevdex.com:

We build the homes to the BAGI standards that are in the BAGI bookBelow is the description when it comes to exterior concreteThe blow description explains what is to be expected with exterior concrete here in IndianaFurther more the homeowner signed paper work at closing that is attached that states cracks are and to be expected and not defectsThere is something else that talks about the width of the crack and displacement but this does not meet any of those requirements Concrete consists of a mixture of many natural materials: water, cement, sand, gravel, fly ash and other various admixturesThese materials are combined in many different ways according to the specific use of the finished concrete, regional requirments, and climateBecause it is a natural product, it is difficult to control how it will react to various conditions that are beyond the control of both the builder and the homeowner Naturally occurring conditions affect concrete in numerous waysIndiana is classified as a Severe Weather Region for concreteNAHB defines a severe weather region as outdoor exposure in a cold climate where concrete may be exposed to the use of deicing salts or where there may be a continuous presence of moisture during frequent cycles of freezing and thawingExposure to severe weather can damage pavements, driveways, walks, curbs, steps, porches, and slabs in unheated garagesDestructive action from deicing salts may occur whether from direct application or from being carried onto an unsalted area from a salted area, such as on the undercarriage of a car traveling onto an unsalted area from a salted areaConcrete expands and contracts with temperature changesThis is especially a concern during the first year after concrete has been poured, because it still retains a lot of water Another characteristic of concrete that is difficult to control is color variationsConcrete itself can have varying colors due to the different types of sand and aggregates used in the mixtureColor variations can also be caused by admixtures such as calcium chloride, (the most commonly used admixture to accelerate the curing process of concrete and to reduce the effects of freezing)If concrete is poured on different days, and the previously poured concrete has had time to cure a bit, color differences will be apparentDifferent brands and types of concrete may contain many varieties of sand, cement, admixtures, and aggregate that will result in color variations in the finished concreteWhen repairs are made, the concrete used as a filler must be extremely dry to prevent shrinkageThis almost always results in a repair patch that is darker in color than the existing concreteBecause of the previous explanations for color variations, it is to be expected that whenever a repair is made, it is nearly impossible to match the colors of concreteBecause the curing of concrete is a chemical process and can take up to one year to complete, changes in size and strength are to be expectedIt is very difficult to control the effects of water evaporation, air bubbles within the concrete, air humidity, and windSome chemical processes are controllable and are the responsibility of the homeownerPitting, spalling, or scaling can occur when salt or other deicers are applied directly to the surface of the concrete or when they are indirectly deposited on the surface by tires or feetThese substances cause rapid deterioration of the surface, by both chemically attacking the concrete and by drawing moisture near or within the surface and promoting expansion and contraction of the concrete during the freeze-thaw cycleOther chemicals such as lawn fertilizer, can also chemically attack the surface of the concrete, resulting in spalling, scaling, and pittingUntil concrete has cured, it can not withstand extreme weight such as moving vans, school buses, or garbage trucksIt is especially important to limit the amount of weight that is placed upon concrete during the first year because it needs sufficient time to cure and gain strength Spalling, Scaling, or Pitting from Pop-Outs in Exterior Concrete Observation: Exterior concrete surfaces are spalling, scaling and pitting from pop outs exposing aggregate Standard: Under conditions of weathering and use, exterior concrete surfaces should not disintegrate; however, minor spalling, scaling and pitting from pop outs should be expected Builder’s Responsibility: If concrete surfaces have spalled, scaled or pitted under weathering and use, the builder will take corrective action as necessary to meet the standardThe builder is not responsible for damage that is the result of spalling, scaling or pitting caused by salt, chemicals, mechanical implements, or other factors beyond the builder’s control Homeowner’s Responsibility: The homeowner should take precautions to reduce or eliminate the exposure of exterior concrete to salt, chemicals, mechanical implements, and other factors which could damage the concrete surface

Per the RWC warranty book it states that there is one year of workmanship warranty on the sidingThe repair that happened at your one year took place over two years agoSince you are outside of the warranty period you can contact your insurance company or pay out of pocket for the expensesThis is the homeowners 2nd complaint about storm related damages -justin

I appreciate you taking care of the flooring and patio door issues.Once again, the vent is not easily accessibleIt is on my roofOnce again, the neighbors that have cleaned out theirs have found insulation in theirs, not lintI don't think it's my responsibility to clean out insulation that was left in my vent by the builderArbor needs to send someone to clean it out initially and if I continue having issues after that, then I will take responsibility and clean it out myselfI think that is the least they can do with all the other issues I have had to deal with.I also forgot to add that I have had doors, 1-bedroom door and the master bedroom closet door, that have already come off the hinges! Are you kidding me!!! I lived in my other house for years and never had a hinge come off the door! But, I knew that was the "homeowner's responsibility", so I fixed those myself, along with the closet rack that already fell down. So, once again, I believe there have been plenty of issues to warrant someone to please take care of my vent issueI really think all the vents should be cleaned since there could be insulation in them as well

I just spoke with Ms*** and informed her that I had spoken to the owner of our siding company and that he was personally going to do the repair on Monday.I apologized for the issues that she has been having with the siding and assured her that we would get this situation rectified! I do
believe that the issues have been separate isolated issues per our conversation and have asked our siding contractor to inspect the entire house while he was there on Monday. Thank you for your time in this matter. Tony K***

This is outside of ANY warranty issue or anything the homeowner (myself) could have done. The trim was not installed properly nor was the step flashing. Even if I was to climb on the roof and touthe trim with caulk, that doesn't even come close to fixing the step flashing/wrapping issue, nor the wetness of the plywood. Yes, you offered to hammer the trim back in, but the damage was already done and the trim was already rotted from the original construction. This is SOLELY a workmanship issue, and should be taken care of outside any warranty claims. Did you see how many nails were in that ONE piece of trim?? Clearly poor workmanship that should not be blamed on the homeowner. SEVERAL people missed this during the final phases of construction of our home, including when people were on the roof several times after that. How can an item even be warrantied if it is constructed incorrectly?

The roof was damaged by the severe storms we had in central Indiana at the beginning of the yearPer the RWC warranty book the siding is covered for one year and with the 57mph winds that we saw and the extreme amount of damage in that area it is safe to assume the siding was affected by these
storms as there were homes across central Indiana with siding damageWe are not responsible for fixing damage caused by storms or other acts of Mother NatureThis is the second request this homeowner has done related to storm and weather damage and our stance still remains the same.- Justin

Our superintendent is currently working with the homeowner to resolve their issues

I called and talked to the HVAC company and they said the damage was caused by a leak on their endWe can replace the flooring for you and we will work out the rest with themIf you want to visit a Model home and pick out some new flooring we can get it ordered and installed for youPlease email your flooring selection to [email protected] talked to the window company that supplies the sliding doors for usThey agreed that it needed to be replaced and we can have someone call to schedule thatWe need to do that before the floor goes down to make sure the leak is fixed before the new floor goes down.on the dryer vent, you don’t need to clean the whole pipe out you just need to remove the lint buildup at the outside ventIt has movable louvers that allow the air to pass throughLint can still get built up around the louvers and does require maintenance by the homeowner

We have reached out to the HVAC company to get more information on what is going on with their unit.

An Arbor Representative met with *** and *** on December 30th to discuss and address the remaining issues that they had and we are working toward resolving the concerns that they haveI also agreed to replace sections of concrete that they were concerned about as well in the spring,
April or May timeframe depending on weather.Thank you for your time in this manner and again I apologize for the delay in responding as I was delayed in following up with my superintendent due to the holidays and his vacation schedule. Sincerely, Tony ***Area ManagerArbor Homes LLC

We have asked someone else to step in and finish up the unfinished items
