Homeowner reached out to us back in December about her yard never being gradedWe thought that was odd especially with a summer closing the mortgage company requires the final grade and landscaping to be completed to pass the mortgage inspectionWe told her since it was never done that we could do
it in the spring for herAs soon as spring came she called the office to follow up with the yard workWe told her that the landscaping company was still doing all of the other yards from winter and with the wet month we had last month that it may take some time to get completeOver the weekend the homeowner reached out to social media along with other places telling others not to buy an Arbor HomeWe looked into this more and her yard was final graded and she did get the landscaping done at time of closingThe homeowner has neglected her yard and this can be seen by the large erosion spots by her gutter down spoutsThe rocks they are seeing in their yard is from the rain washing away their topsoil because they did not establish their yard after ownershipI attached paperwork where it states we do not warrant the hydroseeding because it requires additional effort from the homeownerThis is also outlined in the warranty book as wellWe will not be doing any additional yard work on this homeowners yard due to it being neglect on their end.

For your reference, details of the offer I reviewed appear below The iissue at hand is completely separate from our roof issue The siding was NOT damaged during the wind storms The siding was installed improperly and instead of actually fixing it during our year, Arbor chose to simply nail it in and caulk it Of course, this did not last nor fix the problem so now we have the exact same issue we had within our first year Arbor's lack of concern for its customers as well as their poor construction practices are the problem at hand Again, this is separate from the roof issue and in no way, shape, or form related to wind in April I have attached pictures showing the nail holes and caulking that Arbor did a little over years ago to "fix" the issue Also, rotting wood and mushrooms growing from our house have nothing to do with wind either Arbor is simply trying to avoid taking responsibility for it's actions by attempting to connect dots that simply do not exist

We are not required to repair any damage caused by severe weatherWe did offer to repair damaged shingles caused by the high windsWith so many homes affected by the storms on April 2ed we worked as fast as we could to work through repairs we offered to makeMost homeowners filed a claim with
their insurance company to claim the storm damage on their homeSome were happy with us just patching the damage as a concession. This homeowner called EMS to do a repair when they noticed a leakThey nailed through shingles which caused more damage to other shingles around itWe are not required to fix or repair work done by other contractorsI did approve that we fix the section that EMS repaired for this homeownerI attached pictures of the repair job EMS did and attached a picture of the roof after we fixed it. A third attachment shows that she signed and acknowledged that the concrete is not warrantableHomeowner has been told multiple times by multiple people about these issues.

Again there were reported wind gusts of 57mph in your area on April 2edWe can assume that there were isolated wind gusts that exceed the recorded wind speedsThat is proven by the vast damage the wind storm causedPer the RWC book, it states that damage caused by Mother nature and wind storms are not covered by the warranty standardsWe are more then happy to repair the damages shingles on your roof as we have offered to do so with other homeownersIf you believe your shingles did not perform to the manufacture specifications then you are more than welcome to reach out to the manufacture of the shingles ***They do hold a 20yr warranty on their product***.The manufacture installs a tar strip on the back of the shingleAfter the shingle is installed the sun causes that tar strip to bond to the shingles below itOur roofers do not have any part of the sealing processPlease let us know if you would like for us to repair your blown off shingles

All soil has rocks, we do our best when the yard is final graded to scrape clean the top layer but until a yard is established the rain will continue to erode exposing more rocks under the surfaceall of this is gone over before closing when the attached paperwork is signedHomeowner is responsible to maintain erosion to establish the yard

I have attached the report from *** which states it was not a condensation buildup and that there was a leak in pipe and they had to come out and weld itKevin in warranty said my floor would be replaced! As for the lint build up, again I have proof that not that much lint is going up the vent for it to be clogged alreadyI was in my other home for 16yrs with up to people living there and only had to clean out my vent twice in the yrs. The vent runs up the wall and out the roof, so I would say that it is not "easy" to clean outI clean my lint trap after every load and it is just me, my husband and my yr old sonMy neighbor that had the clogged vent with all the insulation stuck in it left by the builder is the only person living in her home, so there is no way her vent should have already been clogged up by lintShe is lucky her house didn't catch fire! I did not see a response on my patio door as wellThey sent the window man out to check the door and he adjusted it and said if it was still leaking, then it would probably need replacedIt is still leakingI keep a board in the door and you can see how the wood in warped from the board getting wetI understand the climate changes, but I didn't have to re-caulk all the time at my previous home eitherI think I just did it once or twice with in the yrsAnd yes, they re-caulked the counter top, but not until after they had to have someone come and screw the cabinet back into the wall. It wasn't just the caulkYou could have almost stuck a toothbrush in between, that's how wide the gap was. So, since they did screw it back and re-caulk it, the caulk has been fineSeems to me it was just poor workmanship the 1st time! If these issues cannot not be resolved, then myself and several other neighbors are going to the news. This is not my 1st house and I am tired of playing the games! I also forgot to note that my clothes rack in my master closet fell down already too! I did fix that myself! I was in an apartment for months while waiting on this house to be built and had the same clothes hanging in that closet, yet it never fell down! So, an apartment is more sturdy than a house!

Again the exterior trim is warranted by the builder for the first yearWood is a product that can not be warranted but we do understand that wood can bow and twist the first year as it goes through climate changesYearly maintenance of painting and caulking is required by the homeowner to up keep the exterior of the homeFailure to do so will result in the wood deteriorating early and other signs of neglectThe builder has parts of the home under warranty for the first two years after that period RWC has the warranty through the year structural periodAgain we offered to fix the issue that the homeowner found even though the age was far past our warranty period but we can not pay for the lack of maintenance over the past 4years

Glad to hear the garage door company took care of the problem

*** *** the siding was put on to tight it is about time you amint that you use unqualified workers and you do not over see their work.Their is other house just as bad in the neighborhood

We can not control the sun in any way shape or formIf we could every day would be sunny and The screen was an suggestion to the homeowner as a possible solution for the problemIf someone's property is damaging another neighbors property The builder is not the mediator between the homeowners Again in the warranty papers that were signed at closing stated the homeowner had read and understood the Warranty book and it clearly states in the Warranty book that " acts of God or mother nature or exemptions from the Warranty period." This is a strange and unpredictable occurrence that is fully controlled by mother nature because if it was cloudy every day the homeowner would not have this issue. I can provide the signature and paperwork if needed

We have a date set in January to have the house looked at during business hours The complaint will be complete when house is fixed

*** *** We did not damage the garage door. The door fell down without anyone around it. I have call the garage door company *** Doors, they gladly came out inspected the garage door and did fix it.We were told by *** Doors, this does rarely happen when two garage doors are on the same frequency. So proof we did not damage the door. But, Arbor Homes did not even try to find out what happened or how to fix the problem. Once they get your signature on the line they are done with you. We have been in direct communication with this customer multiple times today We have a signed purchase agreement, a release to start building his home and multiple addendums, all of which are very clear on not only what they have purchased, but what the penalty is for not proceeding with the agreement This process started on February 13th when they signed their original purchase agreement and was finalized in mid March Ample time for decisions to be made without being rushed through the process as the customer claims We are a business and our models are our showrooms, we cannot expect others who stop by to view the models to not be allowed in our homes when we are working with others This is a standard in the industry.We were informed by the buyer today that they would comply with the default clause The appropriate paperwork was sent to them for their execution.Best Regards,Arbor Homes

We have asked that the drywall company schedule another appointment with the home owner to address his concernsHomeowner is aware that we do not paint drywall touch up spots and with indianas on going climate changes that he will continue to see more cracks and nail pops over the next several
yearsWe only do the drywall touch up one time at the 11month walk through

Cheri is currently on vacation, but wanted to get a response to the complaint prior to the weekend. Our construction manager for this community drove by the property and reported that the trim around the sliding glass door has been replaced and repainted. We have had a history of warranty
repairs on this yard due to the slope of the side yards and not being able to establish the final grade or ability for seed to grow. In response to this issue, we regraded these areas and installed straw mats and reseeded these areas. The remainder of the yard will take time to establish and must be fertilized, reseeded and watered. With the natural soils in this region rock will work its way to the surface over time. As it relates to the construction debris in the yard when we final grade the property we rake every yard in an attempt to remove all the visible debris and rock

The superintendent has reached out to the homeowner to look into this issue moreWe do not warrant garage doors that have been damaged by the homeowner.

The Arbor Home construction manager scheduled two separate times to come out and did not make either appointmentThe issue is still unresolvedWe still have not signed off on our completed construction and we have now been in the home for over two months.
