Direct Business Lending, LLC ("DBL") has reached out to the Customer without success to settle the complaint On or about April 15, 2016, the Customer electronically signed the Funding Assessment and Lender Preparation Package Agreements with DBL Under the agreements, the Customer promised to pay DBL $3,for the Lender Preparation Package consisting of Bankable Business Plan, Business Website, Business Entity Formation, Business Credit Enhancement, Personal Credit Enhancement, and Lender Matching business consulting products As consideration, DBL promised to deliver the products electronically DBL declared that it did not guarantee the Customer any type, kind, or amount of financing The Customer agreed to pay a cancellation fee of $to $1,with DBL When the Customer signed the agreements he certified that he understood the terms and conditions of the agreement.To date, approximately two months after signing the contract, DBL has delivered all the business consulting products for which the Customer has contracted except Lender Matching DBL has not delivered Lender Matching only because the Customer has not completed the other products To date, the Customer has paid DBL a total amount of $ Now comes the Customer and refuses to work on his Lender Preparation Package with DBL, falsely represents the amount of money that he has paid DBL, falsely represents that DBL guaranteed him financing, demands a waiver of the cancellation fee to which he contractually agreed, and demands DBl to refund him in excess of the fees he has paid DBL, even though DBL has completed all but one of the products for which he contracted.In the interests of Customer Service, DBL would like to resolve the Customer's concerns and continue to serve the Customer Alternative, DBL is willing to waive the cancellation fee to which the Customer agreed to close the Customer's account Please direct the Customer to DBL to resolve this matter We appreciate your ongoing consideration Thank you.Enclosed are copies of the Customer's contracts with DBL, the Customer's File Detail Notes Page, and the Customer's File E-Mail Page

Direct Business Lending will provide the information requested by the client in hisrejection response On March 19, 2015, the client was contacted by Shane He spoke to the client and wentthrough the initial call to gather information about his projected business.On March 23, 2015, we received an email from the client at 10:am, asking us how he wouldlike to receive the Articles of Incorporation He was not sure of the exact documents we werelooking for.On Monday March 23, 2015, Shane spoke to the client about how the client wanted to set upLLC's and that he needed to speak with his father on how they wanted to proceed.On Friday, March 27, 2015, we received an email asking for an update on his loan process.On Apri 13, 2015, we were able to verify business filing information.On April 29, 2015, client advised that he is no longer at his parents insurance agency Accepted a new position at a corporate office for a large insurance company.On April 29, 2015, Shane forwarded the client file to our accounts receivable department.On May 19, 2015, the client was contacted and he advised that he would return the call backthat afternoon after 3pm MST.On May 26, 2015, Richard spoke to the client and wanted to hold on the process.On July 10, 2015, we received an email from the client stating he wanted the contract cancelled as he has no authority to sign for [redacted] .On Friday Jul 2015, 11:45am, a Mutual Settlement Agreement was emailed to the client from the Accounts Receivable Department.On July 22, 2015, the accounts receivable department received another cancellation request from theclient stating no authority.On July 22, 2015, the accounts receivable department sent an email response back to the client statingthat the contract was not between [redacted] , but between Direct Business Lending and [redacted] and that the Settlement Agreement and cancellation fee stands.ON July 22, 2015, we were advised from the finance company that the client disputed all paymentsincluding the initial payment As of that date, the client had not paid anything againstthe contract at all.On July 24, 2015, the client was advised that just because payments were cancelled, does notmake his agreement null and void We requested that a ancellation fee of $and thesigned settlement agreement must be in our office by August 3, 2015, or further collectionactivities would resume.On August 28, 2015, client at he did not get clear instructions or emails about thecancellation fee nor the mutual settlement agreement, even though email correspondence wastaking place between Direct Business Lending and the client On August 28, 2015, when speaking to his account representative Valerie, she asked if we could put on the file his work number as we only had phone number that was working.The client stated that "we had enough" on file.Direct Business Lending waited for weeks for the cancellation agreement and cancellationfee to arrive On November 24, 2015, we asked for an updated credit report so we couldmove the file forward.On December 9, 2015, James called the client and client advised he thought this was cancelledin July The client file remains open and active until the Mutual Settlement Agreementand associated cancellation fee and client was made aware of this in the communications.Client was contacted multiple times in January and February to move his file forward As of March 1, 2016, we have yet to receive the cancellation fee and mutual settlementagreement Client was outside of the day right to rescind his contract and has refused the mutual settlement agreement, and the fees associated with it We will attempt to contact client for resolution The offer will stand if resolvedby March 4,

Thank you for bringing this matter to our attentionDirect Business Lending strives to provide outstanding serviceto each and every clientIf we miss that goal we strive to rectify the situation immediatelyOn June 29, 2015, the client signed our service agreement which discloses in multiple places that there are monthly payments The client also supplied account information to make the down payment of $and the monthly payments In checking with the financing company, we confirmed that the client paid the down payment of $and made monthlyinstallment payments All other payments drafted were returned by the client's bank Shortly after signing up, we completed our welcome call advising the client of the services we would provide forthe purchase of the Lender Prep Package On July 3, we provided by email, the client's articles of incorporationto be signed and mailed to the State of Idaho In August, we completed personal credit consultations to designa strategy to clear up red flag issues that would prevent a lender granting a business loan As of today, we stillhave not received the business plan survey, nor the web survey so we can proceed and custom design these items for theclient.The client was emailed dispute letters to be signed and mailed to the credit bureaus We did receive copies of thecertified mail receipts from the client.With regards to the Dunn & Bradstreet issue, all it requires is a simple phone call from the client We can advisethem what needs to be done We were unaware that they had received this letter until this complaint filing.Direct Business Lending requires that the client is current on their payments for the Lender Prep Package to continueworking on the file Once the payment goes days past due, we stop processes until satisfactory payment arrangementsare made or the account is brought up to date on payments.We have talked with the client on several occasions and went over the items that are still needed to complete theirpackage Our compliance department has reached out to the client to offer a solution and an offer to get theirpayments up to date so we can proceed on the file We would like to continue our relationship with the clients and assist them getting funding to help their businessgrow Our compliance department will continue to reach out to the client We will also upload the surveys forthe business plan and website to the client file once they are received.In an attempt to resolve this complaint we reached out to the client and offered to move the file forwardIf any further information is required, please do not hesitate to contact us

As stated more fully below, Direct Business Lending, LLC ("DBL"), respectfully denies every allegation that [redacted] * [redacted] ("Ms***") has made against it, DBL respectfully refuses to refund any fees to Ms***, and DBL asserts that Ms [redacted] is liable to it in the amount of $3,500.00, costs and fees associated with collection, and interest at the rate of 18.99% per annum: To date Ms [redacted] has paid DBL a total amount of $for our Lender Preparation Package On or about May 26, 2016, Ms [redacted] a complaint with the Consumer Financial Protection Bureau after she had previously accepted a settlement agreement and promised not to file any new complaints against DBL with any agencies On or about June 6, 2016, by docusign, Ms [redacted] signed a new settlement with agreement with DBL:a Paragraph Two of the agreement required Ms [redacted] to take the following actions:i To dismiss all actions against DBL.ii To retract previous disparaging statements against DBLiii To take no other actions DBLivTo publish that, "All matters between the parties have been fully settled and resolved to their mutual satisfaction."v To e-mail copies of the dismissals, retractions, and publications that she made as proof to [redacted] .b Paragraph Three of the Agreement declared that, "Within days of receipt of proof that Client has complied with the conditions of Paragraph Number Two of this agreement with respect Client's complaint with the Consumer Protection Bureau, Company shall take the following actions: a)Company shall waive Client's cancellation fee of $1, b) Company shall send Client a refund check in the amount of $by ordinary US Mail.c Paragraph Nine of the Agreement declares that, "If Client and Company do not fully comply with every term of this agreement(t)hey shall pay liquidated damages in the amount of $3,500.00, plus costs and fees associated with collection, with interest at the rate of 18.99% per annum, until paid in full From on or about June to June 9, 2016, even before she had delivered proof of the retractions, dismissals, and publications to DBL, Ms [redacted] demanded DBL to sendher the $settlement check by overnight mail From June to June 9, 2016, Under Paragraph Two of the Agreement, DBL explained that Ms [redacted] must DBL told Ms [redacted] that she must e-mail copies of the dismissals, retractions, and publications that she made as proof to [redacted] Further, under Paragraph Three of the Agreement, DBL reminded Ms [redacted] that the agreement gave DBL up to days from when it received the proof to mail the refund check of $ During that period, by e-mail, Ms [redacted] made the following statements to DBL:a The agreement did not give DBL days to send the check.b The Consumer Protection Bureau did not allow her to publish that, "All matters between the parties have been resolved to their mutual satisfaction.c She kept another copy of the settlement agreement that she had signed and sent to DBL that did not contain the proof of retraction and day provisions In an effort to accommodate Ms***, DBL offered to allow her to send DBL a sworn affidavit declaring that she had complied with the dismissal, retraction, and publication requirements of the agreement Instead, Ms [redacted] took the following actions:a Ms [redacted] refused to sign and send a sworn affidavit.b Ms [redacted] sent a copy of opened and closed cases with the Consumer Financial Protection Bureau that do not reference DBL.c Ms [redacted] admitted that she opened a new complaint against DBL with the Consumer Financial Protection Bureau.d Ms [redacted] continued to demand that DBL deliver the check by overnight mail DBL told Ms [redacted] that until she complied with Paragraph Two of the agreement, by actual copies of her retraction or the sworn affidavit, it would not send Ms [redacted] the check, that Ms [redacted] engaged in fraud by keeping a different copy of the agreement from the one she sent DBL, that Ms [redacted] had breached the agreement for not sending proof of the retractions, opening the new complaint with the Consumer Financial Protection Bureau, and demanding the check by overnight mail, and was liable to DBL for the amount of $3,500.00, costs and fees associated with collection, and interest at the rate of 18.99% per annum Now comes Ms [redacted] and files this complaint with the Revdex.com of Utah Ms [redacted] has breached the Agreement between the parties because, within hours of signing the Agreement, she has not sent proof of her dismissals, retractions, and publications as required by the Agreement, she has demanded immediate payment by overnight mail when the Agreement permits DBL days to send the payment by ordinary US mail, she has filed a new complaint with the Consumer Financial Protection Bureau, and she has filed this complaint with the Revdex.com of Utah Ms [redacted] has committed the torts of misrepresentation and fraud because she has kept a different copy of the agreement that she signed and sent to DBL Ms [redacted] has engaged in extortion because she is relying on her breach, misrepresentation, and fraud to demand a refund for more money than she has paid DBL For each of the foregoing reasons, DBL respectfully denies every allegation that Ms [redacted] has made against it, DBL respectfully refuses to refund any fees to Ms***, and DBL Since joining Direct Business Lending the client’s Business Plan, Website, DUNS were completed Additionally, multiple rounds of Dispute Letters were drafted to clean upred flags on credit reports that lenders would see Mr [redacted] was contact regarding this Revdex.com complaint After discussing his file we came to a resolution by assigninga new account manager that would have weekly contact an scheduled an appointment for 6/1/

Mrand MrsW [redacted] signed our service agreement authorizing payments from their checking account and credit card on February 11, Our average time for funding clients is 4-weeks but that is not guaranteed, as stated in the service agreement We do guarantee however, to work with our clients as long as it takes to achieve funding On February 11th we also outlined the next steps and requested information, verbally and via email, that we would need to complete the business plan, website and that we needed Mrand MrsW [redacted] to verify their business entity since they stated they had already filed for it We also completed a round of dispute letters and let Mrand MrsW [redacted] know that we would need an updated credit report to continue We requested this information several times over the next few months but Mrand MrsW [redacted] refused to supply them until June 2nd Upon receiving the information we did complete another round of dispute letters and we discussed that the cosigner Mrand MrsW*** provided also had red flags on their credit report which would prevent a lender from funding the cosigner Mrand MrsW [redacted] even stated their cosigner’s credit scores were lower than theyexpected We still attempted to move Mrand MrsW***’s file forward and continued work on their business plan-which was sent to them as a gesture of good will even after this complaint was filed Additionally, we also changed account managers at Mrand MrsW***’s request, but MrsW [redacted] only wanted to interact with one specific person-although we explained that we work as a team capacity and from time to time a specialist in one area would need to contact them and such was the case to complete Mrand MrsW***’s DUNS and I-Update for establishment of business credit Lastly, ever since signing up with Direct Business Lending we asked Mrand MrsW [redacted] to verify their business entity as an LLC or to file the Articles of Organization that we drafted with their Secretary of State office so they can fulfill lender requirements On June 6th Mrand MrsW***sent verification they are listed as a sole proprietorship, that filing an LLC was a waste of time and that they wanted to cancel Upon discussing cancellation we reviewedthat since the Articles of Organization were written, dispute letters were completed, the business plan was soon to be finished, that the DUNS was completed, and that the agreement they signed explained the early cancellation fee, about an inch above their signature, that there would indeed be a fee to cancel the agreementWe informed Mrand MrsW [redacted] that as a courtesy we would keep the agreement to the minimum $ [redacted] and we sent Mrand MrsW [redacted] the appropriate paperwork to cancel the file Mrand MrsW [redacted] refused to cancel per the agreement and instead filed their complaint

Complaint: [redacted] I am rejecting this response because: Sincerely, [redacted] this company has closed permanently and I have forwarded my information to the FBI because I believe who ever this MrJonathan W Fink is he is capitalizing on there past clients to extort money from them and this individual has already gotten $total payments from me my husband has investigated this company and Direct Business Lending is no longer in business they have filed bankruptcy and I am forwarding all emails and correspondence to the FBI Im suppose to be appointed an agent in investigating the legitamcy of this individual

If the Customer is willing to sign a settlement agreement, Direct Business Lending, LLC, will waive the contracted for cancellation fee of $1,495.00. We hope to resolve this matter soon. Thank you.

Complaint: [redacted] I am rejecting this response because: I have revived one call since then and am not aware of such emails I seem to get calls before or during work, and the last times I have been connected I have been hung up on after they tell me they will still attempt to collect when I tell that I don't have time to talk because I am going into workThey clearly just also stated that I did most of the work, which I wouldn't have even minded if I got the loan I was promised after correcting my credit to where the initial guy said my credit needed to be, if they can not find that conversation it is most likely because they don't really record the conversations and lie about that as well, because if everything they said I had to do initially to get a loan was done I should have it, but I don't because they lied "scammed" me about certain thingsI would rather have a loan and have my business started than going through all this hassle but as I was told I only needed 10-20more points to get a loan then I turn around and get 30+ more points on my credit just to be told later that it is not high enough I need more points; that is why this is a scam because the score I was told I needed before I signed the papers and the score they told me after I got to that point are two compleat lay different thingsAnd I will not be satisfied till the collection efforts stop and DBL stops hurting my credit even moreI am currently in pursuit of backrupcy thank you DBL you have not helped and should be getting papers soonFor anyone reading this that does not already have great credit and over 3-4K to spend just to get your loan or business started my personal advice would be to look everything up and do it yourself Sincerely, [redacted] ***

On 10/04/2013, MrW [redacted] signed a Sales Agreement contract with Direct Business Lender This was for a Lender Preparation Package wherein Direct Business Lending performed services for the client to assist in getting them funded for their business The services that we offer are: A bank ready business plan, website, preparation of articles of incorporation, business credit consultation and establishment, and preparation of dispute letters and consultation to assist client in disputing inaccuracies reporting on their personal credit report and once their file is ready we submit the file to our lending department Each client case is reviewed on a case by case basis Direct Business Lending completed the Bank Ready Business Plan, Articles of Incorporation, business credit review and coaching, and prepared several rounds personal credit dispute letters Direct Business Lending does not guarantee funding of a certain amount or a certain time frame We do, however, provide services to assist the client to get their business ready for our lending department to present to a lender Our lending department reviewed his file several times but the client file was not ready for submission due to certain criteria required from lenders.In November, 2014, this client was referred to our collection agency as the monthly payments were no longer be made in accordance with his contract Direct Business Lending continued to assist this client up to and including April 22, 2015, at which time our lending department did a proactive review of the client file Due to discrepancies still showing, they were unable to submit to a lender Direct Business Lending continued to work on the client file for months after the account was sent to collections and their monthly contract payments stoppedAs always, if there are any additional questions, or if we can provide further information, please contact us.Respectfully,Direct Business Lending

Complaint: [redacted] I am rejecting this response because, for a week I tried to get in touch with someone from Direct Business Lending via phone For a week, I was placed on hold each time I called and could never get to a human person to speak to I left several messages for people from the company that I had already spoken to, and was never called, or even emailed back After the first initial week or so, the only contact from the company was from what seemed to be automated emailsMy issue is no one started calling me back until after I emailed them seeking to cancel the relationship as it seemed to be dragging on in an attempt by them to make money from me only This company did not care about my dissatisfaction until I reversed the payment on my credit card If you look at their timeline, it does show a complete void in any contact for an entire week at the beginning of December I think this company is very un-customer friendly and too big to know what anyone else in the company is doing Sincerely, [redacted]

Complaint: [redacted] I am rejecting this response because: The reason I am rejecting their response is based on three items in the company's response.We emailed the certified receipts showing we have mailed the three letters to the cerdit bureaus on Aug28, to [redacted] @directbusinesslending.com and never heard back from the company.We emailed DBL a copy of our LLC certificate and the first letter we got from Dunn and Bradstreet on July 2, and got a response saying it had been uploaded to our files and that was all we received.As far as the business plan assessment and website survey, we never received them until we made contact with the company the first part of December We were informed that these would be the last step of the process.At this time we do not feel the company has held up their end of the contract as we had not heard anything from them since the middle of Aug until now We do not dispute that we quit making the payments At this time we would like original payment refunded, which is $329.00Sincerely, [redacted] ***

MsJ [redacted] signed up for our services on 2/2/In the following days we had some conversations with MsJ [redacted] regarding information we needed to complete our services and on 2/8/we sent her Articles of Organization that she needed to file to register her business with the state of Florida By 1/12/we completed MsJ [redacted] ’s business planDuring the next two weeks we completed a personal credit appointment, called MsJ [redacted] to follow up on her file and she also called in as well We also completed a round of dispute letters for the credit bureau reporting agencies to clean up read flags that would disqualify the client for funding In the month of February we discussed the credit bureau responses that MsJ [redacted] received, conducted a lending review and MsJ [redacted] expressed a desire to cancel her account since her family wasexperiencing medical and financial difficulties After a week of attempting we reached MsJ [redacted] regarding cancellation and a payment deferment Over the next month any lack of communication was due to waiting for a decision by MsJ [redacted] regarding cancelling or continuing After receiving an email from MsJ [redacted] in April we called and discussed next steps MsJ [redacted] informed us she had not sent in her Articles of Organization to register her business with the State and MsJ [redacted] said she was unhappy with the business plan we created for her The next steps we need to take, such as establishing her business credit profile, are contingent on having the Articles of Organization filed with the state We also completed another draft of the clients business plan and over the next several weeks we repeatedly requested an updated credit report to remove red flags that lenders would see, but MsJ [redacted] has refused to provide oneAdditionally we advised MsJ [redacted] on ways to get sales revenue so she could file her Articles of Organization which would allow us to take next steps to reach her funding goals but she was unwilling to move forward MsJ [redacted] has reiterated her desire to cancel her account According to the contract MsJ [redacted] signed we have drafted Articles of Organization, completed the business plan with revisions and completed a round of credit consultation with dispute lettersThe contract also outlined the cancellation procedure including that there would be an earlycancellation fee to dissolve the contract The work we completed would warrant a cancellation fee up to $ [redacted] , however in a gesture of goodwill we will cancel MsJ [redacted] ’s file for the minimum fee of $ [redacted] We will email the settlement agreement to MsJ [redacted] When she signs and returns the settlement agreement and takes care of the early cancellation fee her account will be cancelled

Thank you for bringing this matter to our attention, Direct Business Lending strives to provide an outstanding experience to each and every client and if we miss that goal initially, we strive to rectify the consumer's experience immediately We have reached out directly to the client on several occasions, with no result Client purchased the Lender Prep Package on March 23, Client has suggested that he did nothave authority for the company to purchase said services The Lender Prep Package PurchaseAgreement is between Direct Business Lending, and the individual, [redacted] *** Client initially had a different perception of our services versus what our company’s servicesWe clearly outlined we would not be communicating each and every day but we would provide status updates and information on the account when it’s availableThere have been many attempts tocontact client by email and voice messages Also, Mr [redacted] had a team of specialists working on his file at the same timeThere was an assigned account manager, a web designer, a business plan writer, a personal credit team, a business credit team, and an entityteam It is a team effort so as to get the client to lender matching as quickly as possible.Client was sent a Mutual Settlement agreement to cancel his services with Direct Business Lending onJuly 10, As a good faith effort, we assessed the lowest cancellation fee of $ Several reminder notices were sent to the client advising that we had not yet received the cancellationagreement and that his contract is still active until the cancellation process is complete and thecancellation fee received The Mutual Settlement Agreement has expired due to the length of timethat has passed since it was originally sent to the client.Please do not hesitate to contact us with any questions you may have regarding this file

Direct Business Lending will respond to the client's answer.Direct Business Lending was not aware of any card disputes until December 16, The day we answered the complaint This information was supplied on the first response.In the initial comment from the client, the settlement was such that she did not want any further contact from Direct Business Lending, and her information destroyed.This request was processed as of the date of the first complaint.Direct Business Lending will not do any further business with this client
