I am rejecting this response because:While Ryan Homes has proposed two solutions to the problem, they have not followed through with the promised solutions within the timeframe that their own team members have indicatedAlso note, in our meeting we decided to proceed with building with Ryan Homes contingent upon the issues above being remediedRyan Homes proposed two solutions to the physical problems with our homeThe solutions indicated were as follows: a structural engineer was to evaluate our crumbling foundation and create a stamped report with recommendations on how to fix / if a fix is required, and the home was to be supplied with new housewrap as indicated by the project manager when the problem was first brought to his attention the week before this complaint was lodgedBoth of these items were to be completed by today, Friday, 4/24/as proposed by Ryan Homes and as indicated in our meeting notes submitted to Ryan Homes after the meeting noted belowAs of today, 4/24/at 7:pm, the housewrap has not been replaced as promised by Ryan Homes and we have not received a structural engineering reportRyan Homes has commenced with putting trim over the portion of the foundation that is crumbling (hiding the issue).The other issue discussed in our complaint was a lack of accuracy in communications from Ryan Homes staffWe met with the project manager, Josh L***, and Steve L***, the production manager for our division, during the meeting noted in Ryan Homes' response and aboveDuring this time, I asked Josh and Steve about why there was no blocking to prevent the floor joists from rotating in placeBoth men rushed to assure my husband and I that Ryan Homes no longer uses blocking between their joists as it creates squeaking issuesI asked them to see their construction drawings at this same meetingBlocking was clearly shown as required between the joists, and particularly in the area that I had asked aboutAdditionally, this week the Ryan Homes quality control team member has marked the areas in question as requiring blockingIt is concerning that during a meeting to address a complaint about poor communication and lack of communication, both members of Ryan Homes's staff rushed to tell us something that was patently untrueI'm assuming that this occurred either because they didn't know the answer and just made something up, or because they have been trained to minimize customer questions and complaints by creating easy falsehoods that an un-knowledgable customer would never think to questionAdditionally, they have communicated promises that Ryan Homes has again not followed through with
We will continue with our complaint and will request our full money back and termination of the contract if these issues are not resolved

The answer to our complaint is very interestingWe cannot see the mold because it's under the house and not possible to see, Ryan Homes knows this, also "NO ONE HAS BEEN HERE SEVERAL TIMES" on the flashing, my service requests have been ingnoredI can provide screen shots if needed on ALL REQUESTS that have gone ingnoredThis response is simply a push aside answer that is not acceptableNO person has been in this home to smell anything from RYANThe flashing is still bent

I am rejecting this response because:
The floor in the bathroom around the leak area as well as the wood at the tub structure needs to be replaced as it is rottedOther than this issue, we will accept this as satifactoryWe will take on the responsibilty of the yard but let it be noted that our complaints started immediatley upon moving in with regards to the “tunneling” as well as NO top soil and dead grassThe complaints were just not taken in to true consideration

soil at the foundation (about 3’ deep) at the front of the consumers unit from the gas meter to the porch and replace with gravel and a drainWe will also be installing a landscape burm on the high side unit next to the consumers to direct run off from the neighboring unit to a drain at the low point of the mulch bed. Thank you for the opportunity to review the Revdex.com assigned ID ***NVHomes has reviewed the consumers’ complaint and disagrees with his assertions that NVHomes is trying to “fool” customers regarding the ceiling height in the basement media room of his home which is
currently under construction
NVHomes has, in fact, we have made every effort to disclose his ceiling height properly prior to him completing his purchase agreement with NVHomesThe consumer did purchase the product/floorplan which is also the model home within this communityHe is correct that the construction of the ceiling in the media room of the NVHomes model no longer matches the actual design of homes being built in the communityNVHomes made significant changes to the media room ceiling design based on feedback from numerous customers who had purchased the original media room layout and did not like the ceiling designMore specifically, the prior design had numerous sections of the ceiling that dropped down resulting in an uneven appearance
NVHomes updated the ceiling design for the media room to address these concerns prior to this consumers purchaseWhile the consumer did review our older existing model home with the previous layout every effort was made to disclose the new ceiling designMore specifically, the NVHomes salesperson took the consumer o review the media room of another home that was completed to demonstrate the ceiling layout he would be receiving instead of the design in the model homeThe visit to this other home was made with the sole purpose of showing the consumer how his ceiling would look and confirming that he understood his home would be different from the modelIn addition, the purchase agreement the consumer signed with NVHomes states that NVHomes builds per the blueprints because there are oftentimes updates/improvements made to model homesBlueprints were made available to the consumer which shows the new design of the media room ceiling prior to him completing his purchase agreement
The consumer states in his complaint that NVHomes should have told him his ceiling would be different from the model homeNVHomes did in fact inform *** *** before he agreed to purchase from usFurthermore, when the consumer first brought his concerns to our attention after seeing his home under construction NVHomes offered to completely rebuild his ceiling but required the consumer to pay for the changes as this portion of the home was already builtThe consumer did not respond to our offer to pay for this change even though we pushed our deadline back several times in a desire to accommodate his requestsAs a result, as communicated to the consumer NVHomes will make no changes to the ceiling design in his home under construction
