Upon completion of this process, we will provide the results of our investigation directly to the consumer.Regarding our investigation process, Experian contacts the source of the disputed information directly by letter, telephone, or through an automated verification system. We ask the source to check their records to verify all of the information regarding the item questioned, and report back to us within 30 days of the date that we received the consumer's request. Once we receive their response, we send the consumer the results of the investigation. If we do not receive a response within 30 days we update the item as requested or delete the information, and send the consumer these results.According to the Fair Credit Reporting Act (FCRA), a consumer reporting agency's role in the dispute process is to investigate the information to determine the accuracy and completeness of any disputed item by contacting the source of the disputed information and informing them of all relevant information regarding the consumer's dispute. If the issue is not resolved, then the consumer reporting agency must offer to include a consumer statement on the personal credit report. The FCRA does not require that the consumer reporting agency obtain documentation such as the actual signed sales slips, signature cards, contracts, etc., nor does it require that consumer reporting agencies act as mediators or negotiators in account disputes. Although the court where the disputed public records are filed may not report this type of data, a vendor may collect this data directly from the court's public records and supply that information to Experian.Our records indicate that through our vender, we initiated investigations of [redacted] at the source on 02/15/2016 and again on 03/03/2016. In each instance, the accuracy of the information was verified by our vender with results of each investigation being provided directly to the consumer.If your bankruptcy was dismissed or withdrawn, it appears on your personal credit report because every action that relates to credit may become part of your credit history. So even though the court did not allow the completion of your bankruptcy, the fact that the case is documented allows it to appear on your personal credit report.Any further concerns regarding the disputed information may need to be directed to the source. [redacted] #[redacted]   The response by the Experian representative is informative, but it has no merit to my credit profile.   According to the Experian website [redacted] states that indefinite accounts refer to “open accounts” with no negative history.    It states, (1) “Open account with no negative payment history: remain as long as they are open and active.”   My Experian report lists neither accounts from [redacted] are open/active they list as closed.  Although, they do not accurately show the dates of closure so they do not meet the standard of remaining on Experian Credit report as indefinitely, because they both closed in 2006.   (2) Closed accounts with no negative payment history: remain 10 years for the date they are closed.    This supports my statement that Experian removes the payment history allowing negative credit history to change from derogatory to positive credit and extends the length of the account, but will leave all negative statements for a total of 11 years; this a gross negligence against the FTC of rules by resetting reporting periods.  Experian does this in order to leave negative history attached to a consumer file.    Because of this information, Experian has removed payment history from the accounts from [redacted] and other that are due to expire so they can remain.   The history of credit reports from 2009 to 2013 derogatory credit history has been attached to [redacted]. The first account for [redacted] for (344,000), is listed under negative accounts, on Experian credit report dated 4/29/2010 the credit report status: Foreclosed: account history:  Foreclosure as of Jun 2009: foreclosure proceeding started as of Sep 2008, Aug 2008, Jul 2008, Jun 2008, May 2008, Apr 2008, Mar 2008, Feb 2008, Jan 2008, Dec 2007, Nov 2007, Oct 2007, Sep 2007, Feb 2007, Jan 2007, 150 days, past due Dec 2006, Oct 2006; 120 days past due Aug 2007, Nov 2006, Sep 2006; 90 days past due as of Jul 2007, Jul 2006, Jun 2006; 30days past due May 2007, May 2006, Apr 2006; This account is scheduled to continue on record until Jan 2013.   The second account for [redacted] for (86,000), status: transferred, closed: account history show on 4/29/2010, 150 day past due as of Oct 2006; 120 days past due as of Sep 2006; 90 days past due as of Aug 2006, 60 days past due as of Jul 2006, 30 days past due Jun 2006, May 2006; creditor’s statement; “account transferred to another lender.”   Reports dated 2010, 2011, and 2012 are the same until 2013 when the account should have been removed.  [redacted] (86,000) moved from negative to positive and the negative payment history was completely removed and changed to 2006 to: “ok” for Feb- Apr, with “ND” from May-Nov and Dec reads “ok” and 2007, Jan “CLS” now the status reads transferred, closed/never late.  This account is scheduled to continue on record until Jan 2017.  Extending the dates of reporting from 7 years to 11 years.    As for the [redacted] (344,000) in 2013 when it should have been removed it too payment history was removed and extended to 2016.  If the representative would also refer to Experian report dated 10/24/2011 on [redacted] it clearly shows Experian intent on credit reporting laws.  The account from [redacted] gives a status detail that says, “by Oct 2017, this account is scheduled to go to a positive status with an account history showing over a 120 days delinquency which never recovered.  Experian plans to do the same type of violation to this account as well because once the information was stated they removed the credit history.  Once again they remove negative history to extend reporting date, is in violation of 15 U.S.C. § 1681c Section 605.       (3) Positive accounts remain on your credit report longer than negative accounts   Late payments remain seven years from the original delinquency date.  A single late payment is deleted at seven years.  If there was a series of late payments (not paid at 30 days, or 60 days, or 90 days) and then brought current, the payment would be deleted seven years from the first one missed in the series.  If the account was never brought current and charged off and placed for collection, the entire account will be deleted based on the date the account became late and was never again current.  This is known as the original delinquency date.      [redacted] accounts was never positive and should be deleted.  The account histories are false because the dates of current payments apply after the account foreclosed in 2007, according to ** County records, so this history is inaccurate as well as the date of foreclosure that Experian is reporting on the report.      [redacted] accounts, should have been deleted in 2013, not the current scheduled for removal in 2016, nor 2017.  This inaccuracy confirms the inaccurate reporting made by Experian.    Experian is reporting shows that there was no break in the negative dates of history the account from [redacted] until 2013 when it should have been removed according to law and because it did not is violates and goes beyond the statute of limitations indirect violation of 15 U.S.C. § 1681c Section 605.     In October 2006, the accounts were closed, one account was transferred, both foreclosed, and neither recovered from default in 2006, which lead to a foreclosure in 2007. Experian even violates its own policies when it comes to the reporting of accounts listed on my Experian report.  I would like to have both accounts removed, they are in violation of government laws.

In both instances the creditor responded that the account was accurate as reported. Results of the investigations were provided directly to the [redacted]
Because the information was confirmed accurate with the creditor, we must respectfully decline the request to remove it from the Experian credit report.Our records further indicate that we received requests for investigation from the consumer on 4/11/2016 and 2/12/2016. Based on the information provided by the consumer in those requests, the account was not appearing on the Experian credit report. We responded to the consumer each time indicating the same, providing a complete Experian credit report for review.If the consumer disagrees with the results of the investigations, it is their legal right, under the FCRA, to add a 100-word statement specifying the nature of their dispute. The statement will appear with the item as long as the item remains on the credit report. Upon completion of this process, we will provide the results of our investigation directly to the consumer.Regarding our investigation process, Experian contacts the source of the disputed information directly by letter, telephone, or through an automated verification system. We ask the source to check their records to verify all of the information regarding the item questioned, and report back to us within 30 days of the date that we received the consumer's request. Once we receive their response, we send the consumer the results of the investigation. If we do not receive a response within 30 days we update the item as requested or delete the information, and send the consumer these results.According to the Fair Credit Reporting Act (FCRA), a consumer reporting agency's role in the dispute process is to investigate the information to determine the accuracy and completeness of any disputed item by contacting the source of the disputed information and informing them of all relevant information regarding the consumer's dispute.
