Upon completion of this process, we will provide the results of our investigation directly to the consumer.Judgments, Tax Liens and Bankruptcies are a matter of public record. Although the court where the disputed public records are filed may not report this type of data, a vendor may collect this data directly from the court's public records and supply that information to Experian.The Fair Credit Reporting Act (the FCRA) places no limits on credit reporting agency's use of third party venders to investigate public records.If your bankruptcy was dismissed or withdrawn, it appears on your personal credit report because every action that relates to credit may become part of your credit history. So even though the court did not allow the completion of your bankruptcy, the fact that the case was documented allows it to appear on your personal credit report. The bankruptcy dismissed/Withdrawn status will remain on your report for seven years from the filing date.When a consumer disputes the accuracy or completeness of information on the personal credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. We contacted the data furnisher to verifythe accuracy of what is being reported. They responded on February 6, 2015, the item is reportingaccurately.If a bankruptcy was dismissed or withdrawn, it appears on the personal credit report because everyaction that relates to credit may become part of the credit history. This message, which will expire after 7 years, alerts credit grantors to verify the consumer's identification in case someone is using their information without their consent.We are currently investigating the information with which the consumer disagrees. Upon completion of this process, we will provide the results of our investigation directly to the consumer.Research indicates that we have no record of written or telephone communication from the consumer requesting that a security freeze be placed on her Experian credit report.At this time, we are unable to honor the request to add a security freeze to the consumer's personal credit report using the identity theft report that was sent us by the consumer, because it does not meet our criteria for a valid identity theft report. A valid identity theft report is an official report filed with an appropriate federal, state, or local law enforcement agency, including the U.S. Postal Inspection service, Department of Motor Vehicles, or others, the filing of which subjects the person who filed the report to criminal penalties if the information filed is false. The identity theft report should include as many of the following elements as possible specific dates such as when the loss or theft of personal information occurred or when the fraud(s) occurred; how you discovered or learned of the theft any known information about the perpetrator, the names of creditors and account numbers involved in the theft, name and/or badge number of the law enforcement personnel who processed the report, the filing date and case number. If we do notreceive a response from the furnisher or the vendor within the required period, we update the item asrequested or delete the information, In some instances, upon reviewing the credit file and any relevantinformation submitted to us, we are able to determine whether the disputed information should bechanged or deleted without having to contact the furnisher or the vendor. Investigations can take aslong as 30 days to reach a conclusion. After we complete our processing, we send the consumer theresults.In addition to the consumer's right to dispute information in the credit file with the credit reportingagencies, the consumer also has the right to dispute information in the credit report directly with thefurnisher of the information.If the consumer questions the results of the dispute process, then they may want to contact thefurnisher of the information directly or review the original information in the public record.
