Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my dispute Please enter your reason(s) for rejecting the business response below.Merrick aka First American Payment Systems received today, 10/14/(see attachment for confirmation of delivery by UPS with tracking number) the Talento terminal that didn't work for over a year, the Charity terminal that worked but would not accept checks because they didn't equip it with the proper "chip" to work with the check reader, the check reader that didn't work, and the new check reader they sent me that worked with the Talento but would not work with the Charity 100, the power plugs for the aforementioned antiquated, substandard, primitive out-dated equipment that I repeatedly had problems with and complained about The lease terminated on 9/10/ I no longer have the equipment, Merrick has all the equipment it sent me over the last years and therefore their demand for $fails for lack of consideration and results in an unfair windfall to Merrick aka First American Payment Systems aka Apex aka Secur-chex or whatever name they are calling themselves these days when I have no capacity to use their equipment since I no longer have it, they have it I should not have to pay these people another penny My understanding of the contract was that it was lease to own but I sent the equipment to them because I don't want the clunky mess at my office and now they have it to sell to another victim This company has had at least complaints with Revdex.com alone, and the internet is full of nightmare stories from very unsatisfied customers, this company should not be allowed to rob me any further Regards, [redacted]

First American Payment Systems / Payscape acknowl**g [redacted] that the multiple failures in our cr**it card processing were equipment relat [redacted] and they had no resolution to the ongoing problem I made multiple attempts to contact [redacted] , Leasing Administrator for Merimac Capital to discuss the issue Every call was met with a "he is not available" response He fail [redacted] to return any voice mails or respond to faxes sent On Jan5thI fax [redacted] notice of cancellation to Mr [redacted] along with a request to provide information for equipment return (see attach**) Again no response was receiv**First American Payment Systems / Payscape sent notice that my account met the eligibility requirements and early termination fee was NOT assess [redacted] (see attach**) Merimac Capital fail [redacted] to meet their contractual obligations by properly processing cr**it card transaction, but is relying on their non/cancellable contract to continue to collect They fail [redacted] to provide equipment return instructions and just bill for the equipment I do not agree with their response to the complaint

Our cr**it card processing service work [redacted] great for years before we began experiencing double charges on our customer’s purchases Each time we contact [redacted] Payscape (contract administrator) we were referr [redacted] to First American Payment System for customer service as well as technical support Each time they inform [redacted] us that the double charge should not possible but acknowl**g [redacted] that it had occurr** Their belief was that it was equipment failures but had no solution I sent a letter detailing my issues to the Payscape CEO (see attach**) on October 22, 2015, but never receiv [redacted] a response After the 5th occurrence, I spent several hours tal [redacted] with ***, [redacted] and [redacted] (Director of Support Payscape) I attempt [redacted] to have the issue resolv**, but they could not provide an answer They referr [redacted] me to James in customer retention First American Payment System who fil [redacted] an issue ref# He cancell [redacted] the processing contract and referr [redacted] me to [redacted] (Leasing Administrator) to address the equipment contract (Merimac Capital) She cancell [redacted] that contract and sent verification to me as well as her supervisor [redacted] She also connect [redacted] me to her supervisor’s voice mail to leave a message about waiving the cancellation fees I also sent a fax (confirmation provid**) to Mr [redacted] to confirm the voice mail There was no response to that or any subsequent voice mails The only response that I have receiv [redacted] has been the collection notice from [redacted] *allis It is very frustrating that Ms [redacted] would suggest that they have not been contact** This was the same response that I receiv [redacted] from Payscape Director of Support (see attach**) I am sure that Ms [redacted] is very aware that all conversation are record [redacted] by First American They inform [redacted] me that they pull [redacted] these recording to review my calls before deciding to refund the Payscape fees Had equipment replacement been the resolution, I would think that their technical support group would have suggest [redacted] that occur They also bill [redacted] for the equipment (see attach**) even though they fail [redacted] to provide return instruction (see fax confirmation to [redacted] ) If they want the equipment, they should provide return instructions.As one can see, we have tri [redacted] to reach a resolution with First American Payment System / Payscape Advisors / Merimac Capital for several months Changing cr**it card processing companies is not an easy or smooth process and we would have much preferr [redacted] to continue our business with Payscape Advisors, but this was not possible with these errors occurring with our customer purchases They have repeat**ly refus [redacted] to provide an escalation process to resolve problemI again request that Merimac Capital cancel all billing associat [redacted] with the equipment lease I also request that they STOP all collection attempts from all First American Payment Systems business groups and recall any negative reporting against my business or personal cr**it with any cr**it bureau Issue a letter from First American Payment Systems releasing my company from any and all contracts and fees associat [redacted] with this business relationship

Dear Ms [redacted] : We are in receipt of Mr [redacted] complaint In response thereto we have enclosed the Merchant Application & Agreement (“the Agreement”) and the Merchant Processing Terms & Conditions (“the Terms & Conditions”) for your review On October 31, 2016, Mr [redacted] entered into an online credit card processing Agreement with First American Payment Systems (“First American”)By digitally signing the Agreement Mr [redacted] acknowledged to have read, received and agreed to be bound by the Agreement and the Terms & Conditions (See page of the Agreement)Our records indicate that Mr [redacted] informed the System Implementation team on November 1, that he did not accept the contract until he spoke with his sales rep, and had not agreed to process with First American yetThe Merchant’s account still was opened, with the information provided in the original digital application, and was charged accordingly when the end of the month fees were drafted from Mr [redacted] accountFirst American spoke with Mr [redacted] the next day about the fees, and agreed to close the account as it was not supposed to be opened in the first placeAlso, First American attempted to refund the fees to Mr [redacted] that was charged for the month end of OctoberMr [redacted] put a stop payment on the original fees that were charged on November This resulted in Mr [redacted] getting the $back from his bank, and the amount back from First American as wellWhen First American automatically drafted another $from Mr [redacted] account due to the fact the account was still open in November 2016, Mr [redacted] put another stop payment on the draftAgain First American attempted to refund Mr [redacted] when it became aware of the charges, and again Mr [redacted] collected funds back from his bank and from First AmericanTo date, Mr [redacted] owes First American $from the refundsFirst American has not attempted to scam or otherwise negatively affect Mr [redacted] or any of its merchantsThis situation has been a result of multiple incidences that led to Mr [redacted] dissatisfactionWe have attempted to correct the matter at the same time that Mr [redacted] stopped payment and the result was a double correction and led to Mr [redacted] small debt to First American that he mentioned in his original complaintIf Mr [redacted] would please send a check in the amount of $to the ACH Department Reference No5623322, First American Payment Systems, [redacted] ***, we can close this matter amicablyAs a good faith gesture at this time, the collections amount and efforts have been removedMs [redacted] corrected the issue December 12, when she was informed the account never should have been opened so Mr [redacted] did not owe First American for any early termination fees or collections fees that were charged as a result of the ACH rejects from Mr [redacted] accountMr [redacted] account has been removed from collections and we ask that he disregard the collections letter he received as it was unnecessaryIn summary, First American has closed Mr [redacted] account without penalty, and will not be pursuing any further collection efforts against MrSpatigWe regret that Mr [redacted] has had the troubles he’s had so far with the account processWe hope going forward, that Mr [redacted] will not be prejudiced against First AmericanWe appreciate your attention to this matter Should you have any questions or need any additional information, please do not hesitate to contact the undersigned directlySincerely, [redacted] ***, Merchant Relations

This company entangles you in contracts that you cannot possibly entangle yourself fromFor example, if after the term on the lease, you do not notify within days BEFORE your contract automatically extends one more year with a $termination fee If you have two accounts, and they are not issued on the same day, you cannot terminate you account The lady in collections is rude, calls you stupid and worseShe will not work with you in any manner except on the phone, she says that she is allowed to records the conversations, however we are not allowed to recordShe keeps threatening to ruin my credit and will not work to resolve this problem

What a scam, they sell you a machine that has a 1year manufacturer warranty, but then claim it only has a day warranty We purchased a mobile processing unit an ingenico iWLin August of Ingenico clearly states the unit has a year warranty, however, First American will not honor the warranty stating it only has a day warranty The chip reader stoped working months from sale The company has not been helpful in supplying any information on how to return the unit to the manufacturer I called in and asked to speak with a manager, and instead they forwarded me to my ISO or "payment facilitator" So not only will they not honor the manufacturer's warranty, they will not help getting the unit repaired under warranty at all And to boot, when you ask to speak to a manager they just transfer you around Buyer beware!!!

First American Payment Systems DO NOT DO any business with this company. When you are approached by a sales person they will do all they can to sell you, including offering you $500 if they can't beat your current rates, but never mention the words LEASE, CONTRACT, or EARLY TERMINATION FEES. Only the name of the 3rd Party "MCG" was mentioned, and not First American Payment Systems, They will lead you to believe that they are offering you a Credit card processing rate of $49 per month, 1% for credit card and 0% for debit. After having hundreds of dollars come out of your bank account and a lot of research, you realize, that amount was for equipment only, in my case equipment that I could not use. The salesperson will never mention anything about the high percentage credit card processing fees. Complaint: [redacted] I am rejecting this response because:All dealings with any credit card charges that are processed manually at our office are processed by First-American.net It is also this company that I have called regarding the charge If the charge is Elliot Management then why is everything (internet and phone) referred to as First-American? If First American deals with Eliot Management then they should be the ones dealing with Eliot Management - my contract is directly with First-American and the fees I am charged are made and taken by First-American I most definitely do not accept this very obvious attempt to offload my complaint and not fairly represent their customer Regards, [redacted] ***

Our business merchant account with Chase Paymentech was closed in the summer of 2016 with our sales agent and they confirmed the account was closed. Apparently, Chase Paymentech was sold to First American Payment Systems in 9/2016. Unknown to our company, the new owner, First American Payment Systems continued to automatically debit our checking account each month but the charge was listed as "Bankcard Mthly Fees" - which we assumed was our bank charging fees, as described. End of June 2017, after we had closed our checking account we received collections notice from First American Payment Systems. It has come to our attention that this company has continued to charge us under a misleading description and now will not close the account or refund the amounts. In total, First American has debited our account $263.50 under a misleading description, as if they were purposefully trying to hide the charges. Now this company has us in collections for $197.00. We started an E-commerce website with Altiras technologies as our on line store agent They were to supply an on line gateway for charging customers and the actual store interface for our website As well as mobile pay swipers we were sent an agreement of terms through our agent from Altiras and then we were contacted by their sub contracted Store management company GO-E merchant which was actually First American They sent additional contracts to sign that were different than our original agreement with Altiras We were assured by Altiras that the original terms were still in place and they had a "Special arrangement" with First American After using the companies services for days we came to realize that the fees for the service were just to high As per our original Altiras agreement, we were able to cancel our service with no cancellation fees We still have this agreement if needed when we canceled the service, First American wants to charge us $fee Altiras
