I sold my business in June of and after contacting our Account Executive to come help process the paperwork for the new owner to take over the contract, bank account and merchant account I was told all appropriate files were completedWell, I get a call about months later from a [redacted] who is with this company asking me about fraud activity on "my merchant" accountI told Mr [redacted] I do not have a merchant account with you, I sold my company to [redacted] and he is the owner of that merchant accountIn fact, it was moved to his own bank tied to his name at the closing of my businessMr [redacted] tells me "no"! I was going through the application process for applying for a credit card processing serviceI decided it wasn't going to work because of the high fees to work with my CRMI agreed with the gentleman that would be cancel the applicationNow I find out that first American claims I agreed to a contract at $a month with a $cancellation feeI never entered into a contract

Their representative, [redacted] , was never supposed to put the application in It was always supposed to be placed on hold until I gave her the ok I have emails from [redacted] stating that she is supposed to put in on hold She has emailed me several times in December and January stating if I am ready to move forward, and I told her NO The representative had illegally put my paperwork through First American Payments without my permission so she can get her commission In the email, she also states there will be no termination fees and it is month to month The only time there is a termination fee and contract is if they buy over my other merchant account which they didn't All of this is in email Jennifer [redacted] illegally put my paperwork through the system eventhough I told her not to She pressured me to sign the agreement and said it will be on hold until I am ready I never thought she would put it through Many other people on Revdex.com had also stated that this company's representative pressured everyone to sign right away and let the customers deal with the after effects even though we said we are not ready I think the company fraudulently put my paperwork through I repeat, I have over emails between me and them stating I am not ready and do not do anything with my application!

We are in receipt of Mr. [redacted] complaint. In response thereto we have enclosed the Merchant Application & Agreements (“the Agreements”), the Merchant Processing Terms & Conditions (“the Terms & Conditions”), and the Non-Cancelable Leases (“Leases”) for your review. By... way of background, several security measures are performed to ensure the identity of the merchant is validated in order to submit the online Agreements and Leases. The online submission process is initiated by the sales representative who completes the required information on the application using the information provided by the merchant. Upon completion, the application is submitted to the merchant by email for review and approval. The email received by the merchant contains step-by-step instructions for submission of the application. These instructions include several security questions the merchant must answer correctly to validate their identity and access the application. Upon access, the merchant reviews the application, which clearly shows the rates and fees and terms of the Agreement, as well as the term and fees of the Lease. The merchant must check several boxes acknowledging acceptance of the Agreement and its terms and conditions. At the end of the electronic form, the merchant is provided the option to accept the application by filling in their name, or decline the application and provide a reason. The merchant is given an additional opportunity to review the Lease information and type his/her name for the Lease acceptance. Once the merchant fills in their name, the electronic signature of the merchant is acknowledgment of the agreement and the IP address of the device used by the merchant to accept the application is recorded and stored for further verification. The IP address in this case verified that the Agreements and the Leases were agreed to from within the merchant’s general area. The merchant electronically executed three separate Agreements and Leases on 12/14/2015. By electronically signing the Agreements and Leases, the merchant agreed to have received, read, and be bound by the Agreements, Leases, and the Terms & Conditions. The merchant utilized the equipment on all three accounts to process transactions in early 2016. In June 2017, the withdrawal of the account charges was stopped by the merchant’s bank account, leading to an immediate closure of each processing account, and the entire balance of the Leases and processing fees was forwarded for collection. The Leases clearly state at the top of the Lease and in paragraph 2 of the Merimac Capital Terms & Conditions that the lease cannot be cancelled by Lessee during the term agreed to. Additionally, First American has not received any equipment from this merchant. At this time, the balance stands at $5,638.88 for all three processing accounts and the three Leases, which the merchant has defaulted on. We have been in contact with the merchant to discuss the responsibility of the merchant and offer a settlement amount to close the balances. In an effort to resolve this matter and in a gesture of good faith, First American will accept the reduced payment of $2800 to resolve the matter and close the balance in good standing. The merchant can contact [redacted] to make payment arrangements at [redacted] . We appreciate your attention to this matter. This company held my funds that were to be sent to the merchant I called them and complained They are now hiding behind a smoke screen by saying they can not address the complaint without details which I cannot provide over the Revdex.com website per website instructions They have done this to more than one person as shown by other complaints They should not be allowed to hold funds for days and affect relationships between customers and merchants without recourse from either buyer or merchant I cannot understand how this company with so many complaints achieved an A+ rating from Revdex.com

RevDex.com: I agree that the company was going by the letter of the contract. There is no scam or illegal activity. My only complaint is that the company utilized a contract structured in a way that made it most difficult for a customer to cancel it. We had not used the service in a long time and there was no cost to the company, just the monthly draft from our bank account for services that we were not using. If they gave us free equipment on the front end or something else of value that we needed to pay off through a contract, I would understand. There was simply no good reason to charge a cancellation fee other than the contract said they could. Let's not forget the fact that I sent a fax as requested at the correct time, but the company said they didn't get it. There is no way to prove if they received it or not, so this fact simply gets pushed aside, and the company certainly doesn't take it into consideration. It's simply not good business. I see that the company is not going to change their mind on this, so I reluctantly consider the matter resolved. Regards, [redacted]

I had a contract with this company in to lease an ipad & printer for my POS system, I think they tricked me into a year non cancelable contract that I wasnt aware of, however when I called & spoke with ed *** in july 13th saying my store had suddenly closed & I no longer needed the equipment & pleaded for them to end the charges & return the equipmenthe said he I couldnt return the equipment but he would take off months from the remaining months I had lefti said please I dont want to pay $a month for another year I dont need your equipment, but he said thast the best he could dohe wanted proof I moved into an office & I sent over an agreement between my wework office showing my move in date for july 14th
few weeks went by & I got a call from an EXTREMELY MEAN & NASTY OBNOXIOUS WOMAN CALLED CRYSTAL saying shes from collections & my payment for july got rejected& I OWED more year for a contractshe was accu

February 20,Merimac capital had a sale person came into the businessAbout a credit card machineI told the sale person I will not be here that longSalesman stated I can write to the company let them know the business closed down May 31,That the company will end my contractI received a letter from Merimac Capital June So I call talk with supervisor about the letterI told her the business was closedThe superior stated if I return the equipment back to themI said ok .I ask the superior was there gonna be a late fee supervisor stated NoI was sending payment to the company Then superior demanding me to send it on a special dateI keep telling supervisor I don't have money on that dateOne of my payment the superior mess around throw the payment awayI try tell the superior I have my copyThe superior got mad and hang the phone up while I was explain to her about payment I send the to companySo superior call me I told the superior do u remember yo

This company charged me in FULL for a transaction they denied They contacted my customer to verify if I had done the work and denied transaction because we were in process I provided documentation to them and they still did NOT process transactionThis practice was NEVER disclosed in the contract, according to them it is up to their discretion (the LP department) I have contacted other VERY reputable merchant providers and both of them say this is NOT their standard of practice

THEY ARE LYING THIEVES WHO WILL SAY AND THEY WILL SOUND VERY PROFESSIONAL TO GET YOU TO SIGN ALL THE CONTRACTS WITHOUT INFORMING YOU ABOUT ALL THE FEES AND HIDDEN CHARGES, THEY WILL HIT YOU LEFT AND RIGHT WITH CHARGES THAT YOUR SALESPERSON INDEED WILL NOT DISCLOSE AT TIME OF SALESI LEARN SO MUCH FROM DEALING WITH THIS COMPANY THAT THEY HAVE THEIR WAY OF SCAMMING PEOPLE THROUGH OF SIGNING THAT CONTRACT! DO YOURSELF A FAVOR AND SAVE YOURSELF FROM HEADACHES AND WASTING YOUR MONEY, DO NOT DO ANY BUSINESS WITH THIS COMPANY!!!
