I am rejecting this response because:Nobody is disputing the fact that there is a buyout fee nor has that ever been an issue. The issue is that Fitness Evolution says one thing and then does another and that's a proven fact with my scenario and countless others as I've read countless other similar complaints. Furthermore, we were told verbally via phone conversation at approximately 11:15 on 6/14/17, by manager Wes, that there are no refunds for any unused portion. Yes, the $300.00 is a benefit from my employer.Wes changed his tone after this complaint was filed and presumably after Fitness Evolutiom received it. As stated above, he stated that no refund would be provided in June when attempting to resolve this matter without the support of the Revdex.com and at the time of the cancellation and buyout. Then, on 7/11/17, there was no question when we presented Wes and Fitness Evolution regarding the request of refund. It was only at the point of filing this complaint with the Revdex.com that the representative and manager of this business decided and even thought to cooperate in-regards to the request of a refund. It makes me wonder how many customers has this business kept money they weren't entitled to.Furthermore, when looking at your itemization of payments/fees, there is a $25.00 returned item fee that I see Fitness Evolution has deducted from available credit which further reduced the balance. This is inaccurate, as once again, Fitness Evolution attempted to inaccurately charge my credit card when there was still a positive balance on my account with Fitness Evolution. To fully resolve this, the amount refunded to my employer will need to be $103.03 as the additional $25.00 fee is a result of their negligence to ensure their systems are properly billing and deducting charges from the appropriate accounts for each and every customer's membership. I'm not quite sure why there is a handwritten not on the itemization for disputing it with the credit card company. That $25.00 charge isn't a charge that shows on my personal account. That is a fee that Fitness Evolution isn't entitled to as they continue to incorrectly bill, even after brining this issue to their attention on June 14, 2017. If this can't be resolved through the platform of the Better Business Burea complaint, the Maryland Attorney General's Office - Consumer Protection division will be the next step in ensuring Fitness Evolution is operating in an ethical manner and not allowing themselves to profit and benefit from their own negligence.

On 4/20/15 I filed a complaint with the Revdex.com against Fitness Evolution because they wouldn't cancel my account and they continued to charge me even ater I was told it was cancelled. The Complaint ID [redacted]. The business responded they would no longer be charging my account the $29.00 a month and I was fine with that and I said the complaint was resolved. In checking my account for this month instead of charging me $29.00 I got charged $15.00. I wanted my whole account closed that was the point of my complaint. I suspect they are still charging me possibly for my husband who was on my account. My whole account was supposed to be cancelled. I won't resolve this complaint this time until I get confirmation that EVERYTHING is cancelled and I get my $15.00 refund. You said I would no longer get charged and I was partially charged. This business is shady and will do anything to get over on you.

Per all membership and PT agreements, a 30 day notice to cancel is required, making a payment for anything owed within the next 30 days due, as well as any current or past due balances.
As a courtesy, we are willing to waive the last month's dues and take payment for current past due amount to cancel. However, we are unable to waive any fees as members both have agreements on file for group training.

I am rejecting this response because: Fitness evolution obtained a sale of membership by using deception. After my request to have the membership closed it is still open. As noted in my prior statement they refuse to close the account when I went to the gym to have it closed and now another bill is being accumulated. Through their own admission it is still open forcing me to stay in membership as I stated before. I want a refund based on deception and the account closed!!!

I do apologize for any confusion however the cancellation procedure is clearly outlined all of the termination request need to be sent via certified with [redacted] or with Fitness Evolution.  As we have not received the proper request the account has remained active. What I'm able to do is...

terminate the membership moving forward but I will not be able to issue a refund.

Member’s refund was processed 6/15 to account on file once we received refund authorization form. Company considers this resolved.

I am rejecting this response because: I would like proof that that initial payment was made by me. I have no debit/credit card ending in those digits. The attachment you have provided me states no way whats so ever that I was ever contacted by your company in regards to any past due balance. Yes, the number I have provided is the same as you have on file but I was never notified of this account or had any mail sent to me. Please provide me with documents of your company contacting me. I am giving you until the end of August to correct this mistake with collections or I will have no other choice but to take this to court.

HI,I apologize for any frustration regarding the duplicate account. We have cancelled the duplicate account
and will contact member to issue refund.

In order for us to make any changes to the accounts we need a written request from our members.  If a member is not able to go in to sign their termination request they are also able to send a certified letter.

We show that the member only has a balance of $408.88. The member was contacted multiple times after thebalance was on her account. In June, July, and October of 2014 regarding account. We do not show that this account was ever cancelled by the member. Although we show that all of the charges are...

We apologize for the oversight on that version of the contract. The situation has been corrected.

[redacted] contends that she "called to cancel" in the beginning of April due to unauthorized charges to her account.  On 4/15/16 a cancellation request (copy attached) was electronically submitted and the cancellation process began.  Both the Contract (copy attached) and the Cancel Request...

(copy attached) state the need for cancel in writing with a 30 day notice, including 1 additional month's payment and the need for the account to be current.  Subsequently on 4/20/15 [redacted] had her bank withdraw the payment received by us on 4/14 and at this point she would have been contacted by the call center in TX who handles our past due accounts.  The return is documented on the Account Transactions (pymt history-attached) listing.  The May payment that was due to fulfill the terms of the Membership Registration Agreement and Cancellation Request is also outstanding resulting in additional calls from the call center.  The monthly billing has stopped on the account however the account will not be "closed" as noted in Desired Outcome until the terms of the signed agreement are met.Respectfully, Sheila K[redacted]Billing ManagerFitness Evolution Home Office

I am rejecting this response because:I was not given what I was promised when I singed the contract with the club. I have tried to contact the company many times and no response. the trainer I signed up with can no longer train me as well as the new trainers times do not work with my schedule. attached is the letter from my doctor stating to cancel, I am being treated for a problem which this dilute is making worse. the company has no care for its customers.
