We regret that the customer thought she was getting an AWD vehicle. The fact of the matter is that we feel we didn't miss represent the vehicle  [redacted] purchased at any time. In fact, she was afforded the opportunity to take the vehicle home with her for an extended test drive which she...

did. She had the vehicle in her possession from 3/17/15 until 3/19/15 when the transaction was finalized. We offered and still are oferring to trade her out of the vehicle for an AWD similar [redacted] and her to pay for the difference in price since an AWD [redacted] will be of a higher price.

Here is a copy of my signature from my drivers license. How dare you people forge my signature. I should file a complaint with the authorities.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Revdex.com spoke to customer and the following was relayed: We signed the GAP Insurance documentation with the intention of having the GAP coverage. The employee kept putting documents in front of us to sign without explaining or we would not have signed the other document. We believe this is the business's error and responsibility.
Regards,
[redacted] & [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.
She finally called me back yesterday after 10 days of leaving her messages. I am to pick up my merchandise on Sunday. This business is terrible. I will not EVER do business with them again nor will I recommend them to ANYONE. I hope they get a poor score so others don't have to deal with this situation in the future. Revdex.com did ask for a follow up from the consumer: After 3 months, I have it. Regards,
[redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below: The statement made is one that I do not agree with. When I initially went in to look at cars just look to see what they had. They pushed on me and kept asking if I was excited about my new car. I was there from roughly 10 in the morning until almost seven at night without my knowledge they ran my credit with multiple lenders that I did not approve or want them to do. Also as for the warrantee I asked not to have that when they finally came back with paperwork saying that I was approved and getting my car. They then left came back and had taken off I believe a $1000 from the initial price of the car and put on the warantee. I would like for the matter to be resolved with what I said before but minus them giving me a car. I would like them to still pay off the remaining balence due plus $20,000 in damages for issues that I have gone through trying to refinance, the fact my radio quit working after six months and they would not fix it, the attitude I have gotten from the staff since I have purchased my car which has been unpleasant and so on. If this is not met I will be pursuing a lawyer and going to court.
Regards,

The Dealer is Fucillo Kia of Clay. The address is 3[redacted]. Thank you

Mr. [redacted] signed a contract which clearly indicated the first payment was due to [redacted] on June 20, 2017. It is his responsibility to insure that commitment is made. Possibly, Fcillo imports may could have better helped [redacted] make arrangements with [redacted] to complete his first...

payment. With this in mind, we would be willing to split one of [redacted]'s car payments. The payment is $456.00 and we would participate with the sum of $253.00. Regards, Kevin M., GM Fcillo Imports

In regards to Complaint ID:[redacted]. Fcillo Kia of Clay has agreed to refund Mr. [redacted] the full amount requested. This was attributed to a simple accounting error and was easily resolved, Thank you for your time in this matter. Respectfully, Nicholas C. General Manager Fcillo Kia of Clay

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. Ok general manager obviously don't know what was happening there that day. WE WERE NEVER OFFERED DEPOSIT and as a first time buyer I don't know about it if I knew I would give deposit but that not my job. Second I'm subbmiting screenshot of picture where it says it's fine to come Aug 16th so it's true we supposed to come on 14th. Heidi NEVER called me and she wasn't professional she was rolling her eyes while we were talking. Busness manager said we are all set but then we recently received later month after all this happens saying we aren't approved but you day we are all set and to come see the car. I have all email because I barely talked with Emily she called me maybe 3 times trough while this procces. She wasn't answering emails on time plus I'm gonna mention again she never showed go to greet us or apologize but she knew we are coming and 2 hours before when I called to ask directions because it took her 2 days to answer on my email she said we are waiting for you. Whole experience was horrible and I can't believe companies like that exist. My husband wasn't happy with general manager but he said to give him 7 days to find a car. 7 days passed by he never contact us to say that he did or he didn't find the car for us and my husband called again and manager said to send all emails to him and he never respond eather.

FCILLO FORD FOLLOWS THE SAME PROCESS ON EVERY DEAL.  [redacted] DID GIVE US PERMISSION TO PULL HER CREDIT AND SHOP FOR THE BEST RATE.  LOOKING AT HER DEAL, SHE OPTED FOR AN 84 MONTH TERM, WHICH MAY BE WHY SHE CHOSE TO GO WITH THE LENDER SHE ENDED UP WITH.  I ATTACHED THE INITIAL...

WORKSHEET WHICH [redacted] SIGNED, OUR PRIVACY NOTICE, THE DEAL MENU, AND THE RISK BASED PRICING NOTICE.... WE ALSO HAVE THE ORIGINAL CREDIT APPLICATION AND CONTRACT... WITH DISCLOSED INTEREST RATES, TERMS ETC...ALL ALSO SIGNED.  I HOPE THIS ANSWERS ANY QUESTIONS AND ALSO HOPE TO CONTINUE TO DO BUSINESS WITH [redacted] IN THE FUTURE.  SINCERELY, JOHN T.

I have spoken to customer in regaurds to her complaint,we have agreed to refund her the cost of the starter that she had installed as well as waive the 100.00 deductible on her service work which nis scheleduled for a latter date. we also will be providing a loaner for her at no charge. When Mr. [redacted] took delivery of his new [redacted] everything seemed to be fine with the vehicle. As I recall Mr. [redacted] also went over the vehicle with a fine tooth comb. When he told us there was a scratch on the rim a day or two later it seemed odd to us since our staff and Mr. [redacted] thoroughly...

inspected the vehicle. After making an attempt to repair the rim we did agree to replace the rim with a new one in the interest of good customer service. We also buffed a few minor scratches and at no time did we burn through the clearcoat finish. At some point after that Mr [redacted] complained there was still scratches. We agreed to buff it again. Although we could not see anything wrong with the vehicle we detailed it again. When Mr. [redacted] took possession of the vehicle this last time, there was nothing wrong with it. Although we are grateful that Mr. & Mrs. [redacted] chose to purchase a vehicle from us, there is nothing more we can do satisfy them. Again, there was nothing wrong with the vehicle.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.

Thank
you for allowing me to respond to Mr. [redacted]'s Attorney General Complaint. After
review of the documentation of the transaction dated on 10/16/15 for the purchase of a 2016 [redacted] I have found the following information to be true and correct.Mr. [redacted] traded in two vehicles toward his...

purchase that day, a 2010 [redacted], vin #[redacted] and a 1997 [redacted] vin# [redacted]. I have enclosed a copy of several documents which are the basis for our
decision with regards to this matter. Mr. [redacted] has purchased several vehicles from us and we greatly appreciate his past and future business. In one of his prior transactions Mr. [redacted] had traded in a vehicle to us with no issues. The transaction on 10/16/15 was conducted in the same manner. However, on this transaction Mr. [redacted] was not at this time in an equity position on the vehicles he
was trading in. Mr [redacted] as indicated on the vehicle invoice sheet, as
well as the vehicle purchase agreement, received the total sum of $7,200 for
the trade in value of the [redacted] and [redacted]. (see attached)
This total credit for both vehicles was applied against his purchase price on
the 2016 [redacted]. Mr. [redacted] had
an outstanding lien against the 1997 [redacted] in
the amount of $8,922.82 which needed to be satisfied in order for Fcillo Kia
to receive a lien release on the vehicle. As part of this transaction the lien amount was added back into Mr. [redacted]'s loan after the trade credit was applied. Fcillo Kia sent a check in the amount of $8,922.82 to [redacted] Credit Union to
satisfy this loan from the proceeds of Mr. [redacted]'s new loan on the 2016 [redacted] he purchased. (See attached). At this
time I feel that the fact that Mr.
[redacted] had a negative balance on his trade vehicles of $1,722.82 has created the confusion. However, our
documentation which was signed and initialed by Mr. [redacted] in several places
show clearly that this was the way the transaction occurred and we are hoping
that perhaps you can help him understand the difference. Please
feel free to contact me at ###-###-#### if you have any further questions with
regards to this matter. Sincerely, Pat B.  Fcillo Kia

In response to the complaint from  our customer [redacted], fcillo kia will take care of the required maint set fourth by [redacted] motors for the duration of the customers lease, fcill kia will set up a account for the customer to be used at [redacted], Schenectady ny, fcillo kia...

apologizes for any inconvience this may have caused our customer. thank you. Edward D. General Manager

Revdex.com spoke to Jeff at business and the following was relayed: I have spoken to the accounting office, we still have their deposit. It is being sent certified by check today.

Fcillo Ford of Seneca Falls received a electronic credit application from [redacted] on March 10th, 2015.  He was submitted to some of our lenders as a co-signer for his brother [redacted].  There was no credit extended to either party in that transaction so that was the end...

of it for us.  I am guessing that he may have received an adverse action notice later stating such, and that could have been June or July.  Once the deal was dead on our end we did not send Mr. [redacted]'s application to any lenders at any later date.  We do have both hard copy and electronic copy of Mr. [redacted]'s credit application on file. John T. GM Fcillo Ford of Seneca Falls
