On Dec 14, GM Financial chose to do a repossession of my car on the actual due date of the car noteAfter speaking with GM Financial and it many rude and unprofessional customer service agents nd filing a previous Revdex.com complaint which was never resolved about that issueI was told via the reply for Complaint [redacted] 12/22/from GM Financial that a "notice of our plan to sell property and notice of right to redeem or reinstate" was mailed out to my address Justice, Il Dec18, So I called in on 12/spoke with [redacted] @ 11:11am when he called me and advised I had not yet received the notice and was requesting that GM Financial resend me a new one because it should not have taken that long to receive it in the first place so that I can get the information of where to get my belongings that were in the car when it was taken and how to get the car backIt was at that point [redacted] stated he GM Financial could not send me out at new notice and that I had to either check with the usps delivery guy or wait until it comesI advised him by law that notice had to be received by me from GM Financial within days after the repossession and we were already at days and that the company was going offline and unreachable from 12/through 1/so that notice needed to be resent BEFORE thatAnd as of 1/8/the company is NOT back online via online or customer service phone line [redacted] It is days pass their supposed upgrade relaunch date and I have NOT received any "notice of our plan to sell property and notice of right to redeem or reinstate" was mailed out to my address Justice, Il Dec18, nor the second requested one I asked for on 12/and it is now days past what the law in Illinois allows making this a Insufficient notice of redemptionCar repossession laws in Illinois require your lender to provide you with a redemption notice within days after your car is repossessed and GM Financial the lender failed to provide the notices and provided legally insufficient notice making repossession invalidIf they KNEW that the WHOLE COMPANY was going to be offline AFTER 1/5/they should have made sufficient arrangements to have someone available to address this issueI could careless about their system upgrades when they poorly managed, equipped and inadequately trained to handle their customersThey were suppose to be back up and running today 1/8/and I still can not get through any of the phone systems and they have completely shut down any online access to my account and now I am pass the legal notification dates that my state of Illinois allows for this company to contact me via a redemption notice and even though they were made fully aware of the fact that I had not received the notice and that they would not even have anyone capable of helping me resolved the reinstatement of my vehicle between the dates of 12/27/and 1/8/they made absolutely no attempts to assist meAnd GM Financial provided an Insufficient notice of redemption.This is an Insufficient notice of redemption ?" Car repossession laws in Illinois require your lender to provide you with a redemption notice within days after your car is repossessedGM Financial failed to provide the notices or provide legally insufficient notice, the repossession is invalid and someone needs to call me asap ? You promised to pay the amount financed of $28,and a finance charge of $11,which resulted in a total of payments of $40,698.00, if all payments are made on the contracted date they are dueIt is important to understand that this Contract is a “simple interest” contract, meaning that interest is accrued daily on the unpaid portion of the amount financed, as indicated on the face of your contract, as well as on page two under “Finance Charge and Payments”By signing the contract, you agreed to abide by these terms, including paying the principal amount plus finance charges accruing on the unpaid balance at the rate of 11.90% in installments of $due monthly beginning on March 29, 2015.? I understand I am to pay my monthly payment - I have never missed a payment or had NSF fees but when I attempted to change my financial information on your website it charged my old financial institution and my current.? I want the $in fees back.? The point of autopay is to set it and forget it - so for months I have been paying and now my bill is down to and on statements there was errors on my excise tax.? Complaint: [redacted] I am rejecting this response because:As you can see from a letter I just received, GM FINANCIAL is reporting a credit tradeline over days later for a lease that terminated on September 29, Additionally, as stated in my original complaint to the Revdex.com, State Attorney's Office, the CFPB and the FTC, GM Financial for some odd reason not only waited FULL MONTHS to bill me for the lease that was completed successfully and terminated on 9/29/but also NEVER NOTIFIED ME in any capacity whatsoeverGM Financial NEVER sent me a bill by US MAIL or EMAIL on record nor did they EVER CONTACT ME on my PHONE NUMBER OF RECORD, TEXT MESSAGE to the PHONE NUMBER OF RECORD, NEVER SENT ME EXPRESS MAIL, NEVER LEFT A VOICEMAIL and CERTAINLY NEVER SENT A PERSON LIVE EITHER TO MY HOME OR TO MY OFFICES OF RECORD AT ANY POINT WHATSOEVER.I VERY RECORDED DETAILED MESSAGE WAS LEFT WITH EUNICE PONCE stating the fact and stating that GM FINANCIAL has until 5pm this Friday August 4th to comply or I will be forced to file both a State and Federal Lawsuit for violating the Fair Credit Reporting Act and causing willful financial harmTo summarize, GM FINANCIAL leased a vehicle and was turned in on September 29, and for some apparent reason, they chose not only to NEVER send out a final bill to be reviewed and paid, but they waited months to start the due date and without any notification whatsoeverLastly, after receiving alerts on my credit report of a delinquent account, I caled GM Financial and they ask for all my information and said absolutely everything was 100% current on my current account and never again MENTIONED anything owed on this past account that was satisfactory and turned in (terminated) on 9/29/ Regards, [redacted]
