To Whom It May Concern:Mr [redacted] came to our dealership several times from February? through April in order to help to him trade out his? [redacted] he bought a year ago.? At that time we told we were? unable to get him financed due to extreme inequity on his trade and the lack of? his credit history.? On? May 4th, 2017,? Mr***? once again attempted to trade his vehicle using our online tool.? On the same day Mr [redacted] spoke with our internet consultant and his previous Sales Consultant [redacted] ***, they both advised Mr [redacted] that with current incentives we possibly could help trade out his current vehicle for new vehicleMr [redacted] agreed and would like to move forward with process and scheduled the an appointment on the 8th at 10am? to finish up the paperwork as he stated on the complaint letterThen again on May 5th our internet sales consultant called Mr [redacted] to confirm the appointment? and explains to him to processOn May 6th, we start our process by submitting the application to our lender to get the loan approvedDue to? the extreme negative equity and the lack of credit we called Mr***? to inform him that we needed more time to work on the approval process.? We? did not? want Mr [redacted] to come in and wait several hours at the dealershipMr***? was upset, because we told him not come in and why did we start the process without his authorization, then he called and spoke with? our? sales manager [redacted] ***, he stated to? [redacted] that? he's okay to start the process on Friday? May 5th but did not authorized us? to do so on Saturday May 6th and asked us to remove the credit? inquiries and his personal? info from our? database [redacted] advised? him that we are unable to deleted all his info from database due to? previous purchased record, but will? do best to send out the letter to [redacted] and [redacted] to? remove the? credit inquiry, but not guarantee the resolution.? On my? 8th, [redacted] was on vacation and relayed the message to our office manager to? generate the letter to send to the credit bureau and [redacted] ***, which we did.? We also sent a copy to Mr***We have done everything that was requested and resolved this matter.Sincerely, [redacted] General Manager? ?

Please note I am declining Quirk Subaru's response for the following reasons:1) Represented themselves as [redacted] participants and in fact they are not? They never corrected my assumption? I had called about whether they were [redacted] participants and was given [redacted] as the [redacted] agent.2) There were crosstreks (white) that I was to test drive less than hours before arriving? When I arrived they were sold and I could not see them.3) [redacted] (e-mail available) said that within the hour he would send me a letter of apology for the GM behavior? It never took place? I asked him for the Quirk corporate address he reported he would also send that and he never did.4) I made an appointment with [redacted] to test drive the vehicle? I was told to come back later , odd in itself, which I did and they still would not make a vehicle available for test driving instead telling me to come on the weekendThis is when? [redacted] dismissed me as a customer (which I have been of Subaru for over years).Hence, this leads me to see my interaction with this business as mis-representation ( [redacted] ) and bait and switch (vehicles are on the lot and then they are gone the next morning) not to mention the volatile and dismissive behavior of [redacted] the GM who denied that there was anyone above him to appeal Regards, [redacted] ? ?

I am not sure what else we can add to our initial response.? We do our best to try to obtain financing for our customers.? Unfortunately, when the bank does not approve the customer, the inquiry goes against their credit rating.? We did have Mr***'s permission to try to obtain financing.? It is unfortunate that we could not get him financed.?

Here at Quirk Chrysler Jeep Dodge? Ram? of Dorchester have never stated that an oil change service could not be? performed at our facility.? In fact, what has been communicated to the customer is that an appointment must always be made in order to guarantee parts for Mrs [redacted] 's vehicle is available and/or in stock.? Any other issues that Mrs [redacted] experiences, relating? to brand specific items; malfunctioning lights, electrical issues and/or? powertrain related concerns are items we are unable to address due to lack of resources on the vehicles brandWe would? be available to assist in? any way we can based on our capabilities.? We have talked to the customer and KIAThis particular incidence this customer had over mileage which he did not mention, that is what the bill was issued forThe bill was not for previous payments of the previous leaseQuirk KIA honored all parts of our agreement with this deal, which was paying the remaining payments of his old lease, we had no reselection of the over mileage which customer states he did not let us know?

I am aware of Mr [redacted] 's situation and have spoken to him multiple timesI have advised him to try and work with KMA and consumer affairs and I have also acted as an advocate on his behalf in communication with KIA? The last time Mr [redacted] 's [redacted] was in for service with us was back in April of where we addressed a check engine light concernThe vehicle needed an oxygen sensor replacedHe also requested we remove the running boards from the [redacted] as the mounting brackets where rusted and broken, which we did at no charge as complimentary service for Mr [redacted] ? Mr [redacted] has an open consumer affairs case with KIA and has been granted GOODWILL repair at no cost to himI have reached out to my DPSM and also to consumer affairs to help in any way that I could? I have looked through all of Mr [redacted] 's scanned repair orders and have found nowhere in any of his history/repair orders or paperwork any mention of rear axle damage/concern and or notations? When I spoke to my DPSM he informed me that the vehicle is out of its "perforation/corrosion" warranty and they are not granting any? coverage of? the? "rear axle issues" due to the vehicle being out of warrantySince we have never done any "rear axle" work on the vehicle and have absolutely no documentation of any rear axle issues, there is no way for us to warranty and/or cover any repairs the 10+ year old [redacted] is in need of? We also have a High Mileage Release signed by customer

Mr [redacted] freely and voluntarily signed a lease contract on 12/23/2016, not 12/30/2016.? Mr [redacted] was never informed it would take less than a week for the vehicle to get here.? He was told that it would take about two weeks or so, but we do not know the exact date because we do not control **’s transportation processWhen Mr [redacted] ’s vehicle arrived on 1/3/2017, he was contacted from Quirk Chevrolet that it arrivedQuirk Chevrolet also paid Mr [redacted] ’s first payment for him to keep him happy with us

I escalated this to management and no one from management bother to deal with it.? I was pushed to a person in the body shop who had no authority to do anything.? Matter of fact I was told it was my problem and that I had to deal with it.? No offer was made other than what would be made to anyone coming off the street.? They put my son back into an unsafe car (on a side note and why this is so emotional for me is my other son died during this time in an accident at college) and have basically walked away from the issue they created.? They did not even bother to pay for the tires I had to buy before discovering the problem they left me with.? ? Regards, [redacted] ? ?
