[I never mentioned I signed the lease contract on December 30, 2016, I mentioned that I notified the General Manager, *** *** and? ? the Sales representative, *** ***? by email on December 30, 2016? not to proceed with the registration and to call ? me back so I can talk over the phoneWhen *** called me on January 3, 2017, ? I told him to cancel my lease contract and he was okay with itHe called me few days later to check with me if he can sell the car as somebody was looking for it and I said sureI was not informed at that time that I cannot cancel my lease contractI did not receive any correspondence from Quirk Chevrolet since then until I heard from ** *** about my payments that are due .]?

We have reviewed the transaction with management, everything checked out, customer can feel free to pay us a visit to go over the numbers again and explain anything he needs

That is not accurate.? However, Quirk Chevrolet refunded his money a few weeks ago

On December 18, *** *** purchased a Ford Focus from D.JQuirk Ford Inc.? Ms*** agreed to the terms of the purchase? and reviewed and signed all necessary documents to complete the transaction that day.? Everything that Ms*** signed is in compliance with
the? governing laws of Massachusetts in regards to the paperwork needed to finalize the purchase.? After the purchase Ms*** contacting the dealership, making similar request to the complaint she filed, that D.JQuirk Ford Incpay off her loan with *** and allow her to keep the Focus that she purchase.? Unfortunately we declined this request as we feel there is no wrong doing in this matter.?

Dealer is not responsible for customer’s lost key.Because the key was mail and certainly at customer’s possession

As stated in the previous email, I have numerous text messages and photo's with the "gunmetal" color car, and my fiancee and I did not once mention a blue car to Mr***.? When Mr*** tried to give my fiancee the blue car on Saturday 5/5, he openly acknowledged his mistake on the color, and he said "There's nothing I can do now man, it will take me a week to change everything over.? Let me give you a year of free oil changes to make up for it.? Call my cell phone when you are coming in and I will take care of it".? I find it hard to believe that Nissan would offer a year of free oil changes to all their customers, as it seems like they would lose a lot of money doing that.? We understand mistakes can be made, and we just want the mistake to be acknowledged and corrected.? I have attached yet another text message from Friday 5/stating we purchased a "gunmetal" Nissan ***.? I would also like to point out that while driving Sunday 5/in the rain, my fiancee was unable to see out of the rear window, which poses a huge safety hazard while driving.? We understand we can bring the vehicle back to the dealership to have the blade replaced, however we have not been offered anything for our troubles throughout this time.? Additionally, I posted a review on Quirk Nissan's website on 5/8/18, and the review was deleted this morning and is no longer on the *** page.? If this was an honest mistake on our part we would certainly not be going through the trouble of this complaint, *** reviews and other legal actions

We would like to apologize for any confusion on this dealThe payments discussed with *** over the phone could have only been estimates? without having a exact payoff and seeing the condition of the trade in at this timeAfter arriving at the dealership we gathered the information we needed
in about min (pay off, trade appraisal) also the only white Sedona we have in stock is a white SX which has a m.s.r.p of about $higher then the original EXAt that time we gave the customer our very best deal on the higher costing van of 375x12k per yr? once we knew for sure that we could not get to the deal the customer was looking for we apologized for her time and travel and if she could get that deal at anther *** dealer then she should do soAlso customer did not provide any documentation showing the 319x12k per yr? deal she said she could get, we will? better a? deal that is in writingAs for the gift card it clearly states on the web site you need to print out the voucher and have it signed by a *** dealer then mailed in to redeemAlso did not provide in storeOnce again we apologize for any confusion and hope we will be able to help in any further needs

I am aware of Mr***'s situation and have spoken to him multiple timesI have advised him to try and work with KMA and consumer affairs and I have also acted as an advocate on his behalf in communication with KIA? The last time Mr***'s *** was in for service with us was
back in April of where we addressed a check engine light concernThe vehicle needed an oxygen sensor replacedHe also requested we remove the running boards from the *** as the mounting brackets where rusted and broken, which we did at no charge as complimentary service for Mr***? Mr*** has an open consumer affairs case with KIA and has been granted GOODWILL repair at no cost to himI have reached out to my DPSM and also to consumer affairs to help in any way that I could? I have looked through all of Mr***'s scanned repair orders and have found nowhere in any of his history/repair orders or paperwork any mention of rear axle damage/concern and or notations? When I spoke to my DPSM he informed me that the vehicle is out of its "perforation/corrosion" warranty and they are not granting any? coverage of? the? "rear axle issues" due to the vehicle being out of warrantySince we have never done any "rear axle" work on the vehicle and have absolutely no documentation of any rear axle issues, there is no way for us to warranty and/or cover any repairs the 10+ year old *** is in need of? We also have a High Mileage Release signed by customer

after bring the issues where brought to the manager all where resolved The other issue that was found was brought to the customers insurance company and has been repaired at no charge to the customer a offer to trade the customer out of this vehicle was made and the customer did not visit the

This issue is resolved

I would like to personally apologize for the series of unfortunate incidences that you experienced during your visit at Quirk Chevrolet.? We continually try to do our very best for all of our customers, but unfortunately, sometimes we do fail.? There is no excuse for us to have you wait
here for that long and to take this long to respond to you.? I did another check request today for the inspection sticker refund and I will make sure it gets sent out today

I am rejecting the response I received from Quick Nissan.? The claim that my fiancee and I were discussing a blue vehicle on Friday 5/is completely false.? Mr*** asked us the top colors we wanted in a vehicle, and we said we wanted black intitially.? Mr*** suggested we do not get black because it scratches easily and shows dirt, and that we should go with the gunmetal gray, as that is the color of his vehicle.? He provided us with a gunmetal gray vehicle to test-drive, which we did, and then parked it in front of the dealership (I am sure this can be seen on the security camera footage).? I have attached a text message I sent on Saturday 5/at 5:30am with a picture of the gunmental gray vehicle we test drove and leased, with the words "gunmetal" under it when asked what color we chose.? I also want to point out that my fiancee had to pick the vehicle up without me on 5/because I was out of town tending to some family issues, and my fiancee did not want to upset me further by telling me what happened with the vehicle until I came home Sunday evening, which is why the dealer was contacted on Monday 5/7.?
