If the user elects to continue with their selected report type but does not wish to continue the Premier Plus membership they are instructed to cancel the Premier Plus membership within the first 7 days and they will only be charged $7.95 for the Premier Plus trial membership. However, if the user does not cancel, the member is enrolled in the Premier Plus membership and their credit card will be charged a monthly fee of $29.95 (plus applicable taxes) going forward.   Intelius provides clear disclosures within the report purchase process of the Premier Plus membership offer.  Below, I have outlined the process and various places in which Intelius notified Mr. [redacted] of the membership offer and details.   On June 22, 2016, Mr. [redacted] purchased a discounted membership in the amount of $.95, which included a 7-day trial membership of the Premier Plus membership. Mr. [redacted] was notified of this offer and trial membership when he selected his report type and again on the payment information page. Additionally, he was required to manually select a checkbox on the payment information page before he could complete her report purchase that specifically notified him of the offer and the membership terms, including that his credit or debit card would be charged $29.95 (plus applicable taxes) if he did not cancel his 7 day trial membership, a phone number to cancel his membership, that his membership benefits would continue through the last month for which he paid and that there are no refunds or partial month credits. Mr. [redacted] was presented with language in the same checkbox that by clicking the button to purchase, he agreed to the Terms of Service and Privacy Policy (with hyperlinks to each). A copy of the purchase page is attached for your review.   The “Automatic Renewal Program” section located under the “Paid Services” portion of the Terms of Service states: “Upon your acceptance of an offer for the purchase of any subscription-based Paid Services, you will be enrolled in our automatic renewal program to help ensure that there is no interruption in your access to such Paid Services. Under this program, you authorize us to automatically renew your subscription at the end of the term of the subscription you purchased, and each subsequent term, for the same term length of the subscription you initially purchased (unless otherwise stated in the offer you accepted). Unless you change your renewal status as described below, at the time of each such renewal you authorize us to charge your designated Payment Method at the then-current, non-promotional price (unless otherwise stated in the offer you accepted) for the renewal of your subscription. If you no longer want to be enrolled in our automatic renewal program, you can change your renewal status at any time by completing the following steps:   Intelius.com – cancelling your membership on the My Account portion of the Intelius.com Website or by calling (888) 445-2727.   Please note that completing these steps will only stop future automatic renewals of your subscription and will not impact any automatic renewals that occurred prior to the date that you completed these steps.”   Shortly after his report purchase, Mr. [redacted] would have received a receipt confirmation email sent to the email address associated with his Intelius account. This email contained the amount Mr. [redacted] paid for his report and the Intelius Premier Plus membership terms and conditions and instructions on how to cancel his trial membership.   According to our records, Mr. [redacted] did not opt out of the Intelius Premier Plus membership or contact the Intelius Customer Care team about his membership prior to the expiration of his trial membership. As a result, his credit card was charged $29.95 on June 30, 2016 in accordance with the disclosures and the Terms of Service that he agreed to during his initial purchase.   Per the Terms of Service, Intelius has a no refund policy. However, as a matter of customer courtesy, an Intelius Customer Care representative provided Mr. [redacted] with a refund of his last three month membership fees in the amount of $89.85 (3 x $29.95) on March 22, 2017. As an additional courtesy, I have provided an additional one month refund of $29.95. Mr. [redacted] should note these refunds on his account within the next 30 days depending on his financial institution’s billing cycle and internal refund policy. We are unable to provide Mr. [redacted] with any additional refunds.   This information should successfully resolve Mr. [redacted]'s complaint. The data is compiled into a comprehensive database record that Intelius maintains with active updates from its sources. However, it is important to note that not all states or every county within each state provides digital access to its records and therefore some records may be incomplete.   According to our records, Mr. [redacted] purchased a Background Report on March 17, 2017 in the amount of $49.95. At the time Mr. [redacted] purchased his report, he also ordered an additional Nationwide Criminal Report in the amount of $19.95. A link providing information regarding the limitations of criminal reports is provided within both the Background Report and the Nationwide add-on ordering sections. A copy of the notice is attached for your review.   Per the Terms of Service that Mr. [redacted] agreed to upon ordering his search, Intelius has a no refund policy. However, as a matter of customer courtesy, I have provided a refund to Mr. [redacted] for the Nationwide Criminal Search Report in the amount of $19.95. We would be happy to remove Ms. [redacted]’s information from our database; however, we are unable to locate it.  It would be helpful if Ms. [redacted] would reply with some additional information such as her date of birth and previous cities and states which she has resided.  Once we have located Ms. [redacted]’s information, we will be able to remove it.Intelius does not ask for a URL to submit a request to opt out.  Generally, we request that proof of identity be submitted along with the removal request.  Proof of identity can be a state issued ID card or driver's license.  When uploading, faxing, or mailing a copy of a driver's license, we require that the photo and the ID number be crossed out.  However, we do need to see the name, address, and date of birth to ensure that all information is removed from our database.  If an individual does not feel comfortable faxing us their driver’s license or other state issued identification, they can send a notarized statement of their identity.We appreciate your cooperation in resolving this issue apologize for any inconvenience.

While we are unable to anticipate how, when, or even if information will reappear on our sites, we will be more than happy to remove an individual’s information upon request.    Ms. [redacted] may still initially notice her name appearing within Google search results. If this occurs, it means that while Ms. [redacted]’s information was still in our systems, Google indexed the public results pages of the Intelius website. In order for this listing to be removed, Google will need to re-index these webpages and update the information they have cached. As a result, his credit or debit card was charged $29.95 on July 1, 2017, in accordance with the disclosures and the Terms of Service that he agreed to during his initial purchase.   Per the Terms of Service, Intelius has a no refund policy and we are unable to offer a refund since Mr. [redacted] utilized his Premier Plus membership to order a Background Report.  However, I have canceled his Premier Plus membership and removed him from the Intelius website, per his request.   This information should successfully resolve Mr. [redacted]'s complaint. Ms. [redacted] may still initially notice her name appearing within search engine results. If this occurs, it means that while Ms. [redacted]’s information was still in our systems, search engines indexed the public results pages of the Intelius website. In order for this listing to be removed, individual search engines will need to re-index these webpages and update the information they have cached. When and how often these pages are re-indexed is beyond our control and is based on each search engines’ internal policies and algorithms. However, Ms. [redacted] should note, that none of her information appears in any Intelius search results.   I have attached a screen shot of an Intelius web page that shows that we do not have a “Deirdre [redacted]” in our database in the United States.   This information should successfully resolve Ms. [redacted]’s complaint. Commercial records consist of information that is maintained by enterprises and is available for purchase, such as marketing and telemarketing lists, phone connect and disconnect information, and business profile data. selects the promotional price, they are presented the benefits of the membership and the terms and conditions of the offer, including billing.  By choosing to proceed with the purchase at the promotional price, the customer agrees to the terms and conditions of the promotional offer.In this case, the promotional offer was accepted and the Intelius Premier Plus 7-Day Pass was activated.  As requested, the Intelius Premier Plus Membership was canceled on 12/23/2015 along with the pending charge of $32.53.  This will reflect on Ms. [redacted] statement in one of the next two billing cycles, depending on the closing date.  No future membership charges will occur.We appreciate your cooperation in resolving this matter and apologize for any inconvenience.
