They are still putting my first, middle, last name, age, siblings, and residences and personal info on google and on there data base. I want this personal identity removed its been longer than 72 hours. they also have places that I have worked. THis is still happening and it is July 10, 2016. They have failed to remove the advertisements with my name and personal information. They have provided no proof that they gave google to take this advertisement of theirs down form Intellius off of their website. The advertisements are still up and it has been longer than 72 hours

two-tier pricing structure when purchasing reports on the Intelius website. Each offer includes the standard one-time purchase price and a second discounted report price plus a one-week trial of the Intelius Premier Plus membership. If the user elects to continue with their selected report type but does not wish to continue the Premier Plus membership they are instructed to cancel the Premier Plus membership within the first 7 days and they will only be charged $7.95 for the Premier Plus trial membership. However, if the user does not cancel, the member is enrolled in the Premier Plus membership and their credit card will be charged a monthly fee of $29.95 (plus applicable taxes) going forward.   Intelius provides clear disclosures within the report purchase process of the Premier Plus membership offer.  Below, I have outlined the process and various places in which Intelius notified Ms. [redacted] of the membership offer and details.   On June 21, 2017, Ms. [redacted] purchased a discounted People Search Plus Report in the amount of $6.95, which included a 7-day trial membership of the Premier Plus membership. Ms. [redacted] was notified of this offer and trial membership when she selected her report type and again on the payment information page. Additionally, she was required to manually select a checkbox on the payment information page before she could complete her report purchase that specifically notified her of the offer and the membership terms, including that her credit or debit card would be charged $29.95 (plus applicable taxes) if she did not cancel her 7 day trial membership, a phone number to cancel her membership, that her membership benefits would continue through the last month for which she paid and that there are no refunds or partial month credits. Ms. [redacted] was presented with language in the same checkbox that by clicking the button to purchase, she agreed to the Terms of Service and Privacy Policy (with hyperlinks to each). A copy of the purchase page is attached for your review.   The “Automatic Renewal Program” section located under the “Paid Services” portion of the Terms of Service states:   “Upon your acceptance of an offer for the purchase of any subscription-based Paid Services, you will be enrolled in our automatic renewal program to help ensure that there is no interruption in your access to such Paid Services. Under this program, you authorize us to automatically renew your subscription at the end of the term of the subscription you purchased, and each subsequent term, for the same term length of the subscription you initially purchased (unless otherwise stated in the offer you accepted). Unless you change your renewal status as described below, at the time of each such renewal you authorize us to charge your designated Payment Method at the then-current, non-promotional price (unless otherwise stated in the offer you accepted) for the renewal of your subscription. If you no longer want to be enrolled in our automatic renewal program, you can change your renewal status at any time by completing the following steps:   ·         Intelius.com – cancelling your membership on the My Account portion of the Intelius.com Website or by calling (888) 445-2727.   Please note that completing these steps will only stop future automatic renewals of your subscription and will not impact any automatic renewals that occurred prior to the date that you completed these steps.”   Shortly after her report purchase, Ms. [redacted] would have received a receipt confirmation email sent to the email address associated with her Intelius account. This email contained the amount Ms. [redacted] paid for her report and the Intelius Premier Plus membership terms and conditions and instructions on how to cancel her trial membership.   According to our records, Ms. [redacted] did not opt out of the Intelius Premier Plus membership or contact the Intelius Customer Care team about her membership prior to the expiration of her trial membership. As a result, Intelius attempted to charger her credit or debit card $29.95 on June 28, 2017 in accordance with the disclosures and the Terms of Service that she agreed to during her initial purchase. Once Intelius verified the charge was a legitimate charge with Ms. [redacted]’s financial institution, the membership fee was charged to Ms. [redacted]’s Visa on July 14, 2017.   Ms. [redacted] contacted Intelius on July 17, 2017 and provided Ms. [redacted] with a courtesy refund in the amount of $29.95 and removed her from the Intelius Premier Plus membership program. Ms. [redacted] should note this refund on her account within the next 30 to 60 days, depending on her financial institution’s billing cycle and internal refund policies.   This information should successfully resolve Ms. [redacted]'s complaint. According to our records, Ms. [redacted] purchased her initial search report on December 18, 2016. Ms. [redacted] then cancelled her Premier Plus membership on December 21, 2016. Since Ms. [redacted] cancelled her Premier Plus membership within the first 7 days, her account was charged the $7.95 trial membership fee rather than the full priced Premier Plus fee of $19.95. Since Ms. [redacted] cancelled the Permier Plus membership, no further membership charges will be billed to her account.

disclosures within the paid membership process that fee-based memberships will automatically renew. Below, I have outlined the process and the various places in which Intelius notified Ms. [redacted] of the Automatic Renewal Program.   In addition to a Criminal Check and a Phone & Address report, Ms. [redacted] purchased a 1-month auto-renewing Premier Plus paid membership on March 19, 2017. On the payment information page of the paid membership purchase process, prior to completing her purchase, Ms. [redacted] was required to manually select a checkbox before she could complete her report purchase that stated “Yes, I agreed to the Intelius Terms and Conditions and Privacy Policy and the following Offer and Continuous Renewal Details”. This checkbox specifically notified her of the offer and the membership terms, including that her membership would automatically renew for the same term each time it reached its expiration date unless she chose to cancel, that her credit or debit card would be charged $29.95 for each renewal and that she could cancel her membership anytime either online or by calling (888) 706-2669 and that there are no refunds or credits for partial months or unused vouchers. A copy of the checkout page Ms. [redacted] saw when purchasing her membership is attached for your review.   The “Automatic Renewal Program” section located under the “Paid Services” portion of the Terms of Service states: “Upon your acceptance of an offer for the purchase of any subscription-based Paid Services, you will be enrolled in our automatic renewal program to help ensure that there is no interruption in your access to such Paid Services. This email contained Ms. [redacted]' membership identification number, the amount Ms. [redacted] paid for her paid membership, her renewal date, and a reminder that her paid subscription would renew unless she chose to cancel her membership either online or by calling the number provided.   According to our records, Ms. [redacted] did not opt out of the automatic renewal program or contact Intelius prior to her renewal date. Therefore, her membership was renewed for an additional term and her credit card was charged $29.95 on April 19, 2017 in accordance with the disclosures and the Terms of Service that she agreed to during her initial purchase.   According to the Terms of Service, Intelius has a no refund policy. However, as a matter of customer courtesy, a customer care agent removed Ms. [redacted] from the paid membership program and provided her a refund of her April membership fees on May 8, 2017 in the amount of $29.95. Ms. [redacted] should note this refund on her account within the next 5 to 7 business days depending on her financial institution's billing cycle and internal refund policy.   This information should successfully resolve Ms. [redacted]' complaint. At some point in the future, an individual may need to resubmit a request to opt out for any new records that may have been added to its database since their last opt out request. While we are unable to anticipate how, when, or if information will reappear on our sites, we will be more than happy to remove an individual’s information upon request.    Mr. [redacted] may temporarily still see his name listed within search engine results. If this occurs, it means that while Mr. [redacted]’s information was still in our systems, search engines crawled and indexed the public results pages of the Intelius website. The search engine will need to re-index these webpages and update the information they have cached. Search engines frequently update this information, however, when and how often these pages are re-indexed is beyond our control and is based on each search engine’s internal policies and algorithms.   Additionally, managing personal information through the Intelius opt-out service is just one step in eliminating its availability. from sources such as: marketing surveys, land deeds, catalog purchases, voter registrations, lawsuit filings, court records, magazine subscriptions, and address changes.  This data is compiled into a comprehensive public record search that Intelius maintains with active updates from its sources.Our bulks sales department operates at different hours than our Customer Care.  Once Mr. [redacted]’s sales person was available, attempts were made to reach him by email and phone.  After communicating with Mr. [redacted] by email, an agreement was met to refund the unused search credits.We processed a refund of $430.00 for the unused Background Report search credits to Mr. [redacted]’s account on 2/22/2016.  This refund will appear on his statement in one of the next two billing cycles depending on the closing.We sincerely appreciate your cooperation in resolving this matter and apologize for any inconvenience.

The terms and conditions of the Intelius Premier Plus promotional offer, including the billing details, are presented multiple times during the purchase process. Once a user selects a specific price point, the billing details are shown in the order summary, which is viewable on each page of the checkout process. On the final page of the checkout process, the billing details of the promotional offer are presented again and the user must affirmatively check a box next to these details in order to complete the purchase. If the billing details are not accepted, the promotional offer is removed and the cost of the report will return to its full standard price. Additionally, after a purchase is completed with the promotional offer, the customer will receive a pop-up and a welcome email for Intelius Premier Plus, which reiterates the billing details. A copy of the program details users are shown prior to selecting their report is attached for your review.
 
According to our records, Ms. [redacted] purchased her initial search report on December 30, 2016. Ms. [redacted] then cancelled her Premier Plus membership on January 7, 2017. Since Ms. [redacted] cancelled her Premier Plus membership within the first 7 days, her account was charged the $7.95 trial membership fee rather than the full priced Premier Plus fee of $29.95.
 
Ms. [redacted] contacted the Intelius customer care twice on January 9, 2017. Both times Ms. [redacted] hung up on the agent while they were explaining the charge. Per the Terms of Service Ms. [redacted] agreed to upon the completion of her report purchase, Intelius has a no refund policy. However as a matter of customer courtesy, I have provided her a refund of $7.95.  Ms. [redacted] should note this refund on her credit card within the next 7 to 10 days depending on her financial institution’s refund policies.

The data is compiled into a comprehensive database record that Intelius maintains with active updates from its sources. Due to the nature of public records, however, Intelius cannot warrant the information provided is always current, complete, or accurate. Additionally, a notice regarding the limitations of criminal and civil search results is provided to users within the 13 items noted as potentially available in a background report prior to user’s purchase of the report.   Per the Terms of Service Ms. [redacted] agreed to upon the completion of her purchase, Intelius has a no refund policy. However, as a matter of customer courtesy, a customer care representative provided Ms. [redacted] with a partial refund of $25.00 on March 7, 2017. We are in receipt of the consumer complaint filed by Mr. [redacted] in connection with his dissatisfaction with the information received on the Federal and Nationwide Criminal Search Report he ordered on January 6, 2017....


 
Intelius is an online public information website. The information we provide is gathered from public records and publicly available information via local, state, federal and other agencies. This data is compiled into a comprehensive public record search that Intelius maintains with active updates from its sources. However, it is important to note that not all states or every county within each state provides digital access to its records and therefore some records may be incomplete.
 
In Mr. [redacted]’s case, the search he performed was for an individual he indicated lived in South Dakota. South Dakota is one of seven states that restricts digital access to its records. However, had the individual Mr. [redacted] researched had a record in one of the 43 other states that allow access, that information would have been provided on the report.
 
Per the Terms of Service that Mr. [redacted] agreed to upon ordering his search, Intelius has a no refund policy. However, as a matter of customer courtesy, I have provided a refund to Mr. [redacted] for the Federal and Nationwide Criminal Search Report. Mr. [redacted] should note this refund on his account within the next 30 to 60 days depending on his financial institution’s billing cycle.
