Intelius notified Mr. [redacted] of the membership offer and details.   On December 23, 2016, Mr. [redacted] purchased a 50% discounted Premier membership in the amount of $9.95. Mr. [redacted] was notified of this offer when he selected his report and again on the payment information page. Additionally, he was required to manually select a checkbox on the payment information page before he could complete his report purchase that specifically notified him of the offer and the membership terms, including that his credit or debit card would be charged $19.95 each month. Mr. [redacted] was presented with language in the same checkbox that by clicking the button to purchase, he agreed to the Terms of Service and Privacy Policy (with hyperlinks to each). A copy of the initial offer page and the purchase page is attached for your review.   The “Automatic Renewal Program” section located under the “Paid Services” portion of the Terms of Service states:   “Upon your acceptance of an offer for the purchase of any subscription-based Paid Services, you will be enrolled in our automatic renewal program to help ensure that there is no interruption in your access to such Paid Services. Under this program, you authorize us to automatically renew your subscription at the end of the term of the subscription you purchased, and each subsequent term, for the same term length of the subscription you initially purchased (unless otherwise stated in the offer you accepted). Unless you change your renewal status as described below, at the time of each such renewal you authorize us to charge your designated Payment Method at the then-current, non-promotional price (unless otherwise stated in the offer you accepted) for the renewal of your subscription. If you no longer want to be enrolled in our automatic renewal program, you can change your renewal status at any time by completing the following steps:   ·         Intelius.com – cancelling your membership on the My Account portion of the Intelius.com Website or by calling (888) 445-2727.   Please note that completing these steps will only stop future automatic renewals of your subscription and will not impact any automatic renewals that occurred prior to the date that you completed these steps.”   Shortly after his report purchase, Mr. [redacted] would have received a receipt confirmation email sent to the email address associated with his Intelius account. This email contained the amount Mr. [redacted] paid for his report and the Intelius Premier membership terms and conditions and instructions on how to cancel his membership.   According to our records, Mr. [redacted] contacted us February 11, 2017 regarding his membership. However, the email address he provided, [redacted]@gmail.com, is associated to an account that hasn’t been active since August 6, 2016.  After reviewing, the full correspondence, I was able to locate a secondary account using the ID transaction Mr. [redacted] provided in a later correspondence.  This account is located under the email address [redacted]@yahoo.com.   Per the Terms of Service, Intelius has a no refund policy. However, as a matter of customer courtesy, I have provided Mr. [redacted] with a refund of his last four month’s membership fees in the total amount of $79.805 (4 x $19.95) on March 28, 2017 and removed him from the Premier Membership program. Mr. [redacted] should note these refunds on his account within the next 30 days depending on his financial institution’s billing cycle and internal refund policy. We are unable to provide Mr. [redacted] with any additional refunds.   This information should successfully resolve Mr. [redacted]'s complaint. offer includes a discounted report price plus a one-week trial of the Intelius Premier Plus membership.  If the user elects to continue with their selected report type but does not wish to continue the Premier Plus membership they are instructed to cancel the Premier Plus membership within the first 7 days and they will only be charged $7.95 for the trial membership. If the user does not cancel within the initial seven days, their credit card will be charged a monthly fee of $29.95 for a Premier Plus membership.   Per the Terms Service, which Mr. [redacted] agreed to upon the completion of his report purchase on February 15, 2017, Intelius has a no refund policy. However, as a matter of customer courtesy, an Intelius customer care representative removed Mr. [redacted] from the Premier Plus membership on February 15, 2017 and suspended the $7.95 trial membership fee once Mr. [redacted] contacted them via phone to request his removal from the membership program. Additionally, it is important to remember that the opt out procedure is temporary.  Intelius is constantly updating their database with new public records.  It is possible that an individual may need to resubmit an opt out request for any new records that may have been added to our database since their last opt out request.  While we are unable to anticipate how, when, or if information will reappear on our site, we will be more than happy to remove an individual’s information upon request.  We appreciate your cooperation in resolving this issue and apologize for any inconvenience.

Complaint# [redacted] Consumer name: [redacted]   We are in receipt of the additional information supplied by Ms. [redacted].   According to our records, the only communication received in connection with this account was by Ms. [redacted] on May 25, 2017.  Since Ms. [redacted] is not the accountholder on file, the customer care representative that she spoke to was unable to share any of the account details with her and Ms. [redacted] declined to provide any proof of authorization to act on behalf of the accountholder at that time.   Per the Terms of Service the accountholder agreed to at the time of their initial purchase, Intelius has a no refund policy.  However, as a matter of courtesy, I have provided a refund of the last three months' membership fees to the credit card on file in the amount of $89.85 (3 x $29.95) and terminated the membership. The refund will be noted on the accountholder’s billing statement within the next 30 to 60 days, depending on the financial institution’s billing cycle and internal refund policies.   This information should successfully resolve Ms. [redacted]’s complaint. Intelius customers are presented with a two tier pricing structure when purchasing reports on the Intelius website.  They have the option of paying the full price, or a discounted promotional price which includes a 7-Day Pass of the Intelius Premier Plus Membership.  When a customer...

selects the promotional price, they are presented the benefits of the membership and the terms and conditions of the offer, including billing.  By choosing to proceed with the purchase at the promotional price, the customer agrees to the terms and conditions of the promotional offer.In this case, the promotional offer was accepted and the Intelius Premier Plus 7-Day Pass was activated.  As requested, the Intelius Premier Plus 7-Day Pass was canceled on 11/04/2015 and the charge for the 7-Day Pass was never charged.  Additionally, since the Assisted Phone Search Report did not return any results, the charge of $0.95 was canceled on 11/05/2015. This will reflect on Mr. [redacted] statement in one of the next two billing cycles, depending on the closing date.  No future membership charges will occur.We appreciate your cooperation in resolving this matter and apologize for any inconvenience.

Complaint: [redacted]I am rejecting this response because:  it is unreasonable for a business to say "we've resolved your problem for now" and then explain that that very same problem will be reinstated in an unknown period in the future.  The business has in effect blamed another system for its own behaviors.  If a business is unable to control it's websites content, even after a customer has very reasonably complied with all requests for personal identification, then that business should be held accountable.  These are very shady business practices and if a business is shady in one part of its dealings, it will often be shady in another.  I've worked with numerous company's to remove my information for my safety and they quickly complied with no trouble at all, the company is the giving me terrible trouble with the process and the only one telling me that they will reinstate my info.  Shame on them and those that write up their terms of service!Sincerely,[redacted]

I am rejecting this response because: The business has requested further information to process my claim.  Here is is: 1) The account was created using the email address [redacted].net2) The credit card used to create the account ended in 7016.  I have shredded the card and cannot get the rest of the digits.  However, this card was associated with an account that has a second card associated with it.  That card is [redacted].3) The original, intended one-time order was [redacted].  Since that time my card was charged repeatedly for a monthly fee that I had no intention to sign up for.

As requested, Intelius has removed Ms. [redacted]’s information from the Intelius database, as well as affiliated sites.  However, if an individual changes their name or acquires a new address, it may be possible that a new listing would appear.  While we are unable to anticipate how, when, or if information will appear on our site, we will be more than happy to remove an individual's information upon request. We were unable to locate any search results which included Ms. [redacted]’s email.  If Ms. [redacted] could reply with the URL where the listing appears and indicate which city and state appear next to the listing, we would be happy to remove it.We appreciate your cooperation in resolving this issue and apologize for any inconvenience.

I don't have an email that this "ORDER" was placed from because I didn't place any ORDER.  The card that is getting charged however is a discover and starts in [redacted] and ends in [redacted].  Screen capture attached.  I have reported more of the charges as fraud to my credit card company.

However, I want to make note that while my specific situation has been resolved to my satisfaction, the policy of this company to absolutely refuse the removal of their credit card information is ridiculous.  A really good company should allow this as an option on their website.  The fact that I had to go through the Revdex.com to force them to take this action should be grounds to remove their Revdex.com Best rating for six months.
