Management spoke to [redacted] regarding the cancellation of his paid in full membership. Due to [redacted]'s relocation meeting the requirements a cancellation has been processed and a pro-rated refund in the amount of $225.60 has been refunded back to the [redacted] card on file. Refunds take about 5-7 business days to be completed. Member is satisfied. Thank you

Management spoke to [redacted] [redacted] on 3/23/15 regarding her concerns with the pool being closed. She is happy with the follow up. This matter is resolved. Thank you

LA Fitness will not bill member any further for personal training dues and we will allow her additional time to complete her remaining sessions.

Management contacted Ms. [redacted] regarding her complaint, in which she voiced concerns about an incident that took place involving another member at our Arlington-Clark St location. We apologize for the experience Ms. [redacted] had and in no way condone the alleged behavior the other member exhibited. LA Fitness membership agreements clearly state that “During Club use, all Members and guests will refrain from engaging in loud, foul or slanderous language or molesting, badgering or harassing other Members or club employees, agents and contractors. Threatening or violent conduct is prohibited.”  We informed Ms. [redacted] that the other member involved has been addressed. Ms. [redacted] has indicated that she appreciates the follow up and we will continue to support this member. We believe this matter to be resolved at this time. Thank you.

Refunds are processed back to the form of payment as received. The amount of $286.84 was refunded on 12/13/14. [redacted] can contact Amex in regards to receiving his refund. No further action will betaken.   Thank you.

Management spoke to Mr. [redacted] on 1/6/15 regarding hismonthly billed membership. He stated he was under the impression he purchased a1 month membership. After explaining his agreement and what he signed up for weagreed to process an immediate cancellation and issue a refund in the amount of$42.35...

back to the Visa card and waive the balance of $24.69. No further balanceis owed. Refunds take about 5-7 business days to be refunded. Thank you Tell us why here...

In light of any possible misunderstanding at the point of sale, LA Fitness cancelled the remaining term of member's personal training agreement with no further billing or obligation.

Member states that he did not signed up for guest privileges at the point of sale. Management spoke to member and as a coutesy we removed guest privileges. Management also refund payments $21.40, $21.40 and $42.80 back to the[redacted] card online.  Refunds could take up to 5-7 days to process. ...

We believe this matter to be resolved.

Management contacted member regarding her monthly billed Family membership. She claims to have cancelled over the phone several times. No such cancellation was received.

Friday, but we strongly advise that member’s mail in a written cancellation request via certified mail to ensure return receipt. This cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properly. As a courtesy, due to her prior attempt to cancel, it has been agreed upon to refund $219.60 back to the [redacted] on file. Refunds typically take 5-7 business days to complete. We believe this matter to be resolved. Thank you.

Management spoke to Mr. [redacted] on 6/19/15 per his request guest priviledges has been added at the monthly rate of $20.00 as well as lowering his monthly dues to $29.95 a month. Member [redacted] to single club access as well. We believe this matter to be resolved. Thank you

[redacted] brought his concerns to the attention of our Personal Training Director (“PTD”) on 7/7/16. [redacted] claimed to have had a session scheduled for that day, 7/7/16. However, our records did not reflect that he had a session scheduled. Nevertheless, our PTD informed him that we had a staff...

member available to provide him with a personal training session but [redacted] refused to train.
It should also be noted that, up until that point, there had only been one instance in which [redacted]’s trainer had to cancel a scheduled session on short notice (he became ill and had to call out sick). Although the trainer he was scheduled did not show up, LA Fitness was still able to provide [redacted] with a personal training session on that day from another staff member. Thus, there is no grounds for a refund or to terminate [redacted]’s personal training agreement early without a fee. If [redacted] no longer wishes to continue with his personal training agreement, his agreement includes a voluntary cancelation provision, which affords him the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance due under the Agreement.
LA Fitness will honor this voluntary cancellation provision of his agreement should he elect to take advantage of it. Otherwise, [redacted] should be expected to honor his agreement as LA Fitness stands ready to accommodate his concerns and continue to provide the services for which he contracted.

Our previous response still stands Our Membership Policies and Club Rules and Regulations, which are part of the membership agreement signed by [redacted] clearly state that no Member or guest may coach or train other Members or guests (as solely determined by LA Fitness). Members may not engage in any businessor enterprise while at the LA Fitness clubs.  Like most health clubs, LA Fitness does not permit its members to provide personal training services to other members, as it creates a conflict of interest and utilizes our equipment and space to compete against us. Prior to taking the step of revoking [redacted] membership, this policy was explained to [redacted]  He was given warnings and an opportunity to cease these types of activity.  However, [redacted] chose to ignore these warnings.  Thus, after an investigation and a discussion with [redacted] on November 13, 2014 it was determined necessary to discontinue his membership privileges. The decision to revoke a membership is never taken lightly, but found to be necessary in this case. Notably, the LA Fitness membership agreement affords us the right to cancel a membership at any time for any reason, so there has been no violation of his contractual rights.  Accordingly, for the reasons summarized above, we are simply choosing to exercise this right pursuant to his membership agreement.

Our positions has not changed. Member’s concerns were addressed in our initial repsonse. It should also be noted that we have dual monitors installed at all of our sales desks with one the monitors facing the member. While member is signing and initialing each section via the digital signature pad, the terms are clearly visible to our member on a monitor in front of them.

Management contacted Ms. [redacted] regarding her concerns with the cancellation of her monthly dues membership. LA Fitness provides members with the option to cancel their membership at any location with an Operations Manager between the hours of 9AM-5PM Monday through Friday, but we strongly...

encourage that members mail in a written cancellation request via certified mail to ensure return-receipt. This cancellation policy is not designed to make it difficult for our members to cancel, but rather to ensure cancellations are handled properly. Ms. [redacted] states that she attempted to cancel via mail. However, we have no record of receipt of such a cancellation request. As a result, no cancellation was processed and monthly billing continued based on agreement terms. Nevertheless, as a courtesy, a cancellation was processed on March, 22 2017 with no further billing. We believe this matter to be resolved. Thank you.

Management spoke to [redacted] regarding the incident that occurred when he brought in his guests. We apologized for the way the incident was handled and all his concerns have been addressed. Member is satisfied with the follow up. No further action will be taken. Thank you
