Management spoke to Mr*** regarding the cancelation ofhis monthly billed membership for him and [redacted] A Cancelation wasprocessed on 1/20/and no further billing will occurA refund for one month’sdues for each of them has been processed back to the Visa card with a totalamount of $Refunds take about 5-business daysThank you ll us why here

Member purchased personal training services pursuant to a written and fully executed agreementThe agreement was for a minimum initial term of weeks, beginning 10/6/(the “Initial Term”)She paid a total of $up front, which included the processing fee and payment for the first four weeks of personal training sessionsShe further agreed to make more payments, in the amount of $each, every four weeks, beginning 11/3/14, for the remainder of the Initial TermThese terms are clearly outlined on page of her agreement and she acknowledged her understanding of these billing termsby initialing three separate sections of the payment schedule outlining these termsMember’s personal training agreement also includes a voluntary cancelation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only 50% of the remaining balance due under the agreementThis provision is clearly outlined on page of her agreementIn addition, her agreement included a New Client Checklist which outlined key terms, including her acknowledgement that she received and read a copy of her personal training agreement, the initial term of weeks and the voluntary cancelation provisionThis Checklist was reviewed with her at the time of the sale, as acknowledged by her signature on the New Client Checklist (copies of the agreement and New Client Checklist are included with this response)Her personal training services agreement specifically provided her with a 10-day right to cancel if these terms did not match her understanding (or for any reason) for a full refundHowever, she did not take advantage of this option within the rescission periodThus, she is not entitled to terminate the agreement early without a feeLA Fitness will honor the voluntary cancellation provision of member’s agreement should she elect to take advantage of itOtherwise, member should be expected to honor her per training services agreement as LA Fitness stands ready to provide the services for which she contracted

At the time of our last response (7/11/15), we extended the expiration date of member's remaining personal training sessions to 1/11/We assumed months would have been more than enough time for member to complete her training sessions and did not anticipate that she wouldn't actually begin to resume training months after the factWe have extended the expiration date an additional months from now to 9/23/and member does not need to purchase any additional sessions

Effective November 20, 2015, Fitness & Sports Clubs, LLC (a wholly owned subsidiary of Fitness International, LLC), doing business as LA Fitness (“LA Fitness”), purchased certain club assets related to Hour Fitness clubs and acquired certain membership agreements [redacted] membership was one of those memberships Thus, His agreement and billing information were not obtained unlawfullyAs [redacted] acknowledges, his membership was on a freeze status at the time of the acquisitionAccordingly, he was not billed for any monthly duesWhat he was billed for was the annual fee of $that he agreed to pay when he purchased his membership with Hour FitnessThere was no mistakeNevertheless, as requested by [redacted] in his original complaint, a courtesy was extended to cancel the memberships and a refund was completed back to the [redacted] Card in the amount of $ [redacted] requested no additional contact during his conversation with management However, should [redacted] have any additional concerns he has direct contact information and, if needed, we would be happy to assist himThank you

The district manager called meI believe his name was [redacted] As he talked to me, it seemed like he was involved with another conversationBasically he said the only thing I could do was call the cops again and have him interview the staffAlthough, he admitted that some employees are no longer with the companyHe said they won't do anything else no refund or membership reimbursement (j don't want to workout there anymore anyway)After that worthless interaction, I disconnected the phone call [redacted] ***

As of the time of this response, member has disputed the payments with her bank and defaulted on the agreement termSince it is apparent that she now has no intention to fulfill her contractual obligation to the remaining personal training agreement term, we have released her from this obligation to make the remaining payments due under her agreementAdditionally, LA Fitness will not pursue her for the outstanding balance she currently owesPlease note that we are not contractually obligated to provide this remedy, but this is being done as a customer service consideration for our memberHowever, she is not entitled to a refund on top of the consideration already made

Member’s personal training agreement also includes a voluntary cancelation provision, which affords him the option to unilaterally cancel at any time, for any reason, by paying only 50% of the remaining balance due under the agreementHowever, LA Fitness contacted member and we offered to reduce the cancellation fee from 50% down to 25% of the remaining agreement balanceMember elected to take advantage of the offer, paid the reduced fee on 5/12/and we cancelled the remaining term of his personal training agreement accordingly

Management spoke to [redacted] on 12/23/regarding the cancellation of her memberships [redacted] states he cancelled several times and continues to be billedOur records indicate no cancellation has been received.However as a courtesy a refund in the amount of $has been processed back to the [redacted] card and the balances have been waived on all three memberships and no further billing will occurMember is satisfiedThank you

As outlined in our initial response, we received member’s doctors note dated 1/13/and immediately cancelled her membership and stopped all billing upon notificationWe have not billed her since her notification and request to cancelLA Fitness is not required however to issue a refund or credit for the costs of any services purchased by the member and provided by the health club prior to the health club’s receipt of a member’s cancellation noticeThus, there is no refund owed
