LA Fitness added back member's remaining sessions and will be available for member to use over the next weeks

Our records reflect that member trained regularly up until 5/19/However, as of the time of this response, member has not made any of the payments owed since 4/10/having disputed the payments from May-forward with his bank and defaulted on the agreement term
Since it is apparent that he now
has no intention to fulfill his contractual obligation to the remaining personal training agreement term, we have released him from this obligation to make the remaining payments due under her agreement.
Additionally, LA Fitness will not pursue him for the outstanding balance he currently owesPlease note that we are not contractually obligated to provide this remedy, but this is being done as a customer service consideration for our member

fitness contacted me and told me they would transfer the membership to my son.  I went to la fitness today with my son and they did the transfer.  [redacted]

Management contacted Ms. [redacted] regarding her concerns with the billing and terms for [redacted]’ monthly dues membership. Ms. [redacted] claims that the information provided to her regarding sign up differs from the rate and terms processed for the membership added on to her account. As a courtesy,...

a cancellation was processed on both memberships and the overdue balance of $99.18 on Ms. [redacted]’ membership has been waived. Additionally, we agreed to issue a refund of $32.09 on Ms. [redacted]’s account to be processed back to the [redacted] card on file. We believe this matter to be resolved. Thank you.

This just show what type of business model La Fitness is running . They have their trainer lie to unsuspecting customers and have them sign up for training session and lie about the cancellation policy. I would consider this misleading and fraudulent. You can materially lie to a customer about a cancellation policy and then sign them up for training sessions so you can entrap them. I just want to state again that I originally told the LA Fitness trainer that I was only interested in 4 months with a trainer and he specifically said I could cancel anytime without any penalty. I materially relied on this information when I signed that contract for the trainer.  I do not believe in doing business with any company that allows his employees to deceive customers and then compound the situation more for the customer by penalizing them with penalty instead of correcting the bad business practice.

Our Personal Training Director has been in contact with member, [redacted], regarding her concerns. She elected to take advantage of the voluntary cancellation provision, which affords her the option to unilaterally cancel at any time, for any reason, by paying only half of the remaining balance...

due under the agreement. She paid the cancellation fee on 7/8/15 and we cancelled the remaining term of her personal training agreement accordingly.

LA Fitness agrees to settle with member in an effort to resolve this dispute. The remaining term of his personal training agreement has been cancelled with no further billing or obligation, a refund in the amount of $1,440.00 has been processed ($1,080.00 plus the additional $360.00 that was charged on 4/22, after he filed this rebuttal) and he will have one month (8 sessions) to utilize at another LA Fitness location.

Our District Operations Manager contacted member and she was a little confused as to why her personal training membership reflected a certain amount of sessions when it was initially cancelled but then reflected a lower amount when she checked again later. We explained that amount of sessions remaining were adjusted to account for the refunds that were processed after the cancellation. In addition, any free sessions that were previously applied to the membership were removed upon cancellation since the agreement was cancelled early and the initial term was not completed. Member understands and no further sessions willbe added.
