Unfortunately we cannot calculate the loan to value until we get all your options (leather, wheel drive, stereo system, etc) and call your current lienholder to know how much exactly you oweUntil then we assume that we can make your deal work but its not final until we get those itemsThis isn't any different than a mortgage who has to do an appraisal to make sure the value of a house is within the loan to value guidelinesAgain I am sorry that we were unable to help you

Ms [redacted] - thank you for your emailI am sorry we were not able to assist you in refinancing your vehicleIt is not our practice to return any documents to you especially since most are copiesI would be willing to shred all documentation you provided as it relates to the two original documents you returned to usAgain, all of the documents requested were in an effort to overcome the loss of income from what you stated on your application when you applied to what you could actually verifyWe will set into motion the destroying of the original paperwork you provided.Regards,The OpenRoad Lending Team

Mr*** - thank you for voicing your concerns about our company and processesI have reviewed your applicationIt appears the reason for the decline is due to Capital One reporting to the credit bureau that you are now past due on a credit card payment which is a change in the credit file we
obtained when we made the offer to refinance your vehicleThe back of the letter you received from us states that if there are any changes in your credit profile then your offer is no longer validOnce that account is brought current and Capital One reports it that way to the credit reporting agencies, we can reconsider the pre-approved offer for you refinancing your vehicle.I do apologize this was a poor experience with our company and hope we can earn your business in the future.Regards,The OpenRoad Lending Team

I am sorry that we are unable to help you at this time but you are approved based on your credit However your loan to value (what your car is worth as compared to the loan you have against it) is way too high Your loan to value is over 186% which means your vehicle is only worth $7,
but the new loan would be over $14,dollars If you are able to pay it down by $3180, then your loan to value would be 145% and we would be able to continue with the loan process Otherwise at this time there is too much difference in your LTV that we cannot help I am sorry

I am sorry we mailed you something to save you money. We help thousands of customers lower their payment, interest or both each month. We identified you based on the interest rate you are currently paying for your auto loan. We are accredited by the Revdex.com since March 2013. We
are an A+ rated company and recently the Revdex.com has been updating their rating so it so NR but I can assure you that we are A+ as we take any complaints seriously. I will have you name removed from our listing but you can also opt out per the instructions on the back of the mailer for any marketing materials from any company. Sorry that we mailed you and best of luck

Unfortunately the issue is the way the credit bureaus report as the Cap one acct in one bureau showed as open and in another its notWe are willing to remove the inquiry if you will send us a letter asking the removalThanks for your understanding

Again, I did not AUTHORIZE submission of the application. When I initially went to the website all of my information was populated and as reconsidered continuing I went to exit and then it said it was submittedI immediately called and no answer or return phone callI called the next day advising that I DID NOT AUTHORIZE any credit checkI did not want to submit an application and the lack of communication available could have avoided this processMy credit was ran without my consent and I am requesting to have these removed

I am rejecting this response because: Open Road Lending is unscrupulous and unethicalI do not recall the small print they state was in the initial application giving them permission to pass my personal information to other lendersIf I had been aware I would have never consentedI received their notice in the mail captioned "FINAL NOTICE" "NOTICE OF OVERPAYMENT." Inside the notice it reads "Open Road Lending is happy to inform you that after a review of your credit, you are PRE-QUALIFIED." That information is an outright lie and highly misleadingI also believe it to be illegal At the bottom of the notice is a telephone number to opt out of "prescreened" offersI called that number and was never able to access an "opt out" feature, instead I was solicited for other offers and asked to give my credit card number for "free gifts" from Spectrum Internet, Direct TV, and other promotional "special offers for calling in today." This is a scam.It is also not true that I never notified Open Road Lending with my complaintI have email correspondence to the contraryIt is also not true that multiple inquiries of my credit standing have no negative affect on my credit ratingI have two letters from CarFinance.com dated August informing me of checking my credit twice under two different application ID'S "Number of inquiries" is one of the issues stated by a credit agency as affecting my credit score When I contacted CarFinance.com I was told they received an application in my name from Open Road LendingThis would have been much longer than the days stated in Open Road Lending's response above to my complaintThey continue to cause me injury by sharing and abusing my personal informationThese practices target people who are the least able to defend themselves and who are most vulnerable because of poor credit ratingsPlease be informed, I am considering seeking counsel for a class action lawsuit because this practice needs to be stopped

I am sorry about your poor experience but *** is one of our most experienced agents. The issue is not that you arent approved from a credit perspective, it is your vehicle has a loan to value (the amount you owe as compared to what it is worth) is too high. It is over 150% LTV and the
most we can do on your loan is 135%. So if you were able to bring down your loan amount by about $1,with a payment we would be able to proceed. Again from a credit perspective you were approved but the value of the car in relationship to the loan payoff is too great. I am sorry we could not help you at this time

I am rejecting this response because according to the advertising I received attached I agreed to fill out a loan application suggesting I would receive these terms. I am asking you to remove the inquiry from my credit report ASAP for falsely advertising I would receive better terms on my current loan and that you are not a bank. Look at the screenshot and tell me you wouldn't be led falsely into filling out an application!!! Remove your inquiry ASAP and I'm not interested in paying MORE interest and a longer term for my vehicle!

Ok then there's nothing else to say, I don't care about other customers I care about myself, yeah you might help thousands each month but screw thousands tooWhen I submit my application it was through my phone mobile site and I didn't came across your sneaky ways of giving away customers personal information and let other companies run one's credit multiple timesBut like you said you do not care and will not remove the inquiries so why waste my time with such company

Again I am sorry but the customer is picking and choosing facts The aforementioned police report we said if he felt someone had used his credit (stolen identity) we could investigate and see about removing the inquiry The police report that we got was that some financial institution had sold his information and the report clearly stated that was a civil complaint not a criminal compliant like stolen identify would be Again if Mr *** feels as if someone completed the application on his behalf, then he should start with *** ***, which is where we received the application from We only processed what we received from *** ***

Thank you Mr*** for your noteYou are correct in the fact we passed your application onto other lenders once we were unable to approve your applicationYou agreed to those terms when you completed your applicationThose disclosures are listed below for your referenceWhen a lender reviews an
application for credit, by law they have days to provide you with an adverse action letter detailing the reasons for the declineSome lenders issues those immediately and others wait a period of time before sending themI am sorry we were unable to assist you in your refinancing of your vehicleRegards,The OpenRoad Lending Team I authorize OpenRoad Lending and its lending partners, automobile dealers, third parties, affiliates, agents, service providers or assignees to obtain such additional information as may be required, including credit reports, in order to complete the processing of my application.I understand that I could have multiple inquiries on my credit report through this process and I am granting OpenRoad Lending and its partners permission to access my credit report to determine if I qualify for refinancing my existing auto loan.I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needsSome of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender

This does not resolve my issueIt isn't my fault that there was an "oversight" on your part of my child support obligationI was more that forthcoming with everything my wife and I submittedMy child support obligation is about to end as my child will be years old soonHowever, that wasn't asked and excuse me for being responsible and taking care of my childrenHowever, being loan experts I don't understand why wasn't that noticed when I first submitted my pay data three weeks agoI'm fully aware of what a DTI is and its importance of being able to have credit extended to youWhich again is why I figured that it was the first item looked at once the pay stub was submittedHow do you explain not having seen that for that amount of time and having tagging along for the ride thinking I was approved?Secondly, why wasn't I informed formally by an individual or representative? Maybe the same one that called me endlessly day after day to get item after item for the past five weeks? At any cost, I was informed to not pay the note to the previous lender by your associateI was told by your associate that I was approvedThat everything else that was requested was solely for the lender's records and what was required from a client that is a business ownerNOT documents required as we were still awaiting credit approvalMy inconvenience can not be simply chalked up to "he's a new employee"That's unacceptableNo one in their right mind would go through this rigorous process for five weeks on a chance that it could be deniedI for one would not have gone through all of this if there was a slight inclination that this process would have ended in a denial. I feel lied to, misled and cast aside as I wasn't even given the common courtesy of a single phone call with the results of my application or an explanation for why we were deniedI have emails that went and are still unansweredAfter all the inconveniencing and being woken up with call after call, I now can't even receive an email reply. I had to file complaints and make irate phone calls to get an explanationTo take anger out of the situation and get straight to the point; My case was mismanaged, I was given ill-advised instructions from your company, which has placed my family in a very compromising positionAn apology isn't enoughAt this juncture all I want is for the inquiries from your lending partners to be removed from my wife's and I creditI was informed about the disclosures, however, I'm asking for that as a form of compensation for your company's week oversight and ill-advise givenThat's all that I wantNothing moreI want to totally erase this experienceThere won't be any business between my family and Open Road Lending, ever, but best to you with future endeavors

I am sorry but unless there is identity theft, we received the application in earnest There is no way we would have gotten all the information about you or your vehicle, unless you or someone else clicked the submit button and from the credit bureau's perspective, it is a valid inquiry They dont just allow us to remove an inquiry because someone doesnt like the outcome

The reason for the decline is because the auto we were trying to refinance is now reporting to the credit bureaus as being past dueIn fact, both of your open auto trades are showing past dueThere are disclaimers on the back of the letter that states if anything has changed on your credit report since the time we received your information initially, we no longer have to extend you credit.I do apologize for the inconvenience.Regards,The OpenRoad Lending Team

Thank you for sharing your concernYou are correct, we did approve your loan up front (actually at a lower rate than our mailer offered - 3.5%) but there are restrictions that come with that approvalThe loan to value of the vehicle we are refinancing cannot exceed 125% of the wholesale value of
the vehicle meaning we will finance 125% of what the vehicle is worthUnfortunately, you owe substantially more than that and your loan to value exceeds 150% which is outside our allowable limits and therefore your approval was turned to a declineWhen you submitted your application with us, you gave us permission to pass your application onto other lenders in the event we were unable to provide you with a loanThat is why you received info from other lenders.Again, we do apologize that we were not able to assist you in lowering your car payments and hope we can earn your business sometime in the future. Regards,The OpenRoad Lending Team
