I am rejecting this response because: The bottom line is this: Pool outlet in front of septic system, therefore can't be used So either pool outlet installed in wrong location or septic system installed in wrong location I have been asking Gehan to produce a document that shows me signing off on location, but they have yet to produce such a document

I am rejecting this response because: Gehan Homes should not offer options that they know little or nothing about I paid $for an option that is useless to me At the time of pre-drywall I couldn't of cared what side of the house the plug is on as long as it's on the same side of gas line Not only is it not on the gas line side, but it's right in front of the septic system which renders the plug useless Pool equipment can't be installed in location because septic system in way This plug was installed wrong on two fronts and now they want me to shell out more money to move a plug that was installed in wrong location to begin with Gehan Homes needs to be held accountable for their errors They had absolutely no response for me when they came out and saw the plug right in front of the septic system other than that they build homes and not pools, so they know little about where these plugs need to go Not resolved

HOA, through its members, to evaluate and decide upon the installation of an owners only access gateWith regard to the appraisal, please understand that independent licensed appraisers in the State of Texas are a third party entity which have no affiliation to any business they are performing an appraisal on,including Gehan Homes. While not privy to the appraisal this customer is referencing, if it was so stated then that was an oversight on the appraisal company's part. We would urge them to contact the appraisal company directlyTheir contact information should be in the report.Again, thank you for your inquiry.

I am rejecting this response because:We feel that Gehan does not understand the gravity of this issue for the consumerGehan offered homes for purchase, indicated that by the completion of construction it would gate the community, and urged purchasers to utilize its lenderHomes purchased from Gehan utilizing Gehan's lender have appraisals stating the community is gated--a fact Gehan has previously recognized and we have supporting documentation confirming the statement. Homes purchased through other means do not have the statement about the View being a "gated community." As Gehan states, appraiser should not include information that they are unable to confirmThe appraiser could have only received that information from Gehan since there is no actual gate present. We ask that Gehan perform as promised and put in the gate as indicated to the customers directly and as it influenced the appraiser to doIndicating to the consumer and to the appraiser that the community would be gated and having no intent to gate the community is deceptive

We appreciate the customers candid feedbackWhen warranty service requests are received through our online portal, they are logged in for tracking and follow up purposes.This customers warranty history is as follows:2/27/- move post move in service request - miscellaneous punch items, none of
them grading related.3/17/- Warranty request with photo to address standing water at fence line common with adjacent houseIt was determined the adjacent house was watering too frequently and that was adjusted.4/17/- Request to adjust front door hardware handleset.10/19/- Inquiry regarding cabinet shelving.On October 30th of this year, portions of Buda and various areas throughout Hays County experienced up to inches of rainfall in a hour period, causing significant flooding in those areas affectedUnfortunately, this customers home is in an area that experienced significant rainfall, causing many homes in the area to floodThe flooding, and subsequent damages, was not a result in any construction defect in their home but in fact caused by the significant rainfall, which is an act of god and not covered under Gehan Homes, or any homebuilders, warrantyWe have conveyed to this homeowner to review their homeowners insurance policy to ascertain their level of coverage for this incidentUnfortunately, Gehan Homes is not in a position to address their flood related damagesWe hope this answers any questions related to this issue

I am rejecting this response because:
First and foremost, they fail to point out in their response that they did provide me a fraudulent appraisalThat is my issueI know the stipulations in the contract that they had tucked in there about being responsible for the differenceBut what about the lies in the appraisal? Simply ignore them and hold hem harmless? How many more people have fallen victim and don't even know it? Come on *** ***You and your team know y'all tried to twist my arm to sign the dotted line despite the poor business practice that the Feds really frown upon.... Respond with an admission of fraudulent practice, attempts to still get me to go with it and close, and I will know you are not trying to deflect the issue at hand to a non-issue (contract terms)I realize the contract was flawed in that it left me no negotiation window regarding the appraisal but come on, let's start with a clean appraisal first.

I am rejecting this response because:Dear Ms*** ***,We disappointed to learn that Gehan Homes tried to terminate the sales agreement due to the house can't be closed on May 15. We received an e-mail from Gehan Homes on April 6, 2015; Gehan Homes wanted to close the house on April 30, but actually the house was still under construction and will not be completed until end of April. Gehan Homes notified us to walk through the house on April 27, but the house was not completed at that time (not only the appliances were not installed, but the construction was not finished). Gehan Homes sent us another e-mail on May 1, and asked us to walk through on May 6, 2015. We walked through the house on that day (May 6, 2015) but the house got no occupancy permit until May 8, 2015. We got a second walked through on May 8, 2015.*** Lending, our original mortgage company was handling our home financing. Mr*** *** (sales consultant of Gehan Homes) asked us to change to Gehan Homes' preferred mortgage company (***) on April 22, 2015. Mr*** *** claimed that Gehan Homes will waive all the late penalty if we got home financing through ***. We followed Mr*** ***'s recommendation and sent the application to ***. We received requests from *** to provide further documentation regarding our loan application but at that moment *** Lending notified us they already done the appraisal and final inspection of the house. Mr*** *** notified us on May 12, to close the house between May to 15, 2015. We followed Mr*** ***'s instruction to prepare a cashier check $3,and ready to close the house on us. Mr*** *** asked us to prepare cashier check of $4,to cover the late penalty on May 15, and we followed his instruction to do so.*** Lending notified us on May 15, that the fund will not be ready until May 18, 2015. Ms*** ***, the Closing Officer and Vice President of *** Title told us that Gehan Homes withdrew the closing on May 18, at the time we dropped by *** Title in the afternoon on May 18, 2015. We are preparing to pay any late penalty and charges arisen from the any delay of the closing. According to Terms (e) Closing of the sale in the Contract Agreement: If closing is delayed through no fault of Seller, Seller may at its option charge Purchaser a contract extension fee equal to $the first day and $per calendar day thereafter during such delay. We would like to pay the captioned contract extension fee up-to-date and close the property immediately. We do appreciate the customers input, but to reiterate all information used by an appraiser is collected through them. Gehan Homes are not appraisers but are almost certain that an appraiser would not use features or conditions for a property that do not exist at the time of appraisalAnd the community does not have a members only gateAgain, thank you for your inquiry

*** ***.In regards to the cabinets please understand this home is over years complete and is well past any warranty timeline for cosmetic cabinets concernsIn speaking with our team and our cabinet installer we verified your cabinets that were installed and signed off by you at close are of the correct, color, material and specification installed in our homesYou also completed a comprehensive walk at close and per that document accepted that the home was 100% ready for move in and completeAs a courtesy Our Area Manager had a few doors replaced as goodwill and there are some screws at the venthood that our warranty team is going to replace as a courtesyWe are also changing your cracked floor tile as a courtesyCracked tile is not warrantableThank You

Gehan Homes will call the home owner and set up and inspection of the property in the next weekUpon inspection, we will create a plan to assist and/or correct the electricalGehan Homes stands behind it s work and if there is indeed a workmanship issue, especially one that compromises the

I am rejecting this response because:Thank you for proceeding with tile replacement, I haven't heard from anyone yet from tile companyI sent tile number that I would like to go with to JARED two weeks ago but no response from him either as usual.For cabinets have a look the pics I attached here with,- cab_door_1.jpg : left and right door has big difference in color shades(both looks from different level)- cab_door_2.jpg : left and right door are different color shades but less than first one.- cab_door_3.jpg : left and right door looks similar color shades.Please explain, is this cosmetic damage that happened over the period of time?As Gehan has confirmed that I have received the correct level/grade of cabinets, which one is correct left door or right (In first picture)Please understand something wrong has happened with cabinet order, I would not stretch this much if I am happy by 80%.My proposal is compensation that I paid for the cabinet upgrade and change two doors that are looking totally different, aslo, fix the screws coming out in the cabinet over the exhaust hoodI am happy to consider if you have any reasonable solution
