I am rejecting this response because:
While Mr*** was supposed to be an independent appraiser, he received his information about the gate from Gehan and delivered the appraiser to Gehan's financial company. The language was in several appraisals within the community--not just ours--even a year later. If the appraiser was truly independent, the language would not have repeated itself. Providing funds to the HOA to determine whether or not we should have a gate is acceptable, but it is disheartening to hear that Gehan accepts no responsibility in the misinformation provided to the appraiser and to us as buyersAt least three other homes were sold with this information includedThis feels deceptive and inconsistent with the values we thought Gehan stood onWe will file a complaint on the appraiser, too, we hoped Gehan would step up to the plate and honor the information they provided.

As stated in Mr***’s email, Gehan Homes addressed his concerns and has signed off that the work was completed to his satisfaction as I included in the last email Please let me know if you need copies of those againAs stated in Gehan Homes warranty; “ Any cost incurred for hiring outside contractors or non-original contractors without written approval from Gehan Homes will not be covered under Gehan Homes warranty.” It is Gehan Homes understanding that we have one cabinet drawer face left to replace with Mr*** and have attempted to schedule with Mr*** but he has rescheduled with us three different times We are happy to install the new cabinet face at Mr***’s convenience but consider all other items complete and closed Please let me know if you need any other information Thank you for your help *** ***

Information mentioned in response is not trueGehan Homes is exactly in the business of keeping buyer’s earnest moneyThere was no communication barriers between realtor, us and Gehan Homes*** *** was playing his game on both sidesHe was telling us that our realtor is giving us bad advise and at the same time was trying to push our realtor (by texting her) to sell his houseHe was offering her bigger commissions on the next home she will sell from Gehan HomesGehan Homes mentioned in response that sales consultant was willing to give 100% of her commission towards our closing cost which is total lieShe was giving us $3,which is not 100%Sales consultant was also pushing our realtor to sell her house, so she can get commissions, not someone elseOn the end Gehan Homes blaming our realtor for everything which is not professional at all! *** *** didn’t have guts to admit that his team in Alamo Ranch community messed up in the house and didn’t install correct itemsI advise all buyers to check Selection Sheet on inventory home, or they will be short-cut and will pay for things that not in the house! This is how Gehan Homes make there money! Little-by-little they make thousands of dollars by lying! When you ask Gehan Homes to provide particular papers on the house to see what you are paying for, there answer will be: “This is an internal paperwork and not for buyers eyesYou shouldn’t have Selection Sheet in your hands.” Any other builder in town provides Selection Sheet with all details before you even think about signing contractObviously, this is not the case with Gehan Homes, you have to constantly ask for papers. Please, customers pay attention to Gehan Homes preferred lender - Brook Hollow MortgageThis company will twist anything to approve for the loan to make money from youThey cleverly play with numbers and eventually you will pay all there feesThey also get in to the system and broke your confidentiality by getting into your business. I am rejecting this response because:Hi Sir,Yes, it is been two years just because it is not been taken care of timely and satisfactorily like it is been more than a month already since this complaint and we are still communicating and this is how time elapsed. I don't know who I am getting response from but please get all the info from your staff including wisenbaker inspector (The last one)If you think I am wrong please deny on fixing cabinet issueThe inspector came last time told us that those chips from the door are because of construction. This is my first home and I learnt things that what I suppose to make sure or not but being genuine business you should not install the damaged cabinetsWarranty people will replace the screws which are coming out and can hurt someone after my complaint or it should be taken care before even I know.Yes, I have done comprehensive walk before signing the document but when *** agreed to fix any remaining item including cosmetic issuesComprehensive walk was just one hour before the closing, should I say no or take Builder's words that he will take care things that are not done.Let me tell you exactly what happened, I was not moving in the house until days after closing so I told *** please finish all the things that are undone, he told me I can't come in once you close but I will take care of the things under warranty, rest you can ask himLooks like I can write a book if I explain everything that I have been through in two years.So please come to the conclusion and let get over with it, We are spending more time then work.Regards,*** ***

I am rejecting this response because:As I have mentioned multiple times this is not wear and tear issue, this is the quality issue, I have not received the product that I paid for and not consistentNo one can find quality issue at the time of closing (for example: toilet seat, plumbing company changed without any question) and my sign off walk through was just one hour before closing (please confirm with builder, he agreed to fix any issue and that is why I signed)I have given two contracts with exactly same cabinet upgrade and anyone can tell the difference, I mean anyone.I am uploading another picture, the issue occurred yesterday, drawer front came off, this is the same drawer which replaced twice, I have no doubt now that I have been tricked or given wrong productplease don't tell this is wear and tear issue as usual.If this is the wear and tear than Gehan customers will have to start renovating house right after one year.Also, based on reply Gehan is not doing any research about my issue someone just replying with exactly same responseNo one is looking picture that I have sent earlier.Please do some research before replying again or send someone to my place I will show the issue and contract if necessary.Regards,

I am rejecting this response because: I believe that the practices of this company are deceptive and the salesperson was not clear about the fact that earnest money is not returnedI believe that the company would act in good faith to provide the customer with examples in the form of a model home or at the very least pictures of the standard options that come with a houseI understand that I signed the contract and regret that I did soI do not believe that this company has good customer service and that they disclose what you are signing at the time the contract is issuedI am considering whether to pursue this issue in small claims court to try to get my earnest money returned to meI'll be speaking with my lawyer to determine my next course of action

I am rejecting this response because: Gehan Homes should not offer options that they know little or nothing about I paid $for an option that is useless to me At the time of pre-drywall I couldn't of cared what side of the house the plug is on as long as it's on the same side of gas line Not only is it not on the gas line side, but it's right in front of the septic system which renders the plug useless Pool equipment can't be installed in location because septic system in way This plug was installed wrong on two fronts and now they want me to shell out more money to move a plug that was installed in wrong location to begin with Gehan Homes needs to be held accountable for their errors They had absolutely no response for me when they came out and saw the plug right in front of the septic system other than that they build homes and not pools, so they know little about where these plugs need to go Not resolved

Gehan Homes is not in the business of keeping Buyer's earnest deposits and would not retain a deposit if there wasn't an ethical and contractual reason to do soThere are some evident communication barriers and challenges that came up through the process that included communication that went
through the Buyer's realtorIt was clear that the timing and accuracy of the information being conveyed from the Realtor did not always line up creating frustration for both the Buyer and Gehan HomesAll concerns that the Buyer had on the home were satisfiedWhen the Buyer walked the house again the "crooked" wall was exactly that same as it was when it was walked originallyOriginal walk was over hours with one of Gehan Homes best buildersEven though the wall concern came up much later in the process it was immediately agreed by Gehan Homes to have the concerned areas fixedWhen the appraisal came back low, Gehan Homes agreed to lower the price of the home which discounted the already discounted price another $11,The original negotiation included higher closing costs because the Buyer had a very specific amount of funds that they could bring to closingWhen Gehan agreed to lower the price of the home, which we were not contractually obligated to do, we did so with expressed understanding that we could not still pay the $in closing costsThe communication from Brook Hollow Mortgage was to look for any and all options possible to close the home without the buyer having to bring in any additional fundsA call was made to the Realtor to discuss the situation by both the Sales Counselor and the Lender to which the Realtor originally volunteered 1% of her commission to assistShe was not asked to do soShe later backed out of this offering which was why *** *** had re-brought it up againThe Sales Counselor who is being accused of not caring was the first one to say she was willing to give 100% of her commission to help the buyers so they would not lose their homeThe lender also gave funds to contribute to the closing as well as Gehan HomesThe buyer ended up with a home at approximately $11,less, with no additional out of pocket and chose to not closeThis loan was not an easy loan because of income historyThe conditions that were set up front were done so based upon what the original underwriter would acceptThe loan officer went back and fought for an exception on the income during the process that she later got approvedThis enabled the buyer to move forward and to be fully qualified even with their existing property not being leasedThis was looked at as a trick instead of the reality of what it was; the lender and Gehan Homes doing everything possible close this loan and get the buyer into their homeWe elected to discontinue communication with the realtor because it became very clear that she was not conveying all relevant information which extended the communication disparityGehan Homes is not a perfect company which was expressed directly to the buyer in personHowever, we honor our commitments and abide by the contracts that are agreed to with our buyersGehan Homes has lost much more the $that is being retainedThe expectation had been set with the buyer and the realtor from the beginning that all deposits were non-refundableThe buyer was qualifiedAll items of concern with the home were satisfiedThe terms of the contract only improved financially for the buyer because the price was reduced and they were bringing the same amount to closeThe buyer chose to break the contract and the realtor chose to lead the buyer to put more money down on another home while they were still under contract with a Gehan HomeGehan honored the buyers decision to cancel but we are holding to the terms of the agreement and retaining the deposit of $If the buyer chooses to move forward on a different Gehan Home within the calendar year, the $deposit will be credited to the new purchase and buyers realtor will be compensatedNo other terms will be agreed to

Gehan Homes is always striving to make the construction process as smooth as possible, and when miscommunication or mistakes happen we look to correct those quickly and fairly for our future homeowners. Gehan Homes regrets any construction or communication setbacks that have occurred with Mr
***, however Gehan made quick and fair corrections and concessions that Mr*** agreed upon and decided to move forward with the build of his home. Gehan Homes has corrected any issues that have occurred and are offering to refund more than what is required by the contract that Mr*** agreed to and signed. Gehan feels we are being more than fair with what we are offering

definitive Gehan Homes readily admits that we are not a perfect company because we are run by a team of humansIn the course of process it is not out of the norm for someone to make a mistake via communication or execution Our promise and guarantee to all of our customers is that we will always hold to the terms of the agreement, and if we make a mistake we will always do what’s right according to the terms of the agreementThe case with the ***’s has been no exceptionThe information below describes additional events and Gehan Homes attempt to resolve the concerns that the ***’s had which ended in their decision to terminate the contractual agreement outside of the terms of that agreement:The ***’s started the sales process before the model was complete in Afton Oaks Because of getting the opportunity to be the first buyers, the ***’s did not completely understand the details of Afton Oaks which is to validate that some of what the ***’s are saying is trueThey were not given 100% correct information up front They were assigned a new Sales Counselor who took over and made it a point along with the Construction Manager to clarify all details of what the ***'s purchased and what would be included in their home and community The only item that was not 100% clear was the sidewalks in the community which was told to the ***'s because Gehan Homes was waiting to hear from the developer on how they intended to proceed. The beginning of the process with the ***'s was not acceptable to Gehan Homes so the Buyer was offered $5,toward free options to reconcile the experience and move forward, which the ***’s acceptedThis is confirmed and documented in writing per an addendum to the purchase contract signed by the buyersTheir designated Sales Counselor made it a point to insure that all information moving forward was clear including ***'s chosen lot location and conditions According to the Sales Counselor, the only delay in communication was on sidewalks because he was also waiting on clarityThe buyers other quality of construction concerns were not justified and explained to them in detailThe Sales Counselor stated that the ***'s had found another home with a competitor after the resolution had taken place and $5,was acceptedWhen they told the Sales Counselor that they were looking to cancel their contract, the Sales Counselor reminded the ***'s that cancelling would result in the loss of their deposit money ***'s were not pleased with the information and told him that that they had been misrepresented on what the lot conditions wereThe Sales Counselor clarified that this was not the case and reminded the ***'s that they had met on the lot with the Sales Counselor and the Construction Manager to explain the drainage and affirmed that their home was not in a flood plain as referenced by the plat map and lot boundariesThe Sales Counselor confirmed that there was an appropriate resolution worked out between the Construction Manager, himself, and the ***'s on each of the concerns that were mentioned The process with the Gehan team members, mainly one individual, and the ***'s did not start off idealChanges and concessions were made including giving the ***'s a new sales person and $5,in new features for their homeThe intensity of the ***'s accusations about Gehan Homes came when they found another home that they decided they wanted to purchase and were reminded of the terms of the Sales AgreementThe ***'s home was well into the construction process and Gehan Homes had spent tens of thousands already in construction costs In addition, the home was being built with the ***’s specific options in them that were not what Gehan Homes would have selected to sell if we had started the home as a spec In order to reduce financial losses as much as possible, Gehan Homes had to make modifications to options which caused construction delays that cost the company in addition to having to discount the homes thousands of dollars in order to get it sold to a much more limited market. The deposits retained by Gehan Homes were based upon the terms of the Sales Agreement which the ***’s signed and that would hold up in a court of law or arbitrationTheir concerns were not only dealt with but the buyer was monetarily compensated due to the upfront “experience” and the ***’s accepted the good faith and reconciliatory offer Gehan Homes has chosen not to pursue further legal action due to the losses that are not covered by the retained Buyer Deposits which we are well within the company’s rights under the contractual terms of “Liquidated Damages.”The team at Gehan made multiple efforts to communicate with the ***’s, set very complete and detailed expectations, and attempted to move forward as agreedThey responded with threats of slander, making the company out as if it was purposefully taking advantage of the buyer We wish that the circumstances had turned out differently and that the ***’s would have moved forward as agreedUnfortunately, there is no other action that we will be able to take moving forward.Please feel free to contact me directly with any necessary clarification questions.Thank you, *** ***

I am rejecting this response because:As I mentioned earlier in my initial complaint and multiple times in my replies, cabinets are not what I ordered.yes, cabinet experiences wear and tear but does not change color, even if changes the color over the time, I believe, just two three doors would not change the color entirely(attaching the picture again and try to look closely anyone can tell this doors are different)Also, my complaint is not taken care of within warranty period either by not communicating or not taking action, that is the reason I am out of warranty period, you should ask your warranty department and verify that how long I have been complaining about tiles and cabinet issues.I have been told that tile guy should start working on replacing but I have not heard anything yet (This is how time elapses)Three months since this complaint and no action has taken to resolve the issue, you are just replying after more than a weekNo body from Gehan communicating.There are phase-and phathe same community due for warranty and I am hearing the issues of dealing with gehanI think they should know that Revdex.com is the only way to get the response duly but may not get issues resolved though, this is ridiculousAttaching picture which you already should have looked and understand what I meant
