we will schedule a time to fix the items, any items that are excluded from coverage will be explained to Mr*** and shown to him in the Home of Texas warranty booklet? I have also attached Mr***’s previous warranty tickets that had been completed and signed off by the homeowner? Please contact me if you have any other questions, thank you?

pricing of upgrades at the Design Center and has chosen to terminate her
purchase agreement.? The earnest money requirements and standard features of the
community are documented and signed by the customer as part of the
purchase
agreement? Earnest money is refundable only in the event the buyer
performs according to the contract and cannot secure a loan qualification, or
in the event that the seller defaults.? Since neither of these situations existed, Gehan Homes
acted in good faith and began the process of preparing the home for start of
construction; the earnest money will be retained by Gehan Homes according to
the contract

I am rejecting this response because: The bottom line is this:  Pool outlet in front of septic system, therefore can't be used.  So either pool outlet installed in wrong location or septic system installed in wrong location.  I have been asking Gehan to produce a document that shows me signing off on location, but they have yet to produce such a document.

HOA, through its members, to evaluate and decide upon the installation of an owners only access gate. With regard to the appraisal (a copy of the referenced appraisal has been attached), please understand that independent licensed appraisers in the State of Texas are a third party entity which have no affiliation to Gehan Homes. The particular appraisal referenced, in 28 pages of documents has a single one word reference to a gated community in a general overview of the community, which is obviously an oversight on the appraisal company's (Residential Appraisal Specialists) part. Nowhere else in the report was it mentioned, nor was it referenced in the comparisons and evaluations in calculating the market value of the residence in question. If the customer would like further information, I would urge them to contact Residential Appraisal Specialists directly. I believe their contact information is in the report. Again, we appreciate the inquiry and hopefully this has shed some light on this topic. Thank you.

With regard to the appraisal, please understand that independent licensed appraisers in the State of Texas are a third party entity which have no affiliation to any business they are performing an appraisal on,including Gehan Homes. While not privy to the appraisal this customer is referencing, if it was so stated then that was an oversight on the appraisal company's part. We would urge them to contact the appraisal company directly. I am rejecting this response because: Gehan has not strived to make this process smooth. Gehan does not work quickly to repair their mistakes. They lied about closing date, Gehan would have set the incorrect brick on the entire house had I not brought that to their attention. In fact as of 5/7/17 they still had not removed the incorrect brick. On April 25, 2017 I was offered my whole refund of 12,945 by [redacted], when I called back May 1, 2017 to let him know I was not moving forward with the house all of a sudden the offer was not there. Gehan's lack of integrity and their business practice has been based on deceitful acts, lying to customers and withholding their money.

I am rejecting this response because:This response to our letter is so ridiculous! Information mentioned in response is not true. Gehan Homes is exactly in the business of keeping buyer’s earnest money. There was no communication barriers between realtor, us and Gehan Homes. [redacted] was playing his game on both sides. He was telling us that our realtor is giving us bad advise and at the same time was trying to push our realtor (by texting her) to sell his house. He was offering her bigger commissions on the next home she will sell from Gehan Homes. Gehan Homes mentioned in response that sales consultant was willing to give 100% of her commission towards our closing cost which is total lie. She was giving us $3,650 which is not 100%. Sales consultant was also pushing our realtor to sell her house, so she can get commissions, not someone else. On the end Gehan Homes blaming our realtor for everything which is not professional at all! [redacted] didn’t have guts to admit that his team in Alamo Ranch community messed up in the house and didn’t install correct items. I advise all buyers to check Selection Sheet on inventory home, or they will be short-cut and will pay for things that not in the house! This is how Gehan Homes make there money! Little-by-little they make thousands of dollars by lying! When you ask Gehan Homes to provide particular papers on the house to see what you are paying for, there answer will be: “This is an internal paperwork and not for buyers eyes. You shouldn’t have Selection Sheet in your hands.” Any other builder in town provides Selection Sheet with all details before you even think about signing contract. Obviously, this is not the case with Gehan Homes, you have to constantly ask for papers. Please, customers pay attention to Gehan Homes preferred lender - Brook Hollow Mortgage. This company will twist anything to approve for the loan to make money from you. They cleverly play with numbers and eventually you will pay all there fees. They also get in to the system and broke your confidentiality by getting into your business. That is true that Gehan Homes is long away from been perfect company. There response twisted all facts. Obviously, company not learning from previous mistakes (you can see 23 complains on Revdex.com site). Complains are pretty similar, all pointing to companies dishonesty. This response is unacceptable. I want Gehan Homes to take responsibility for there actions! I want my earnest money back! Why company thinks after all this disrespect from there employees I will be having business with them? I never going to build or buy inventory house from Gehan Homes, they stole my earnest money. I am ok to pay for honest customer service, in this case Gehan Homes, there employees wasn’t honest with us. It will be right for them to give us our money back.If I have an accent and I am an immigrant it doesn’t mean you have to take advantage of me!

Gehan Homes is always striving to make the construction process as smooth as possible, and when miscommunication or mistakes happen we look to correct those quickly and fairly for our future homeowners.  Gehan Homes regrets any construction or communication setbacks that have occurred with Mr....

[redacted], however Gehan  made quick and fair  corrections and concessions that Mr. [redacted] agreed upon and decided to move forward with the build of his home.  Gehan Homes has corrected any issues that have occurred and are offering to refund more than what is required by the contract that Mr. [redacted] agreed to and signed.  Gehan feels we are being more than fair with what we are offering.

We regret that Mr. [redacted] and Ms. [redacted] were not able to complete the purchase on the home. The home was to close prior to the end of April, but the purchaser was not prepared with approved financing and loan documents that are needed to close on a property.
In reference to their comment about...

the city permit, the home was complete and would have been prepared to close by 4/30. When we were informed that their loan was not ready, we opted not to install the appliances and get the last required inspection. This was done to protect the new equipment from damage; in no way delaying the closing on our end.
We worked with the buyers to allow them to close on the home in May and pay the applicable late fees as required by the sales contract they signed. It became clear on the 15th, the information we were receiving about their loan continued to be vague and/or erroneous. The decision was then made to terminate the sales contract and offer the home for sale.
We will be refunding all of the deposits paid by Mr. [redacted] and Ms. [redacted]. We welcome them to purchase another property from us provided they have confirmed financing in place that meet the contract requirements. We are in the process of processing their refund.

We contacted Ms. [redacted] and discussed the situation onWednesday 5/20.  There was apparently much misunderstanding involvingtheir chosen lender and realtor, but we were able to reach a mutual agreementabout the closing and the applicable fees. The [redacted]’ were able to moveforward with the purchase of the home and close escrow on the home this pastFriday.  I believe that all parties consider this matter resolvedsatisfactorily.
