I am rejecting this response because: I believe that the practices of this company are deceptive and the salesperson was not clear about the fact that earnest money is not returned. I believe that the company would act in good faith to provide the customer with examples in the form of a model home or at the very least pictures of the standard options that come with a house. I understand that I signed the contract and regret that I did so. I do not believe that this company has good customer service and that they disclose what you are signing at the time the contract is issued. I am considering whether to pursue this issue in small claims court to try to get my earnest money returned to me. I'll be speaking with my lawyer to determine my next course of action.

We do appreciate the customers input, but to reiterate all information used by an appraiser is collected through them. Gehan Homes  are not appraisers but are almost certain that an appraiser would not use features or conditions for a property that do not exist at the time of appraisal. And the community does not have a members only gate. Again, thank you for your inquiry.

We regret that our customer feels that the granite sample as shown is not the one that was used in the selection of the granite at the design center. That is why we are bringing the actual sample out to the home so that the customer can see the sample in person and confirm that is the same sample that is shown in the photo of the selections when they were chosen. I believe the meeting has been set up for 5:30 this afternoon. Thank you.

Thank you for your correspondence. Gehan Homes has beenin contact with the customer several times in an effort to resolve thisissue. Attached is the portion of the signed sales contract thatstipulates that differences in appraised values are not uncommon (due tooptions chosen, lot...

premiums,etc) and are the purchasersresponsibility for the difference. Attached are two emails from the DivisionPresident of Gehan Homes to the customers which ultimately included the offerof paying the discrepancy between the independent appraised value and the salesprice of the home. The customer rejected this offer and ultimately decided notto close on the home when it was scheduled to close. In an effort to resolvethis issue, Gehan Homes will extend the offer to pay the difference in theappraised value and the sales price, PLUS will contribute $1000 to towardstheir closing costs if they close in the next 10 business days (by 8/10/15). Ifthey choose to reject this offer, Gehan Homes will move forward with its rightsas contained in the signed contractual purchase agreement. Thank you

I am rejecting this response because: Dear Mr. [redacted],            Thank you for finally giving a response we have long awaited. We are sorry this communication needed to take place with the Revdex.com, but we began to run out of options as no one within the Gehan organization would respond. To date we still have not received any documentation in regards to our cancellation. We do not agree with some of your response and feel it is because you were given inaccurate information and would like to discuss things a little further in person to clarify any confusion. Would you be available to meet or at the very least discuss via phone?  Please contact us directly.

Complaint: [redacted]I am rejecting this response because: This answer is unacceptable. Hiding behind 'act of god' does not negate the duty and responsibility this company failed to adhere to. It is true that there was a heavier than usual rain in Buda on October 30th but this does not negate the fact that we complained and brought it to your attention multiple times about the inadequate drainage and nothing was done.
 
I applaud you for the sincere condolences you have expressed on this public forum as these were not the comments made to me on the phone. I was threatened, harassed, and belittled by several of your employees; namely [redacted], and [redacted].

As stated previously, any damages to the customer's home were a result of the flooding caused by massive rainfall amounts experienced in various locations throughout Hays County on October 30, 2015. It was no way caused by the addition, or no addition, of topsoil to a low spot in the yard. Gehan Homes regrets any damage caused by an act of god such as this, but is not in a position to address any issues caused by this incident. Gehan Homes will continue to address any warrantable issues not related to this flooding for the remainder of the warranty period. I am rejecting this response because:We feel that Gehan does not understand the gravity of this issue for the consumer. Gehan offered homes for purchase, indicated that by the completion of construction it would gate the community, and urged purchasers to utilize its lender. Homes purchased from Gehan utilizing Gehan's lender have appraisals stating the community is gated--a fact Gehan has previously recognized and we have supporting documentation confirming the statement.  Homes purchased through other means do not have the statement about the View being a "gated community."  As Gehan states, appraiser should not include information that they are unable to confirm. The appraiser could have only received that information from Gehan since there is no actual gate present.  We ask that Gehan perform as promised and put in the gate as indicated to the customers directly and as it influenced the appraiser to do. Indicating to the consumer and to the appraiser that the community would be gated and having no intent to gate the community is deceptive.

I am rejecting this response because:
While Mr. [redacted] was supposed to be an independent appraiser, he received his information about the gate from Gehan and delivered the appraiser to Gehan's financial company.  The language was in several appraisals within the community--not just ours--even a year later.  If the appraiser was truly independent, the language would not have repeated itself.  Providing funds to the HOA to determine whether or not we should have a gate is acceptable, but it is disheartening to hear that Gehan accepts no responsibility in the misinformation provided to the appraiser and to us as buyers. At least three other homes were sold with this information included. This feels deceptive and inconsistent with the values we thought Gehan stood on. We will file a complaint on the appraiser, too, we hoped Gehan would step up to the plate and honor the information they provided.

Good morning sir,Gehan Homes did (adequately) address my concerns.  That said I had to hire an independent contractor to modify some of their work.  I can send you the contractor's itemized bills and the amounts I had to pay if required.

Gehan Homes takes 100% responsibility for representations and mistakes that are made by Gehan Homes. It was not a mistake to offer the buyer an option that was made available for something that they wanted done after closing. The exact location of the electrical placed and signed off on by the buyer could have been presented to the pool expert prior to the home being dry-walled and Gehan would have gladly made the change. We are not responsible for the fact that more thorough communication did not take place to insure that the exact location needed for the pool company was accomplished. Gehan has contacted the electrician and gotten the price to move the electrical down to $200. The builder cant be expected to take all responsibility and the home owner take zero responsibility. To acknowledge "I dont care what I signed" doesn't change Gehan Homes position that this is what we are going by.

Gehan Homes will call the home owner and set up and inspection of the property in the next week. Upon inspection, we will create a plan to assist and/or correct the electrical. Gehan Homes stands behind it s work and if there is indeed a workmanship issue, especially one that compromises the...

buyers orientation meeting or the sign off meeting. Mr. [redacted] acknowledge that he did not and only learned that the plug wasn't in a good location once the pool company came out to discuss. Originally we did tell Mr. [redacted] that we could get him the electricians number and he could see what they would charge to move it for him. The price was going to be 300.00 to do the work, I called the electricians and asked them to reduce this to 200.00 to help Mr. [redacted] out which they did. At this point we feel we placed the plug in the location that Mr. [redacted] asked for and it was never an issue during the build and at sign off. I am rejecting this response because:The photo Gehan is trying to pass off as the Granite selection I made is false. They sent me the same photo and tried to tell me it was taken the day I made the selection and that it was the physical sample I chose. That is a lie. The time / date stamp photo on the photo they provide was dated 03/06/15. I was physically present in the design center to make my selections a month prior to when their photo was taken. Attached is the photo I took when I was at the design center with all of my kitchen selections. As you can see, the granite is vastly different from what Gehan is trying to pass off as my selection. I paid cash for this counter top and did not get it. Also attached is my signed and dated contract showing I was present and paid cash in February, not March as their picture alleges. I have never experienced such wretched customer service. Gehan is blatantly lying about the photos they took and it is unacceptable.

Mr. [redacted] contracted on [redacted] in Arcadia on November 25th. The contract was executed on November 28th. This home was offered and purchased at a $59,359 discount due to the agreement to close within 21 days of signing. This contract was also written non-contingent with the contractual...

understanding that if this contract is terminated for any reason, all deposits are non-refundable. This home was taken off the market for the [redacted]’s which has put Gehan Homes in the position of not being able to market the home in time to re-sell and replace the companies loss for this year. In addition, Gehan’s Sales Counselor did communicate with the buyer that if they decided to cancel they would lose their deposit and even offered an additional closing costs to assist the buyer with less out of pocket at the closing. The buyer declined the additional assistance and acknowledged that he understood that the terms of the contract would be upheld with the direct response that “its only one five though.” This was a reference to the $1500.Gehan Homes is willing to apply the Buyers deposit to another purchase but will not be refunding it. A copy of the cancellation will be re-sent to the buyer.[redacted]Division ManagerGehan Homes – San Antonio

definitive.  Gehan Homes readily admits that we are not a perfect company because we are run by a team of humans. In the course of process it is not out of the norm for someone to make a mistake via communication or execution.  Our promise and guarantee to all of our customers is that we will always hold to the terms of the agreement, and if we make a mistake we will always do what’s right according to the terms of the agreement. The case with the [redacted]’s has been no exception. The information below describes additional events and Gehan Homes attempt to resolve the concerns that the [redacted]’s had which ended in their decision to terminate the contractual agreement outside of the terms of that agreement:The [redacted]’s started the sales process before the model was complete in Afton Oaks.  Because of getting the opportunity to be the first buyers, the [redacted]’s did not completely understand the details of Afton Oaks which is to validate that some of what the [redacted]’s are saying is true. They were not given 100% correct information up front.  They were assigned a new Sales Counselor who took over and made it a point along with the Construction Manager to clarify all details of what the [redacted]'s purchased and what would be included in their home and community.  The only item that was not 100% clear was the sidewalks in the community which was told to the [redacted]'s because Gehan Homes was waiting to hear from the developer on how they intended to proceed. The beginning of the process with the [redacted]'s was not acceptable to Gehan Homes so the Buyer was offered $5,000 toward free options to reconcile the experience and move forward, which the [redacted]’s accepted. This is confirmed and documented in writing per an addendum to the purchase contract signed by the buyers. Their designated Sales Counselor made it a point to insure that all information moving forward was clear including [redacted]'s chosen lot location and conditions.  According to the Sales Counselor, the only delay in communication was on sidewalks because he was also waiting on clarity. The buyers other quality of construction concerns were not justified and explained to them in detail. The Sales Counselor stated that the [redacted]'s had found another home with a competitor after the resolution had taken place and $5,000 was accepted. When they told the Sales Counselor that they were looking to cancel their contract, the Sales Counselor reminded the [redacted]'s that cancelling would result in the loss of their deposit money.  [redacted]'s were not pleased with the information and told him that that they had been misrepresented on what the lot conditions were. The Sales Counselor clarified that this was not the case and reminded the [redacted]'s that they had met on the lot with the Sales Counselor and the Construction Manager to explain the drainage and affirmed that their home was not in a flood plain as referenced by the plat map and lot boundaries. The Sales Counselor confirmed that there was an appropriate resolution worked out between the Construction Manager, himself, and the [redacted]'s on each of the concerns that were mentioned.  The process with the Gehan team members, mainly one individual, and the [redacted]'s did not start off ideal. Changes and concessions were made including giving the [redacted]'s a new sales person and $5,000 in new features for their home. The intensity of the [redacted]'s accusations about Gehan Homes came when they found another home that they decided they wanted to purchase and were reminded of the terms of the Sales Agreement. The [redacted]'s home was well into the construction process and Gehan Homes had spent tens of thousands already in construction costs.  In addition, the home was being built with the [redacted]’s specific options in them that were not what Gehan Homes would have selected to sell if we had started the home as a spec.  In order to reduce financial losses as much as possible, Gehan Homes had to make modifications to options which caused construction delays that cost the company in addition to having to discount the homes thousands of dollars in order to get it sold to a much more limited market. The deposits retained by Gehan Homes were based upon the terms of the Sales Agreement which the [redacted]’s signed and that would hold up in a court of law or arbitration. Their concerns were not only dealt with but the buyer was monetarily compensated due to the upfront “experience” and the [redacted]’s accepted the good faith and reconciliatory offer.  Gehan Homes has chosen not to pursue further legal action due to the losses that are not covered by the retained Buyer Deposits which we are well within the company’s rights under the contractual terms of “Liquidated Damages.”The team at Gehan made multiple efforts to communicate with the [redacted]’s, set very complete and detailed expectations, and attempted to move forward as agreed. They responded with threats of slander, making the company out as if it was purposefully taking advantage of the buyer.  We wish that the circumstances had turned out differently and that the [redacted]’s would have moved forward as agreed.
