I spoke with Mr*** and listen to his concernI explained that there wasn't anything we could do at this point, I reminded him that he signed the plans (attached) showing where he wanted the pool plugI ask him if he brought up the concern during the pre-sheetrock meeting, the initial
buyers orientation meeting or the sign off meetingMr*** acknowledge that he did not and only learned that the plug wasn't in a good location once the pool company came out to discussOriginally we did tell Mr*** that we could get him the electricians number and he could see what they would charge to move it for himThe price was going to be to do the work, I called the electricians and asked them to reduce this to to help Mr*** out which they didAt this point we feel we placed the plug in the location that Mr*** asked for and it was never an issue during the build and at sign offPlease contact us if you have any other questions or concerns.Thank you

I am rejecting this response because:As I have mentioned multiple times this is not wear and tear issue, this is the quality issue, I have not received the product that I paid for and not consistentNo one can find quality issue at the time of closing (for example: toilet seat, plumbing company changed without any question) and my sign off walk through was just one hour before closing (please confirm with builder, he agreed to fix any issue and that is why I signed)I have given two contracts with exactly same cabinet upgrade and anyone can tell the difference, I mean anyone.I am uploading another picture, the issue occurred yesterday, drawer front came off, this is the same drawer which replaced twice, I have no doubt now that I have been tricked or given wrong productplease don't tell this is wear and tear issue as usualIf this is the wear and tear than Gehan customers will have to start renovating house right after one year.Also, based on reply Gehan is not doing any research about my issue someone just replying with exactly same responseNo one is looking picture that I have sent earlierPlease do some research before replying again or send someone to my place I will show the issue and contract if necessary

Gehan Homes takes 100% responsibility for representations and mistakes that are made by Gehan HomesIt was not a mistake to offer the buyer an option that was made available for something that they wanted done after closingThe exact location of the electrical placed and signed off on by the buyer could have been presented to the pool expert prior to the home being dry-walled and Gehan would have gladly made the changeWe are not responsible for the fact that more thorough communication did not take place to insure that the exact location needed for the pool company was accomplishedGehan has contacted the electrician and gotten the price to move the electrical down to $The builder cant be expected to take all responsibility and the home owner take zero responsibilityTo acknowledge "I dont care what I signed" doesn't change Gehan Homes position that this is what we are going by

As mentioned previous the cabinets items ? are not covered under warrantyWe will not be making any additional adjustment at this timeFor the cracked tile this is also not covered under the warrantyAs a courtesy though we agreed to replace the cracked tile in the spirit of goodwillThe tile company has a extreamely close color match, we are just waiting on your confirmation? from you to move forward with the color and courtesy fixThank You Sir.?

Gehan Homes will contact Mrs*** today, 6/28,? to review any outstanding items and set a time to do any necessary repairs covered under the Gehan Homes and Home of Texas Warranty.?

Gehan Homes is not in the business of keeping Buyer's earnest deposits and would not retain a deposit if there wasn't an ethical and contractual reason to do soThere are some evident communication barriers and challenges that came up through the process that included communication that went
through the Buyer's realtorIt was clear that the timing and accuracy of the information being conveyed from the Realtor did not always line up creating frustration for both the Buyer and Gehan HomesAll concerns that the Buyer had on the home were satisfiedWhen the Buyer walked the house again the "crooked" wall was exactly that same as it was when it was walked originallyOriginal walk was over hours with one of Gehan Homes best buildersEven though the wall concern came up much later in the process it was immediately agreed by Gehan Homes to have the concerned areas fixedWhen the appraisal came back low, Gehan Homes agreed to lower the price of the home which discounted the already discounted price another $11,The original negotiation included higher closing costs because the Buyer had a very specific amount of funds that they could bring to closingWhen Gehan agreed to lower the price of the home, which we were not contractually obligated to do, we did so with expressed understanding that we could not still pay the $in closing costsThe communication from Brook Hollow Mortgage was to look for any and all options possible to close the home without the buyer having to bring in any additional fundsA call was made to the Realtor to discuss the situation by both the Sales Counselor and the Lender to which the Realtor originally volunteered 1% of her commission to assistShe was not asked to do soShe later backed out of this offering which was why *** *** had re-brought it up againThe Sales Counselor who is being accused of not caring was the first one to say she was willing to give 100% of her commission to help the buyers so they would not lose their homeThe lender also gave funds to contribute to the closing as well as Gehan HomesThe buyer ended up with a home at approximately $11,less, with no additional out of pocket and? chose to not closeThis loan was not an easy loan because of income historyThe conditions that were set up front were done so based upon what the original underwriter would acceptThe loan officer went back and fought for an exception on the income during the process that she later got approvedThis enabled the buyer to move forward and to be fully qualified even with their existing property not being leasedThis was looked at as a trick instead of the reality of what it was; the lender and Gehan Homes doing everything possible close this loan and get the buyer into their homeWe elected to discontinue communication with the realtor because it became very clear that she was not conveying all relevant information which extended the communication disparityGehan Homes is not a perfect company which was expressed directly to the buyer in personHowever, we honor our commitments and abide by the contracts that are agreed to with our buyersGehan Homes has lost much more the $that is being retainedThe expectation had been set with the buyer and the realtor from the beginning that all deposits were non-refundableThe buyer was qualifiedAll items of concern with the home were satisfiedThe terms of the contract only improved financially for the buyer because the price was reduced and they were bringing the same amount to closeThe buyer chose to break the contract and the realtor chose to lead the buyer to put more money down on another home while they were still under contract with a Gehan HomeGehan honored the buyers decision to cancel but we are holding to the terms of the agreement and retaining the deposit of $If the buyer chooses to move forward on a different Gehan Home within the calendar year, the $deposit will be credited to the new purchase and buyers realtor will be compensatedNo other terms will be agreed to

As stated in Mr***’s email, Gehan Homes addressed his concerns and has signed off that the work was completed to his satisfaction as I included in the last email? Please let me know if you need copies of those againAs stated in Gehan Homes warranty; ? “ Any cost incurred for hiring outside contractors or non-original contractors without written approval from Gehan Homes will not be covered under Gehan Homes warranty.” ? It is Gehan Homes understanding that we have one cabinet drawer face left to replace with Mr*** and have attempted to schedule with Mr*** but he has rescheduled with us three different times? We are happy to install the new cabinet face at Mr***’s convenience but consider all other items complete and closed? Please let me know if you need any other information? Thank you for your help? *** ***

I am rejecting this response because:Hi,I totally understand that after years warranty does not cover.I have explained this many times but let me do that again.My final walk through was just one hour before the closing the house, When I complaint about these issues (Cosmetic, cleaning? ) *** (my builder) told me that don't worry we will take care of anything since you have days and year warrantyI had to pay for cleaning before I moved in to my house (I suppose to receive clean house)*** washed my garage floor and driveway after I signed off and when I went for closing.On days ***? said he can't do any cosmetic issues so I had to contact Warranty department? and they sent Adonay to take care of days warranty issuesFor cabinets and tiles he suggested to wait until months but for months another person (Ron) came to take care warranty issuesRon also stopped responding so I had to email and make phone calls to warranty department againThen, *** started communicating, since then we are going back and forth without any resolution.I can provide emails of communication? or *** can too if you have any doubt.Builder? installed broken cabinet over vent hood, I would never know until Jared (area manager) visited and when we ask why it is misalignedHe said it was broken while installingI am not getting why would you install broken cabinet.My point is, this is not after two years issue, this is from beginningThe only reason it is been this long is because it is not being taken care in first place
