Complaint: I am rejecting this response because: that is not my IP address for any device I own The signature on the terminal addendum is not my signature and was forged by the personnel at MAS I have side by side proof of my actual signature on a document I sent them and the one they claim is my signature Also, when I requested the original contract I e-signed, Courtney delayed sending it to me so I contacted a different customer service representative within the company and was sent the contract that stated my termination fees are $ When I told Courtney I got a copy of my contract she claimed they hadn't completed it yet The form is Adobe and a fillable document with a typed e-signature that can be placed on the form at anytime they need it to fit their needs The date was inaccurate on both the contract and the terminal addendum, as well I was never informed of a $fee, rather that's a new one, they claim I owe now I was belittled by [redacted] during my dealings with him I have emails of all of our conversations, as I'm sure he does as well Regards, [redacted]

On June 4, Mr [redacted] solicited Merchant Acccount Solutions and applied on our Mobile Application for the service in question, the account was approved and the hardware mentioned in the complaint detail was shipped, delivered and signed for by Mr [redacted] June 11th The complaint listed by Mr [redacted] states that he received an email from a representative listing out our offer, pricing and terms for his new account, chief amongst the details mentioned was that there is $ Monthly statement fee listed as part of the offer, in the latter portion of the same report Mr [redacted] states that he never agreed to monthly feesEither the context of the email was written incorrectly or the information provided outright contradicts itself Historically Merchant Account Solutions has firmly stood by all offers that are presented in writing from representatives but we were never provided such an email nor details explaining the offers the complaint detail is the first bit of information provided suggesting such emails, agreements or amended termsDespite the inaccuracies in the complaint it has been founded that Mr [redacted] s application was submitted to our company unsolicited through our Mobile web portal; in this application all details of our agreements and contracts are very clear, concise and requires acceptance by the applicant in each step of the process, the final step is a set of terms - this section provides all important details in regard to the pricing and structures for each respective applicationAll items listed in question via the complaint detail is available at that point and viewable prior to acceptance of the terms listed in our agreementsThere is full and complete disclosure included with all of our applications and this situation is no differentIn the interim Merchant Account Solutions has also founded that Mr [redacted] had separate accounts with Ipayment Incwhom is the underwriter and processor for the account in question as well as the processor for the aforementioned account ending in XXXXXXXXXXXXInexplicably on October 17, both accounts mentioned were shut down due to Security Risk Issues and Fraudulent Activity, this was not done at Merchant Account Solutions request but as a blanket closure for all accounts under the Ipayment IncumbrellaThe correlation of dates of this complaint as well as the dates of force closure one can only assume that we have not done anything wrong other than provide a service that was requested by Mr [redacted] and this is an effort to further engage in fraudulent activity In closing, the desired settlement requested by Mr [redacted] cannot be granted Merchant Account Solutions agrees to close the account with no Early Termination Fees as long as the equipment is returned in proper working order but there will be no refund of the monies requestedShuttle Serial Number 417***62Ref # 31957MAS Returns

Complaint: I am rejecting this response because:I was waiting to hear back from the company because I have yet to receive the card swiperSo basically its ok for customer service reps to lieNow I have to pay $a month for a year for a companyand I have yet to receive the card swiper and the contract that I supposed signed initially Regards, J [redacted]

In order to assist with this merchant concerns we have reviewed accounts notations and agreement Merchant was provided proper closing procedures on July 15, Which included all the correct paper work and return address for equipmentMerchant neglected to follow the procedures provided and only completed half of the procedures that were highlighted in the email with the proceduresMerchant was advised on numerous occasions that the email provided with the procedures needed to completed in order to process closureMerchant neglect to complete procedures is not Merchant Account Solutions responsibility Unfortunately merchant's desired resolutions cannot be granted, there is a signed month agreement on file that is available upon request to the merchant ###-###-####All fees and termination fees are valid per merchant agreementAccount was closed on December 4th, after receiving equipment along with closure form as requested in the closing proceduresAccount is scheduled to be billed their termination fees with the next business days

As previously stated Merchant Account Solutions has waived 1($350) of termination fees as a courtesy to the merchant not understanding the terms and conditions provided(online application and hard copy mailed) for services they requested, we provided and merchant installedAny other fees are valid per agreement providedMerchant requested services, provided all information for merchant application including but not limited to personal information such as social security number and bank account information and proceeded to sign agreement online, digital signature captured is embedded with IP address previously providedDates provided on agreements are the dates the agreements commenced (when account was assigned a merchant ID and associated account numbers)

On June 8, merchant submitted the case below and was advised to return equipment and termination fees will be waived(See text in RED below)Equipment was received via USPS [redacted] on June 16th and was processed for closure on June 26th with no termination feesAny fees accrued for the month of June are valid as again per previous response "This case is in reference to Merchant's equipment was received on June 16th, and the account is currently in process of closure, account cancellation may take up to days depending on the billing scheduleMerchant is responsible for June Fees as account was active for the month of JunePlease be advised that we bill back, merchant will be billed for June fees in the beginning of July but will no longer accrue fees after that" To summarize equipment has been received and account has been closed with no termination fees ($645) and 96% of financial responsibility of a year agreement have been releasedNo refunds will be processed as services were requested, provided, installed and used Complaint Detail I recently downloaded an app on my phone to use a card swiperIt wasn't anything that I desperately needed I just thought it would be nice to havethe app that I downloaded was called Smart SwipeThe application asked me to provide my information so that it would be possible for me to hook up the swiper and make transactions to my bank accountshortly after setting up the application I received a call from merchant solutionsthey told me that they took care of smart swipe and they asked me if I had downloaded the smart swipe app and if I was ready to use it and of course I replied yes and asked how much it would cost to make a transaction they told me that it was a 2% fee to processafter weeks I received another swiper in the mail and a piece of metal with my business name and my address on iti was not sure why I had received the equipment because I already had the desired equipmentafter a month of Merchant Account Solutions having my information they sent me bill that they had charged my bank account with a fee of after seeing the bill I was in shocknote: (I had not yet made a transaction using the smart swipe)i called Merchant Account Solutions and they proceeded to tell me that I owed them a monthly fee if I used it or notWhen I put my information in the app I signed absolutely nothing that agreed to a monthly feeAfter deciding that the best thing to do would be to just shut my account off I was told by the deactivation manager that in order for me to deactivate my account I owed them dollars for ending my contract early when I did not sign up for onei have never signed anything from this business and if a box was checked while setting up the app I was not aware of what they were doingi could understand a fee if the product was being used but I have not used it for anythingi asked if they would please waive the fee for I did not need there services and I was told they would notProduct_Or_Service: card swiper Desired Settlement DesiredSettlementID: Refund I wish to be refunded 100% for what the company has charged meI have not used the Card swiper or any other services through Merchant Account Solutions and I also wish to deactivate my account and remove me from any contract I'm in with NO CHARGEI also want my information kept private and not sold.Desired Settlement: Other (requires explanation)

On 7/28/at 4:PM PST merchant downloaded our Mobile Application Smartswipe, and applied and completed application on 7/28/at 4:pm PST for the services in question without speaking with a representativeMobile App requests pertinent information to be entered in prior to application submission, these steps include but are not limited to Business Name Principal Owner NameFederal Tax ID #Social Security Number Expected Processing Volume Checking Account Number Bank Routing Number Our application process is very clear, concise and requires acceptance by the applicant in each step of the process, the final step is a set of terms, this section provides all important details in regard to the terms, conditions, pricing and structures for each respective applicationAll items listed in question via the complaint detail is available at that point and view-able prior to acceptance of the terms listed in our agreementsThere is full and complete disclosure included with all of our applicationsApplication was signed with digital signature that has the following IP address embedded Different agreements are based on the program selected, merchant selected to process via their mobile devices and were provided with the terms for service requestedServices were requested, provided, installed and actively usedThe larger portion of the termination fee has already been waived, merchant is responsible for second portion of termination fees as they did agree to services just neglected to read terms provided during initial application periodOnce equipment is received account will be closed with in business days, any fees leading up to termination are valid Please be sure to read and have a full understanding of any terms and conditions in the future before blindly agreeing to services being requested and then experiencing buyers remorse as this costs the company that is being accused for providing a service that was indeed requested

We were able to locate merchant account information by other means but not by the information that was provided to the Revdex.comWe have received the equipment in good and working condition as a courtesy the account is now closed June 16, and termination fees of $dollars were waived and they were released of 94.44% of the financial responsibility of the year agreement the merchant agreed to via digital signature which was embedded with their IP address [redacted] Merchant was also mailed a welcome packet with all the programs guides and termsNo refunds will be processed as service were requested, provided, installed and actively usedMerchant Account Solutions would like to advise business owner for the future to always read all terms and conditions provided to them and have full understanding before signing anything in order to avoid any misunderstandings for their business

In response to claim 10/21/ MrM [redacted] applied on our Mobile Application for his business on 5-27-at 10:AM, Merchant Account Solutions proceeded to fulfill the order as requested and setup the account with the information provided by MrM [redacted] within hours Per the complaint listed MrM [redacted] says he was never told about these terms, conditions and fees but this application was submitted to our portal unsolicited, it was an order placed through our Mobile app, all details of our agreements and contracts are very clear, concise and requires acceptance by the applicant in each step of the process, the final step is a set of terms, this section provides all important details in regard to the, pricing and structures for each respective applicationAll items listed in question via the complaint detail is available at that point and view-able prior to acceptance of the terms listed in our agreementsThere is full and complete disclosure included with all of our applications Despite the inaccuracies in the complaint I have records of MrM [redacted] contacting our Customer Service group to go over the monthly fees and minimums on 6-3-15, information was provided and no further questions were askedOn 6-18-Mr M [redacted] called again to go over the same information that was provided on 5-27-15, 6-3-and now again on 6-18-These same calls were also again fielded on 6-25-15, 7-2-and 7-6-to provide the same informationAfter the conversation on 7-6-a representative authorized a credit in the amount of $and lowered total monthly fees to total of $19.95, as long as Mr M [redacted] took the industry mandated PCI compliance scan the fees would remain at the agreed upon structure that was amended on 7-6-The paper statements that are delivered monthly to MrM***’s address explicitly list the PCI Compliance requirement these have been provided monthly ranging from the onset of the account until present dayOn 10-3-MrM [redacted] also contacted our Customer Service group to check on the status of his PCI compliance scan in which he was informed that he is now PCI compliantThe fees are now as suggested during the 7-6-conversation In closing, the desired settlement requested by MrM***, Merchant Account Solutions agrees to close the account with no Early Termination Fees as long as the equipment is returned in proper working order, once equipment is received and tested account will be closedNo refunds, as services were requested and providedAny fees leading up to account closure are validMAS ReturnsREF#
