After downloading and installing mobile application which states in order to use Smartswipe application you must apply for a merchant account and directs them to our Merchant Processing Agreement. Within that agreement any and all service fees, terms and conditions  were available for the merchant to read through, agree to and email PDF copies to retain. Merchant proceeded to enter all of their business information and business owners information and agreed to the terms via digital signature embedded with their IP Address 70.198.132.250 and had not spoken to any representative. Merchant Processing Agreement was approved and issued an account number and Shuttle credit card reader SN: 502[redacted]468. On March 25th, 2015 one of our in house technician reached out to the merchant to provide Smartswipe logins and to assist with installation and merchant complete a $0.03 test transaction. Merchant never inquired about pricing or to have agreement explained with any representative, as a company we received a completed agreement which stated merchant understood pricing that was listed. 
As a courtesy to the merchant we can terminate the merchant agreement without penalties as long as merchant returns equipment(listed above) to the address below in good and working conditions. As far as monthly service fees already billed, merchant requested service to process credit cards for their business and was provided with service to do so and installed equipment, fees are valid.  Per our Privacy Policy and Card Network Policy no merchant information will be shared or sold outside of our company and its affiliates.

I signed up for Merchant Account Solutions through a referral from a friend. Every person I have talked with from this company has been very pleasant to deal with. I ran into an issue with a customer who requested a refund on their purchase. I called the technician and was walked through this process quickly and easily. I am very happy with my decision to process credit cards through this company and would encourage others to do so.

On June 8, 2015 merchant submitted the case 10662358 below and was advised to return equipment and termination fees will be waived(See text in RED below). Equipment was received via USPS 9[redacted]481 on June 16th and was processed for closure on June 26th with no termination fees. Any fees accrued for the month of June are valid as again per previous response "This case is in reference to 10662358. Merchant's equipment was received on June 16th, 2015 and the account is currently in process of closure, account cancellation may take up to 30 days depending on the billing schedule. Merchant is responsible for June Fees as account was active for the month of June. Please be advised that we bill back, merchant will be billed for June fees in the beginning of July but will no longer accrue fees after that"
To summarize equipment has been received and account has been closed with no termination fees ($645) and 96% of financial responsibility of a 3 year agreement have been released. No refunds will be processed as services were requested, provided, installed and used. 
Complaint Detail 
I recently downloaded an app on my phone to use a card swiper. It wasn't anything that I desperately needed I just thought it would be nice to have. the app that I downloaded was called Smart Swipe. The application asked me to provide my information so that it would be possible for me to hook up the swiper and make transactions to my bank account. shortly after setting up the application I received a call from merchant solutions. they told me that they took care of smart swipe and they asked me if I had downloaded the smart swipe app and if I was ready to use it and of course I replied yes and asked how much it would cost to make a transaction they told me that it was a 2% fee to process. after 2 weeks I received another swiper in the mail and a piece of metal with my business name and my address on it. I was not sure why I had received the equipment because I already had the desired equipment. after a month of Merchant Account Solutions having my information they sent me bill that they had charged my bank account with a fee of 32.04. after seeing the bill I was in shock. note: (I had not yet made a transaction using the smart swipe). I called Merchant Account Solutions and they proceeded to tell me that I owed them a monthly fee if I used it or not. When I put my information in the app I signed absolutely nothing that agreed to a monthly fee. After deciding that the best thing to do would be to just shut my account off I was told by the deactivation manager that in order for me to deactivate my account I owed them 500 dollars for ending my contract early when I did not sign up for one. I have never signed anything from this business and if a box was checked while setting up the app I was not aware of what they were doing. I could understand a fee if the product was being used but I have not used it for anything. I asked if they would please waive the fee for I did not need there services and I was told they would not. I am rejecting this response because: I did not authorize or consent to the charges to my bank account and at no time was disclosed of this information that my account would be billed I signed up on an app on my iphone that said no monthly fees, Credit card Fees, Or...

cancellation Fees, I finished signing up for the account over the phone yet I was never informed of any information involving billing or that the routing numbers they collected would be billed. When I entered my routing numbers to the app it said the account WOULD NOT BE CHARGED that is was for deposits only. in 5 U.S.C. § 7001 : US Code - Section 7001: General rule of validity -

This company did not disclose the proper information by phone, paper letter, or email that the bank account on file was going to be charged, under consumer disclosure acts a company must provide these type of details in writing to a consumer or make knowable that billing is going to occur and get there consent. I never consented to any billing at any time and was never once informed I would be billed anything while the company had numerous chances to explain billing they did not.

I have sent for my account to be closed by fax the documents they requested for me to fill out. I have also sent the company emails that the fax was sent three times and to close my account.
At this time I am still asking for a refund for the two charges of 35.90 for a total of $71.80 Refunded to my bank of america account I will close this complaint and seek no further action if they agree to refund my money they stole.

downloaded the following mobile application "Credit Card Reader" which does not in anyway state "Square" or "Integrated Card Systems" it state Merchant Account Solutions on March 25, 2015 at 2:59 pm PST. After downloading mobile application merchant contacted the number on the mobile application###-###-#### and wanted to complete credit card reader activation and was connected to one of our representatives named Russell not "[redacted]". Merchant was advised both of our company names and that we are not affiliated with "Square", merchant still wished to continue with services and was emailed our Merchant Processing Application. Merchant completed application with all their business information, business owner information, how much they process in credit card and how they accept payments. Application was completed and all terms and conditions which had all fees associated with the services requested were agreed to via digital signature which is embedded with the merchants IP address 74.167.170.71. Merchant was contacted by our installation team to complete installation with a test transaction. Merchant then called in to have account cancelled on May 7th, 2015 stating they had not requested services was advised of contract and was provided with courtesy adjustment on existing contract to assist with merchant confusion and again explained the application process and services requested, merchant agreed to new service fees and contract length. Merchant states they have returned equipment, as of July 15th, 2015, equipment has not been received at our location. Agreements is available upon request, please call ###-###-#### Ext 124.
Merchant Account Solutions would like to advise business owner to read through any and all documentation provided to avoid confusion such as this. Merchant has been emailed proper closing procedures, please complete them to have account closed per desired resolution.

I am rejecting this response because:
I have proven to this company that the item was returned and received! Yet, I am still being charged. Nowhere in these responses do they state that I will continue to be charged until they FIND the received item! They stated that all charges would be waived once item was RECEIVED in which it was RECEIVED 25 days ago. I have proof it was received 25 days ago. I do NOT understand why it takes them 25 or more days to FIND an item. Yet they continue to say they don't have it, after I have proven it has been received. They want to keep charging me even though they have the returned item IN THE SAME PACKAGING IT WAS SENT TO ME IN! Please refer to attached photos of the receipt with tracking number, photo of item tracked and received by this company, AND the response that said they would waive all charges once item was RECEIVED not FOUND!

Merchant Account Solutions operates with worse than deceptive practices -- they flat out lie. They will charge fees and take money out of your bank account. When you question them, they will claim that it was in the contract you signed (it wasn't). They will continue to charge you monthly fees, until you decide to try to leave, when they will tell you that there is an early termination fee of $500+ (also not in the contract).
Best advice, don't give them any of your banking information. Get out before you get trapped. If you're already in, get out and change accounts.

Merchant was provided with a verbal quote that consisted of the monthly service fees and was directed to an online application that reflected the full pricing schedule for the program they requested. Merchant was advised to read through and complete application, they agreed to the terms via digital signature embedded with their IP address. As a courtesy for the merchant misunderstanding the terms and conditions provided for them to read on the online application they acknowledged completing, we will waive the agreement termination fees as long as the merchant returns the equipment provided EPN SN:[redacted]in good and working condition to the address below. I am rejecting this response because:  that is not my IP address for any device I own.  The signature on the terminal addendum is not my signature and was forged by the personnel at MAS.  I have side by side proof of my actual signature on a document I...

sent them and the one they claim is my signature.  Also, when I requested the original contract I e-signed, Courtney delayed sending it to me so I contacted a different customer service representative within the company and was sent the contract that stated my termination fees are $0.00.  When I told Courtney I got a copy of my contract she claimed they hadn't completed it yet.  The form is Adobe and a fillable document with a typed e-signature that can be placed on the form at anytime they need it to fit their needs.  The date was inaccurate on both the contract and the terminal addendum, as well.  I was never informed of a $295 fee, rather that's a new one, they claim I owe now.  I was belittled by [redacted] during my dealings with him.  I have emails of all of our conversations, as I'm sure he does as well.

11:38 AM – Mrs...

Mc[redacted] went into our Smartswipe Mobile Application,
downloaded and applied for the services in question. 12 times on dates ranging
from 8-16-15 to 10-2-15 messages as well as emails were sent in effort advise
of billing cycles and answer any possible questions that may arise. To no avail
calls were not returned and services remained intact and operational requested.
On October 20,
2015 Mrs Mc[redacted] contacted our office stating that she was not aware of the
account in question, after being notified of the terms of the agreement Mrs
Mc[redacted] stating she would like to close the account and avoid any termination
fees. The aforementioned representatives simply stated our standard operating
procedures and advised Mrs Mc[redacted] of the agreement that was requested.
In closing, the
desired settlement requested by Mrs Mc[redacted] Merchant Account Solutions agrees
to close the account with no Early Termination Fees in effort to keep good
standing with past, future and current businesses.

In order to address this merchant's concerns regarding their agreement with Merchant Account Solutions we have reviewed their account notations and communications. 
On December 31 they downloaded an application called Credit Card Reader available for...

free download via Google Play App Store. In order for the application to function with their mobile device they must apply to accept credit cards as form of payment for products and services they are selling for their business. The application has a contact us profile for a quote to request and they proceeded to complete. One of our account representative contacted them to complete a Merchant Processing Application which is available online. 
Merchant filled in their business information, business owners information and a detailed description of products and services sold, at the end of this application there were terms and conditions available for the merchant to read through and agree to via digital signature embedded with the following IP address 98.[redacted].211.1** which matches the address on our Merchant Agreement and on the contact information provided on this case. After agreeing to terms and conditions merchant has the ability to print out a retain a copy for their records. To address merchants desired resolutions and as a courtesy due to the misunderstanding of the agreement they signed we will cancel merchant agreement and waive any termination fees associated as long the merchant returns equipment provided EPN SN: 3[redacted] in good working condition to the address below. Unfortunately their monthly service fees are valid as merchant requested services and were provided also the merchant was not charged $70 worth of fees.
