 Agreement available upon request, call ###-###-#### Ext 124. Merchant stated they agreed to new agreement which indeed was done by the highest Manager(supervisory consultation) available to assist with the merchants confusion, merchant was not denied assistance. Monthly statements are mailed to merchants mailing address provided as well as they are provided with logins in their welcome packet which also has the terms and conditions for service requested to login to view their "bill". No one "threatened" to withdraw money from his account but was advised of the services he requested and would be "billed" for service rendered.
Merchant requested to accept credit cards as a form of payment for their Retail T-shirt business, with average monthly volume of $2,500.00 and an average ticket of $20.00, merchant failed to read initial agreement terms and has been adjusted as a courtesy of merchant misunderstanding. 
After reviewing this account communications and account notations. We don't understand where the merchant saw that they wouldn't be charged a monthly service fee as they were directed to our online application where all the fees associated to service requested were available to read through, understand and agree to. ALL documentation pertaining to the merchant agreement was provided upfront before the merchant signed up. Merchant completed application online and signed it digitally which is embedded with the merchant IP Address ##.##.###.###(see below) on March 11, 2015. Merchant was as a courtesy offered to lower monthly service fees and shortened agreement length to assist with their misunderstanding of the agreement by the Retention Manager available which is Anthony Herrera. Services were requested, provided and installed.  Merchant stated would continue service with new amended fees and length and even completed PCI questionnaire to reduce fees. Merchant Account Solutions has assisted the merchant to have a better understanding of the services requested and we provided. We do not record our calls without permission as it is violation and we hold the right to refuse to have our calls recorded as well per state and federal laws. Agreement available upon request, call ###-###-#### Ext 124. This case has already been dealt with outside of Revdex.com and we have completed all offers to amend the original agreement that the merchant did not understand.

Merchant acknowledges request of services were
requested. Several calls/emails were placed to verify merchant received login credentials
and instructions but no contact. We did not have contact with the merchant
until July, 2 months after signing up for service. Services were requested and
provided, merchant does have the ability to accept credit card as a form of
payment for their products and services they provide even without the
equipment. In closing the desired settlement requested is to have the account
closed. We will submit for account cancellation and as an additional courtesy
to their desired resolution, we will waive the early termination fees totaling $645.00.
 Merchant Account Solutions stands by its
services, products and terms listed in our fully disclosed and completely
transparent contracts at all times and while we feel that we have delivered the
services requested to the best of our ability, we will waive the termination
fee due to their misunderstanding of the terms provided. Any and all fees
leading up to account closure are valid as services were requested and provided.
No refunds will be processed for monthly services during active state of account
as it was in use. Merchant Account Solutions would like to advise merchant in their
future business ventures to always read and have full understanding of the
terms provided for services they are requesting to avoid confusion such as this.

February 14, 2015 at 3:19 PM PST merchant downloaded our Mobile Application

we feel that we have delivered the services requested to the best of our
ability, we will waive the termination fee due to their misunderstanding of the
terms provided any and all fees leading up to account closure are valid as
services were requested and provided. No refunds will be processed for monthly

requested is to have the account closed with no early termination fees which
will be completed at the end of the billing cycle (9/30/15). Fees refunded for
services rendered from May 2015 is declined as services were provided and proper
closing procedures provided were not completed. Merchant Account Solutions
would like to advise merchant in their future business ventures to always read
and have full understanding of the terms provided for services they are
requesting to avoid confusion such as this.

On 7/28/2015 at 4:38 PM PST merchant downloaded our Mobile Application Smartswipe, and applied and completed application on 7/28/15 at 4:43 pm PST for the services in question without speaking with a representative. Mobile App requests pertinent information to be entered in prior to application submission, these steps include but are not limited to

Different agreements are based on the program selected, merchant selected to process via their mobile devices and were provided with the terms for service requested. Services were requested, provided, installed and actively used. The larger portion of the termination fee has already been waived, merchant is responsible for second portion of termination fees as they did agree to services just neglected to read terms provided during initial application period. Once equipment is received account will be closed with in 5 business days, any fees leading up to termination are valid. 
Please be sure to read and have a full understanding of any terms and conditions in the future before blindly agreeing to services being requested and then experiencing buyers remorse as this costs the company that is being accused for providing a service that was indeed requested.

I am rejecting this response because:I was waiting to hear back from the company because I have yet to receive the card swiper. So basically its ok for customer service reps to lie. Now I have to pay $20 a month for a year for a company.... and I have yet to receive the card swiper and the contract that I supposed signed initially.

WAS I GIVEN A WEB ACCESS OR SENT CONTRACT?  WHAT IS THE DATE FOR THAT?
I NOTIFIED THE COMPANY WITH IN A WEEK THAT I DID NOT WANT THE SERVICE. 
I TALKED TO L[redacted] AND HE REFERRED ME TO THE COMPLAINT AND CLOSURE OFFICE.
I WAS NEVER ISSUED A CONTRACT OR TERMS OF THE AGREEMENT. I WAS NOT EVEN AWARE OF THE COST OF THE SERVICE UNTIL I ASK MR L[redacted] ON THE PHONE. THIS WAS BEFORE THE COMPANY EVEN STARTED TO CHARGE ME FOR THE SERVICE. THERE WAS NOTHING FOR ME TO READ, TO DECIDE IF I WANTED THIS SERVICE.

After some beginning miss-communications I was able to get my account set-up and have processing done over smart phones. Their second level support group is much better at dealing with customer concerns.

After reviewing this merchants
account, we unfortunately cannot assist the merchant with some of their
concerns as they are not the...

account holder/principal. We gathered the
following info to assist with clarification however merchant desired resolution
will not be granted.
Mr. Fernandez applied for service
for his business on April 13th, 2015 and has been actively
processing from the inception of the account, this account is good standing and
has an agreement in place. The second account was applied later the in the
month of April by a different business owner with different information. In no
way shape of form did we make a mistake and create 2 accounts with completely different
information.
Mr. Fernandez is referring to an
account that maybe associated to him via his partnership, however he is not on
the agreement we are not at liberty to provide full information. We will advise
the following:  This account has been closed
with no termination fee on the end of February’s 2016 billing cycle.

Overall great experience... They have helped every step of the way making our transition easy! Our last company was very hard to get help form and this has been the opposite. Thanks Merchant Account Solutions

I am rejecting this response because:
I'm strongly disagree with their response.   Prior to P[redacted] calling me from the month of February 2015 to July 2015 my company had a monthly average of $120 sales.  Why would I agree to work with a company that would take half of my sales in fees.  Your senior account representative NEVER took the time to advised or explained about monthly fees, early termination penalties, number of accounts, another account for processing by gateway, or length of contract.  When I finally got him on the phone he blatantly lied about our conversation that is why he said he would contact his manager to see about cancelling the contract with out any fees.  Which he never called back.  He committed fraud and I don't think your company should get anymore of my hard earn money for fraudulent contract.  I want all accounts closed immediately.

ALL items listed in the complaint detail are available at that point and view-able prior to the final acceptance of terms listed. There is a full and complete disclosure included with all of our applications. Cancellation procedures were provided as well as copies of their merchant agreement that had their digital signature embedded with their IP address 70.197.7.229 have been provided.
If the merchant chose to not read through terms provided and proceed to agree to them without having a full understanding Merchant Account Solutions offer stands to waive the larger portion of the termination fees($350) to assist with the merchant neglecting to read the terms.
In closing in order to assist the merchant in their confusion we will waive the larger portion of the termination fee of $350.00 and the merchant will be responsible for the remaining balance of $295.00 and any and all fees accrued and leading up to termination per the services requested and provided. Merchant Account Solutions stands by its services, products and terms listed in our fully disclosed and completely transparent contracts at all times and while we feel we have delivered services requested to the best of our ability. I am rejecting this response because:
It is the responsibility of the business to let me know that I am requI red to sign a contract. All he told me is that I need to check a box to confirm that my informatuon was accurate. Not once did he say that I am obligated to sign a contract. When I signed up for Direct TV, they told me I needed to sign a 24 mon the contract. That was the first thing the rep told me. When I signed up with Verizon the first thing the rep told me was that I had to sign a 2 year contarct. Any respectable business that is not trying to run a scam will tell you that. Maybe your business records conversations? Listen to mine a d you will see that I was mislead. I should not and will not pay a termination fee. All of needs to be waived.
