opportunity to respond. Upon receiving notification of Mr. [redacted]'s complaint, MRS conducted an investigation with regard to this matter. The investigation has found the following: Prior to this complaint being filed, our office has had no communication with this consumer, neither written nor verbal to address this dispute. Our office made 7 attempts to contact Mr. [redacted] at [redacted] which is provided in this complaint as a valid contact number, without success, and furthermore no return phone call from Mr. [redacted]. According to the FDCPA it is not required to provide the 809C Initial Demand Letter until verbal contact is made with a consumer, at which point it is then required to be sent within 5 days of the initial contact. Our internal policy, however, is to honor verbal & written validation/dispute requests any time a consumer is expressing such a claim. With that said, we have acknowledged this validation request, and have marked this account DISPUTE as of today's date, and will issue a request for validation documentation from our client. I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  They have agreed that the derogatory and misleading information they gave to both Experian and Equifax credit companies were false and in a fraudulent nature. Midwest Recovery Systems LLC claims in their statement to me that they will delete the negative record from my credit history but in the response letter from them, the Revdex.com is asking if I agree to the response or disagree.I am willing to agree to their response but I would like to wait until they have removed the negative information the my credit report. Just to make sure they are in good faith in their response to this matter.Is this at all possible....for me to wait for my response to the Revdex.com until Midwest Recovery Systems, LLC have done what they say they will do? It HAS been thirty days, and I have received no proof of validation of this account. This goes against my rights under the FCRA. I have never had any contact with this business. I never received any documentation for the said debt from "12 castle". I am entitled to all documents in regards to this debt before it is reported. my rights were infringed and this needs to be removed as it is not validated and fraudulent. I will contact the state attorney if this is not removed! I asked for documentation 8/1 and have not recieved anything as of 9/4. This company re reported to CRAs on 8/27/17 YET DIDNT PROVIDE ME PROOF OF VALIDITY BEFORE IT WAS RE REPORTED! I do not owe this company, never had a signed contract with them. this is on my credit report in violation of 15 U.S.C. § 1681. Black’s Law Dictionary, 9th Edition, 2009, defines “Verify” as, 1) "To prove to be true; to confirm or establish the truth or truthfulness of; to authenticate." 2) “To confirm or substantiate by oath or affidavit; to swear to the truth of." and “Verification” as, “Confirmation of correctness, truth or authenticity, by affidavit, oath, or deposition. Affidavit of truth of a matter stated and object of verification is to assure good faith in averments or statements of a party.” PLEASE REMOVE TRADE FROM ALL CRAs ASAP!

MRS has had multiple communications with this consumer. On the first communication (11/5/2014) Mr. [redacted] informed our company he had an attorney representing him named [redacted]. Our agent contacted the attorney, in which we contacted to find out she was not representing him in...

this matter. On 11/12/14 this consumer called back in to state he was requesting we send him a letter stating the balance, and once received he would pay the account in full. That notice was sent on 11/12/15 with no return mail being delivered to our company. We then had no communication with this consumer until 3/9/16 in which the consumer again requested a letter for the same purposes. The letter was resent on 3/9/16, and has yet to be returned as mail return. Then another contact on 3/16/16 in which the consumer stated he had never spoke with anyone at our office at any point & time. We have provided the letters the consumer has asked for, and also had promise of payment on this account prior to this complaint. Please contact our office to resolve this matter.
