The investigation has found the following: Our records indicate we have never had any communication with this consumer prior to this complaint. I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  My concern is them notating as fraud when it was a legit loan but paid on my part.  As long as this debt is trashed and never show back up on my report again I will be happy with this response and action.  I am just tired of continuously having to fight this as it is sold over and over.

Our internal policy is to honor both verbal, and written validation requests. The investigation has found the following: Prior to this complaint being filed, we received no communication from this consumer. We have made over 20 attempts to contact this consumer at [redacted] which was provided in this claim as a valid contact number. Our internal policy is to honor verbal & written fraud claims any time a consumer is expressing such a claim. With that said, we have acknowledged this as a fraud claim, and have marked this account FRAUD as of today's date. Our office will issue a credit bureau deletion record on the next batch submission file sent to the credit furnishers, and will make no further attempts to contact this consumer, nor collect upon this debt, and will immediately return this account to our client for internal review. Our office has attempted to contact this consumer at 903-401-6277, 10 times, since 02/16/2016, which according to this complaint is a valid contact number. We have had no return phones calls, nor have contact with anyone answering the phone when called. The consumer may not have received any notice...

because the initial demand notice was sent to [redacted] which was the address used at the time of enrollment with Six Flags. Our office did not receive any mail return on this item either. According to the FDCPA if the attempt is made to send a validation letter to the consumer in which it does not receive any return mail, it is not required to duplicate the letter unless verbal contact is made, at which point it is then required to be sent within 5 days on initial contact. Our internal policy is to honor verbal & written validation requests. With that said, we have marked this account DISPUTE, and will issue a request to our client to provide the initial enrollment contracts between [redacted] & Six Flags. Our office had our initial communication with [redacted], the consumers spouse, on 06/21/2016. At that time the consumers spouse acknowledged the debt, gave a full financial statement, i.e. Rent, bills going out every month, etc. Our agent then offered a settlement arrangement on the account in which the...

consumers spouse said he was going to review their finances to see if this arrangement was feasible. We then received a call the next day requesting our address and the unidentified male said they are getting a "proposal" together for us. On 06/24/2016 we received the certified letter from the consumer requesting validation of the debt. Our internal process is to honor verbal & written validation requests at the time of communication. This consumer never disputed the debt prior to the letter received on 06/24/2016. To address the accusations of breaking federal regulations, there is no spousal restriction in the state of Texas per the FDCPA guidelines. The consumers spouse identified himself, as well as the address/DOB of the consumer prior to our office speaking with him about the debt. Furthermore, per FDCPA our office legally has 30 days from the date of request to provide the validation documents requested. Our office has marked the account DISPUTE as of 06/28/2016, and the request for validation was submitted to our Client. Once the documentation is received those documents will be sent to the address provided within this complaint. If there are any questions please contact our office directly for further assistance.
