April 17, 2015Complaint ID: [redacted] We would like to acknowledge receipt of Ms [redacted] ***’ complaint and appreciate this opportunity to address itOur customers are sent their initial 30-day supply of NuvaLift to try for the first days without chargeOn the 15th day, if the customer has not contacted us, they are automatically billed for the product in their possession and enrolled in our NuvaLift Preferred Customer Club, where they receive a monthly supply every days thereafterNowhere on our website do we claim to offer a free sample, sample size, trial size, or free giftWe offer all customers a trial period to try our full sized productAt NuvaLift.com we do not hide our Terms and Conditions in small, unreadable text or behind a hyperlinkThey are disclosed directly on the ordering website at the bottom of the page in size font, and are also highlighted in a large white box on the second page where the customer inputs their credit card information (please see image on page 2)The customer has to click on “I agree to the Terms and Conditions” twice before the order is processedIf the customer does not “agree” to those terms, the order will not go throughThis customer began her trial period on 1/23/She was selected for a special extended trial, which ended on 2/17/Since we did not receive a request to cancel during that time, our system attempted to charge her for the product in her possessionThat charge was declined and our system attempted again, and on 3/2/15, the charge was approvedOn 4/1/15, she was sent a second product as a member of our Preferred Customer ClubWe received a call from the customer on 4/17/At this time, her account was cancelled and she was informed that because she was calling outside of the trial period, she was ineligible for a refundAs stated in our Terms and Conditions (see Section 2.2-b): “Your request for termination will be processed immediately; however, subject to Our refund policy You will be responsible for payment for any Product that has either (i) already been shipped to You or (ii) already been delivered to You at the time of Your call.”We apologize for any miscommunication that may have occurredAs a courtesy, we would like to offer a complimentary jar, which will be shipped out once we receive an email to [email protected] that a satisfactory resolution has been reachedCustomer satisfaction is very important to us, and we are continuously striving to streamline and perfect the quality of our serviceWe do stand by our policies and would like to reiterate that our customers accept the Terms and Conditions two separate times before the order is processedIt is also the customer’s responsibility to contact us within that trial period if they are not satisfied with our productSincerely, NuvaLift Management

This company should not be allowed to operate in California or any place elseThey run a well-engineered scam that really skirts being legitThey offer through online advertising (I came to them through a link on a Walgeens email, and took them to be legitimate) They offer a trial jar of face cream for $ I read everything carefully and still missed the "terms and conditions" which state that you will be charges $unless you cancel - but the terms and conditions are carefully buriedI was on the lookout for this kind of thing and still I missed itThe cream itself is terrible - smells like watered down cold cream and resulted in a breakoutThen I missed that we were being charged this outrageous sum for what was supposed to be a trial sample - because my husband pays the Visa billBy the time we caught it it was too late for a refundHow many people have fallen into this trap.? Even if you cannot shut them down, it would be a service to the public to pay them a little visit or analayze the crap they are trying to pass off as face cream

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Regards, Patricia [redacted] They say it is a day trial period The product was ordered on the of the month Received it on the of the month That allowed me to use it for days Not enough time to see if product would even work There was no information with the product about who to call or send it back to Did not know where to find any number Called the bank and they gave me the number The day I called them it was the 14th day I did not purchase the item until 9pm the day of the ninth I figured the day was 9pm on the I was not charged the 25, but on the business day of the 24th This kind of practice should not be allowed days in the USA means days not days That is not enough time to even try the product let alone send it back I have never dealt with a company like this before nor will I ever do this again Thank You The company Is a rip off and a M.F.B of a company and I have read that this is what they have done to many people This is a company that if I had a lot of money I would start a law suit and have all the other women join me in suing the companuy

I just have to say this is so misleading, shame on me for not reading the very very fine print! I've cancelled but will be paying for that little tiny jar! when I called to question the customer service rep was extremely rude! I don't think I have every been talked to so rudely before by a company! Shame on you Nuvalift, your product doesn't really work and you are scamming people!

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Regards, [redacted] Apparently this was a scam because I originally found this product posted in facebook, I clicked on it and sent off the the trial size cream for $shipping and handling, there was nothing there letting me know about you will have to cancel a subscription in days or you will be billed $dollars for a membership, my sister saw the same thing and I don't know what happened but this was not showing when I bought that product, now they want me to pay for something that is no use to meI got the cream and used it but that should have been the end of it because if I had seen a paragraph letting me know to cancel I would not have even ordered I just wanted to try the productI can read and clearly have and understanding about things but I was not aware of this type of advertisement at all and I refuse to pay these people for something I do not have, and I will also notifiy all credit bureaus as wellI am sorry about this mishap but to fight a person about $dollars for a membership and you get only a small one ounce box of cream that was paid for is CrazyI have already been refunded my money from my credit card and this company did not respond in the dispute with my credit card and I am satified, they cannot rebill the card either because of their neglect to respond in all of this

December 17, Complaint ID: [redacted] serif;">We would like to acknowledge receipt of Ms [redacted] ’ complaint, and appreciate this opportunity to address itOur customers are sent their initial full 30-day supply of NuvaLift to try for the first 14-days without chargeOn the 15th day, if the customer has not contacted us, they are automatically billed for the product in their possession and enrolled in our NuvaLift Preferred Customer Club, where they receive a monthly supply every days thereafterNowhere on our website do we claim to offer a free sample, sample size, or trial size, only a trial period to try our full sized productAt NuvaLift.com, we do not hide our Terms and Conditions in small, unreadable text or behind a hyperlinkThey are disclosed directly on the ordering website at the bottom of the page in size font, and are also highlighted in a large white box on the second page where the customer inputs their card information (please see image on page 2)The customer has to click “I agree to the Terms and Conditions” twice before the order is processedIf the customer does not “agree” to those terms, the order will not go throughThis customer began her trial on 11/11/14, and when we did not hear from her to cancel within that trial period, her account was charged for the product she had on 11/25/We have the trial period so that customers may test out of product to make sure they don’t have an allergic reaction or develop a rash, as this customer didWe were unaware of the situation until she called on 12/4/During this call, the customer was offered a refund of $42.44, which is half of the retail value of NuvaLiftThe Customer Support Representative was unable to offer more of a refund because the product was openThe customer denied this refund and requested to speak to a supervisorThe supervisor offered the customer a higher refund of $63.65, but the customer continued to request a full refund for an open product, which we are unable to giveThe product was never returned to us, so we have not yet processed the refundWe would like to apologize for the customer’s bad reaction to our product and restate that we do offer the trial product for precisely that reasonWe will also honor our offer of a $refund upon receiving an email from the customer at [email protected] that a resolution has been reachedCustomer satisfaction is very important to us, and we are continuously striving to streamline and perfect the quality of our serviceHowever, we do stand by our policies and would like to reiterate that our customers accept the Terms and Conditions two separate times before the order is processed Sincerely, NuvaLift Mangement
