I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.I would like for the organization to define the less discounted offer they are claimingI have reached out to the company to state on a previous call the representative assured me that the last payment to payoff would be updated and withdrawn from my account and that did not take placeI pleaded with Okinus and asked them to review the dialogue between the rep and IInstead, the rather not consider my customer organization relationship, and/or any previous transaction history even consider making a time exception perhaps to the representative providing a customer with expectationsWhat I would like for the company to do, is to reconsider the terms of days same as cash and retro back the date to the actual pay off and I will pay the balance in full and be done with Okinus and NEVER do business with a company that holds no integrityI asked them before escalating this with Revdex.com and they instead now are confirming me to call them directly and speak to them about some ghost offer I am seeklng a resolve and I hope you can help bridge the customer experience and business services issues I am reporting.

It is unfortunate that Mrs*** is not satisfied with OkinusOkinus strives on customer serviceThe reason that Mrs*** payoff changed as much as it did is Mrs*** requested payoffs on 9/12/13, Mrs***
made a lump sum payment on 10/29/(requested payoff after payment), 11/12/13, 12/4/13, December payment was revoked by customer (fees assessed for return), 1/12/These are the reason the payoff was changingMrs*** paid account off online on 1/19/
Mrs*** is correct Okinus has a lease contract, our contract is not deceiving (states LEASE in bold letters on 1st page of contract), the term lease is mentioned several times on both page and Okinus reports to Equifax to help build the credit for customers that need itAll of the fees are disclosed on contract as well

Ms*** with *** bank representative on the phone contacted Okinus on 4/16/and stated that wanted the bed picked up and the payment refunded due to bed bugs
Ms*** states that sent a “cancellation letter” stating the bed bugs and to have the bed picked upOkinus has not received a letter from Ms***; the only notice that was received in reference to bed bugs was on 4/16/when Ms*** contacted Okinus*** asked Ms*** if she had proof where sent the info to us, Ms*** stated that she had this information at home*** asked if Ms*** provided the docs that were mailed would we refund the April payment, Ms*** and *** were told Okinus was not able to refund any monies at this time but if could provide the information would submit for review

For your reference, details of the offer I reviewed appear below.I am not satified with the time constraints Okinus has providedA reply is provided to me hours from an authorized debit that is taking place on 5/27/Again, the issue I am having with this reduction offer is no time to make proper arrangments before the actual debit that is scheduled to take place on 5/277/when there was sufficient notice provided on 5/11/Revdex.com, please help bridge the communication and consumer challenges I am having with this vendorOkinus needs to factor all payments made to include the total about of days same as cash and allow me to pay the total pay off that was suppose to be debited from my account on 5/6/15.
Which now includes this next payment due on 5/of I find the business approach unacceptable and I have been an existing customer that never had any issues to pay on time and pay my payoff amount as scheduledI will like the reduction for 6/10/to be the amount to pay same as cash daysI will schedule the right pay off amount and be done with Okinus for everAs, a note: I will never do business with Okinus and I will worn all my colleague

Ms*** is correct her principle balance is $327.45, however the account is past due from 3/15/With the account being past due from 3/15/and not having made a payment since 4/12/the account has accrued past due fees in the amount of $Ms*** is urged to contact Okinus to
work out payment arrangements to bring her account current to remove the past due fees from account and therefore reducing the total amount due to OkinusOkinus has several payment options available for our customers that have fallen on difficult timesMs*** can make a payment on account in the amount of $(payment + processing + reinstatement) and Okinus will forward account current (removes the past due amount), and at that time Ms*** can set up arrangements on the amount remainingThe reporting to Equifax can not be deleted only updated

Mr***' account is not paid outMr***' requested a payoff be set up in the amount of $for 2/24/(this was to take care of his 2/12/payment that was returned for insufficient funds), the payoff in the amount of $was returned due to insufficient fundsMr
***' stated that Okinus took duplicate payments for the payoff, Okinus does not have records of a second attempt to ACH debit the payoff ($386.44), Mr*** is adamant that Okinus attempted to ACH his account twice a week apart, Mr*** has been asked to provide proof of the duplicate ACH which has not been received as of 6/16/Okinus has made several attempts to discuss the matter with Mr*** however when Okinus does get Mr*** on the phone he will request a supervisor, when the call is placed on hold the call is lostMr*** then receives a voice message from the supervisor to contact Okinus to discuss his account
Okinus' actions have not been nefarious (illegal), if anything a resolution was attempted to have the problem negotiated however Okinus was not able to assist Mr*** due to the beseeched information being retained
Okinus reports to EquifaxThe information reported is correct; account is past due from 2/12/Mr*** is urged to contact our office 1-800-472-to discuss his account

Okinus received the ROG (Receipt of Goods) from the store on 8/23/as Ms*** statedThe 1st payment was scheduled to draft on 9/1/as Ms*** stated, however as a courtesy to Ms*** the 1st payment was set up for 10/1/Ms*** still has to make the same amount of payments per her contractMs*** was sent a Welcome Letter that stated when her due date wasThe letter was returned with a new address *** *** *** *** (same as customer supplied on complaint), the letter was resent to the new address *** *** *** ***
The payoff amount cannot be adjusted as this is the accurate payoff amount $

I had an opportunity to lease with Ashley Furniture financed by OkinusThe staff was polite and very helpful to answer questions and giving advice for issues when necessaryI was able to complete the days payoff and plan to use them again in the near futureHighly recommend the company for you too

Mr*** is correct his account was debited for regular monthly payment of $and for the SAC (Same As Cash) payoff in the amount of $Okinus made an error and should have only deducted this difference of the SAC payoff and the regular payment that was already submittedThis
however did not occur as a result before Okinus can issue a refund it is explained to customers that a statement must be sent to Okinus for review to show that the payment(s) are posting to account and will not returnMr*** did sent these statements on 2/6/showing both payment posted to accountOkinus then prepared the ACH credit for $Mr*** was informed of the delay in the funding showing upAs of today 2/10/14, the credit should be reflected in Mr***'s accountOkinus would like to again apologize to Mr*** for the oversight

Roman"">Okinus is considered a second chance leasing company and we report
to Equifax as advertisedThe days same as cash is an offer that Okinus
gives our customers and is mentioned in
our contract on line along with stating you have to include sales tax to the
cash price listedI do see that Ms*** paid out the account out on 12/4/
for the cash price plus sales tax that was owedOkinus reports on all of our customer’s accounts
at the end of every month which is when Ms*** account would have been
updated. I do
understand Ms*** concern about Okinus not reporting on her credit in October and November and usually the correct process to fix this would be to file a dispute with Equifax then Equifax will send the dispute to Okinus. However, I sent
her account in to have the status updated to a zero balance without having a
dispute from Equifax. Ms*** should see this update in 3-
business days on her credit report

As stated previously
we do offer all of our customers an early payment option, however to take
advantage of this the customer must contact OkinusBy law Okinus can only
draft a customer’s monthly payment unless authorized by the customer to draft a
different amountMrs*** is correct to mention that the website shows that
the Bill Amount is $however it also states the Minimum Payment Due beside
it in the amount of $Unfortunately, Okinus was not contacted nor did
the customer select the option to go ahead and pay the Bill Amount on our
website to take advantage of the early purchase optionTherefore, Okinus
drafted her regular monthly payment that was agreed upon when Mrs*** signed
her contractOkinus is going to allow the account to remain paid out but no
refund will be issued

Ms*** signed a contract on 5/17/Ms*** contacted
Okinus on 6/14/wanting to change the debit card info on file, Ms*** was
explained that Okinus will ACH draft from the
checking account on fileMs
*** stated that the checking account number on file was still goodMs***
did contact Okinus on 8/26/and was informed that he day SAC (Same As
Cash) expired on 8/16/14(Welcome Letter attached), Ms*** was upset that had
missed the SAC payoff and was wanting to payout the SAC payoff, Ms*** was
told this option was not available to her she stated that was not going to pay
extra and ended callMs*** replied to an email Okinus on 2/27/that
would like to pay $to pay the account offThis has been approved to
accept $to pay off accountMs*** is urged to contact Okinus and
take advantage of the reduced payoff

Ms***’ cash price from the store was $the sales tax for Marietta Furniture Outlet is 7.00%, the amount of sales tax due on the cash price is $($x 7%)$+ $= $4547.50. Ms***’ made payment to Okinus (including the down payment), those payments total $($+ $+ $+ $+ $2121.49) If Ms***’ had “swiped her credit card” this is the amount that would have been paid $The amount of sales tax is decided on by the local government (Cobb County)
Ms*** contacted our office on 2/17/and inquired on her payoff the payoff was given along with an explanation (cash price + tax) she said okMs*** called Okinus back within an hour to ask about the taxes it was explained to Ms*** that Okinus has to collect the sales tax that the store does not; Ms*** stated that maybe the store included it in the price that was sent to usMs*** was informed that if that was the case then she would be doubled taxed and the store would owe her a refund, Ms*** was placed on hold while the store was called (initially Ms*** did not want to call the store)*** from the store verified twice that the amount on the invoice submitted to Okinus ($4250.00) did not include sales tax, Ms*** was informed of this and stated ok, then customer asked if could have her SAC (Same As Cash) extendedThe account was reviewed by management and the customer was misinformed by one (1) day when her Day SAC expiredOkinus honored the incorrect date that Ms*** was toldMs*** paid account out

Ms*** did cosign on a contract with Okinus on 5/31/(contract attached)The contract states the terms of the contract (remaining after down payment) and the amount of the monthly paymentOn page of the contract Okinus provides a payment schedule for the customer, as with all Okinus'
customers Okinus offers customers the option to pay account out in Days Same As Cash (Ms*** did not take advantage of this)Okinus also sends every customer a Welcome Letter that will summarize their contract (payment amount, terms, SAC expiration, due date, payment schedule), the Welcome Letter was sent to same address Ms*** included on above complaint (Welcome Letter attached). Ms *** states that paid $in December 2013, Okinus does not show a record of this paymentA payment history is attached showing all payments made on the account (the amounts of $are for previous payments returned NSF)
Okinus did provide a payment breakdown to Ms*** on 10/24/Okinus will not be able to stop payment in August 2014, nor will Okinus issue a refund for July paymentThe remaining payments are scheduled for ACH debit on the 12th of each month

prior notification from Mrs*** stating that she intended to take advantage

listed on the contract, all of which have been made by automatic withdrawal
Mrs*** contacted our office on 11/3/to inform us that she originally
planned to take advantage of the early pay off option that was showing online
for $however now we have drafted the full monthly paymentMrs***
requested a refund of the differenceMrs*** spoke with a Manager, *** ***, who advised her that we would accept the November payment as the
early pay off but we could not issue a refund of the differenceThe customer
had payment remaining per the contract and an early pay off balance of $
after the November payment was processedOkinus is still going to accept the
November payment of $as the early pay off and will mark the account as
paid outThe customer will have a zero balance and no more payments due.
The customer will receive a letter showing that the account has been paid in
full

confusion Ms*** has experienced Okinus will offer a slightly reduced
regular payoffOkinus will not be able to extend the SAC payoff due to it
expiring 12/11/
The regular payoff for Ms*** is $510.14, Okinus will
offer a reduced payoff of $offer will expire on 1/30/

In response to Ms*** Okinus understands completely what she has stated each timeOkinus has stated each time that the error was Okinus, this has never been disputedOkinus does not refute that Ms*** has a judgment, however Okinus cannot issue a refund because someone sends over a judgmentMs*** has been informed repeatedly that in order for a refund of fees Okinus will need to see where the charges were assessedIf the documents are not submitted then refund can not be givenThe reason that Equifax reports as paying late is due to Ms*** missing 11/22/payment, due to her payroll changing to monthly, after this maintained month behind (reason Equifax reports paying late)The negative mark is accurately reflecting how Ms*** has paid on account, as a courtesy arrangements were made to bring account current and forward due date to current so that would no longer report behind on EquifaxMs*** may submit a copy of Equifax report to check for accuracyMs*** states that had to fight with Okinus to remove NSF fees, the exchange was in the email document that was forwarded with previous REBUTTAL, Ms*** stated that did not feel should have to pay NSF fee due to Okinus error, the Okinus rep replied in minutes that the fee was removed, without hesitationMs*** can be assured that Okinus is able to continue to process her payments monthly and properlyOkinus admitted to the error and asked for proof so could be reimbursed, offered arrangements to bring account current (was past due before error)
So there is no ambiguity with Okinus it is as follows:
No settlement offered on account
Letter of accountability mailed to Ms*** for her records
Okinus must have supporting documents of accessed fees for a refund; to date still have not received (it may be sent to ***fax ###-###-####)
Ms*** account was forwarded current in April after completing the arrangements to bring account current; Equifax reporting correctly (subject to review if Equifax report submitted)
