Ms. [redacted] is correct with some of the statements made. Ms.
[redacted] cancelled her order with [redacted]. Ms. [redacted] called Okinus on
3/14/15 and stated that had cancelled the order...

with the store. Ms. [redacted] was
told for refund of the payment Okinus would need a copy of the bank statement
showing the payment had posted to the account (the payment was for 3/9/15). Ms.
[redacted] did send over a bank statement with transactions thru 3/5/15 on Sunday
3/15/15. The statement did show the initial transaction from The Furniture Spot
(on 2/9/15) and the credit for [redacted] (on 3/4/15).
Ms. [redacted] is correct Okinus had documentation of the payment
submitted and the payment has posted to her account per the contract that she
signed on 2/7/15. Okinus did not have documentation that the payment would be
honored by her financial institution which is why Okinus requested the copy of
the cleared payment so a refund could be issued (Okinus never received proof).
Okinus sent the payment per the contract that Ms. [redacted]
signed, Okinus was under the impression that Ms. [redacted] was in receipt of
merchandise being that did sign a “Receipt of Goods” on 2/7/15. Ms. [redacted] also
received a “Welcome Call” from Okinus 2/13/15 and stated was in receipt of all
merchandise followed by a follow-up email from the same email that the above
reference bank statement was sent from.
Ms. [redacted] states that Okinus used her monies for 2 months
even though did not receive any merchandise (2 months has not passed since
signing contract on 2/7/2015), Okinus was notified by Ms. [redacted] on 3/15/15 and
a credit was submitted on 3/19/15 (even without proof the payment posted). Ms.
[redacted] was informed this and was not satisfied with what was told as evident of
the recording from 3/19/15 that she referenced in complaint.
Okinus processed a refund of Ms. [redacted] payment that was
sent to the bank in error. Enclosed you will find the contract Ms. [redacted]
entered into on 2/7/15, the “Receipt of Goods” that was signed on 2/7/15 and a
copy of email correspondence from Okinus representative verifying had
merchandise on 2/13/15.
Ms. [redacted] should be in receipt of the payment if not feel
free to contact Okinus. Okinus has apologized to Ms. [redacted] several times about
the misunderstanding about the whole matter.

Mr. [redacted] is correct that Okinus has been charging him per the invoice received from the store. Okinus received a call from Mr. [redacted] on 5/26/15 (who was at the store) that was not in receipt of the bar stools and no longer wanted to wait. This was verified with the store...

and a revised invoice was sent without the price of the stools. Okinus sent a contract for the customer to sign so the account could be corrected. Okinus received the revised contract signed on 5/27/15. The account is in the process of being corrected and Mr. [redacted] should be able to contact Okinus by close of business 5/28/15 for an up to date account status.Mr. [redacted] stated that Okinus has charged him for all merchandise and is FRAUD due to not receiving all merchandise, this is not the case. Okinus was charging Mr. [redacted] incorrectly due to Mr. [redacted] signing an ROG (Receipt of Goods) on 3/31/15 stating that had received all items on his Okinus contract and instructed Okinus to fund the store. Okinus attempted several Welcome Calls to welcome to Okinus and go over any questions that may have, we were unsuccessful in reaching Mr. [redacted] and left several messages. Mr. [redacted] did contact Okinus on 5/11/15 in reference to correspondence sent via mail about payment, information was verified however nothing was mentioned about not being in receipt of merchandise (this was not until 5/26/15 as stated above)

Mr. [redacted] is a returning customer of Okinus, Inc. Okinus
was not contacted by Mr. [redacted] to advise that preferred to pay account off in
90 days therefore Okinus only ACH debited...

the amount on the contract $60.76
that Mr. [redacted] agreed to when he signed the contract. As with all customers
Okinus includes a payment schedule that gives a payoff estimate provided make
regular monthly payments (on page 2 of contract). The S.A.C. (Same As Cash)
expired on 8/15/14. It is unfortunate that Mr. [redacted] was not able to take
advantage of the S.A.C. on his 2nd account. Mr. [redacted] has advised
an Okinus representative to pay account out on 12/5/14.
 
A refund is not due to customer.

response to Mr. [redacted] and referencing USPS
Certified Letter # [redacted]. The Equifax report has been correctly
updated (a copy was attached to initial dispute). The letter that was attached
to initial dispute can be emailed/mailed if Mr. [redacted] still requests. In
reference to $750.00 loss Okinus has not received any documentation from Mr.
[redacted] as to an amount of loss nor a responsible party.
            If
as Mr. [redacted] contends that Okinus is responsible, Mr. [redacted] is urged to send
over documentation so that it can be reviewed.
 
Okinus has attached again the
updated Equifax report showing no late payments and up to date. The updated
Equifax report shows a high credit of $1599 and a balance of $625.00
 
Mr. [redacted] should not be penalized for an error made by
Okinus, if you have any questions please feel free to contact.

I reject this because I have paid more than what the pay off amount is. even on my credit report they state I owe a balance of 1,980 and the actual balance was  2,442 there is no possible way I owe more than the balance they want to give me. not only do they continue to add to the balance but they continue to report to Equifax as if I'm late on my payment and its affecting my credit . witch its making it  hard on me on my new home purchase . how can they report something I owe to to the credit bureau and give  me a different amount it makes absolutely no sense.

Ms. [redacted] signed a lease agreement with Okinus on 10/30/13 (see
lease agreement attached). The terms were disclosed in the lease agreement. Ms.
[redacted] has not paid over $4000.00 on her...

account. The total of payment that Ms.
[redacted] has made on account is $3132.24 (see payment history attached). Okinus made
arrangements to get account caught up with Ms. [redacted] when her account initially
fell behind 6/2014 the arrangements were not met. Ms. [redacted] asked for Okinus’
assistance again 11/2014 to get account caught up. If arrangements are met
account will then be forwarded current and the payoff reduced (by past due
amount).
 
Ms. [redacted] has not satisfied the terms of the lease
agreement, the lease cannot be terminated. Ms. [redacted] is urged to complete the
arrangements from 11/2014 and reduce the amount owed to Okinus

Ms. [redacted] was emailed on 5/28/14 and a voicemail was left informing Ms. [redacted] that the request was made again to Equifax to have Okinus removed from credit. If anything further is needed we ask to contact our office.

Ms. [redacted] invoice stated her cash price was $4200.00 this amount did not include sales tax as was verified on 2/17/14 at the request of the customer with the store. The sales tax is not included in the cash price due to the contract being a Lease Contract (stated in bold letters beneath the 90...

Day SAC (Same As Cash) notice). The sales tax is calculated into each payment (based off of current sales tax rate). The monthly payments are broken down on the contract which reflects the monthly amount of sales tax to be paid. Okinus does not have a 90 Day SAC balance on contract however it is noted on contract that the customer can exercise their right to pay account off in 90 days. The taxes that are collected are paid to the county in which the store operates in. Ms. [redacted] was sent a 3 page Welcome Letter that summarized her recent contract (payment amount, due date, 90 Day SAC expiration, remaining payments), the letter instructed Ms. [redacted] to call for additional info, the 2nd page is our Privacy Policy, the 3rd page is a payment schedule that reflects the current balance of account less taxes.
It is unfortunate that Ms. [redacted] did not contact Okinus previously so that could have been aware of the total amount of 90 Day SAC payoff. A refund is not due.

at this time I dont have  any arrangements for okinus to  take money out of my account when they feel like it. I was told by agent today that they can debit funds out of my account anytime they feel like it. I told thier agent that I will not just accept thier barbaric and bully tactics. I didn't authorize a payment out of my account and this type of barbaric tactics is unacceptable. they have been conducting these tactics for the last two years. I will talk to by bank to my bank on how to rectify this issue from ever happening again.
If okinus wants to handle this situation in a professional matter and stop with the barbaric tactics then we can talk.

They also stated that I initially called in, when in turn upon review of my call log I noticed that the company called to me. This is not the first time that this company has drafted my account when either the account was paid up ahead of schedule or I request a call back. Sending email is not appropriate as I said to the representative that the email was not received/reviewed until the overdraft of my account occurred. The initial call made by the company on 12-21-2015 lasted for 2 minutes 22 seconds and I request a call back on 1-1-16 to schedule a payment later within that month using the same account as the last payment. Okinus, Inc. has not offered any type of resolution only an apology for not having the promised tape recording which is mandated by the FTC to keep on record for 24 months. Their response in unacceptable at this current time.

Then why didn't they don't take out the money come October 16th.I just had 162$ and some cents to complete my purchase. My understanding was that the money would automatically come out of the account.That is why my call to Okinus was immediately after the 1st because that money that got out of my account was not expected.

Ms. Hampton is correct she did contact Okinus on 5/14/14, and state that wanted to stop the payment for 5/21/14, asked for the payoff (payoff was quoted) changed due date to 27th of month. Ms. Hampton was asked whether to set payoff up said will call back if decides to pay out, asked how many...

payments left was informed 8 and asked why and the Ms. Hampton was given a breakdown of the payments. Automatic ACH were suspended on 5/14/14.
Ms. [redacted] called Okinus on 5/22/14 and spoke to [redacted], decided to pay the payment with checking instead of debit card (due to fees), asked for payoff after Mays payment (payoff quoted good until 6/27/14), the call ended.
Starting on 7/2/14 messages were left for Ms. [redacted] to contact Okinus, a letter was sent on 7/2/14. Per # 20 on page 2 of contract authorizes Okinus to process payment.

Okinus received Mr. [redacted] bank statement showing where the two payments (the regular monthly payment and the payoff) had drafted from his account on 2/1. However both payments were pending so per Okinus policy we had to ask Mr. [redacted] to submit over a bank statement that show the payments posted...

before issuing a refund to avoid the chances of Okinus issuing a refund then the original payment coming back returned. Okinus received the bank statement showing the payments posted to Mr. [redacted] account on 2/2 and a refund was issued that same day in the amount of $67.01. Mr. [redacted] should have seen this refund in his account 1-3 business later. Okinus is sorry for the inconvenience that was caused to Mr. [redacted] by both payments drafting from his account.

I have attached a copy of the letter I had sent to Okinus regarding the furniture and I called back and spoke to a representative on 4/16/14 to schedule a pick time and date and she said she could not schedule the pick up since management was reviewing the case and that they will call me back.  I have not received any phone calls regarding the pick up or regarding the refund of the payments.  I did advise the Okinus representative that its urgent to have somebody pick up the bed since I do have a baby at home and children which makes it dangerous to have the bed bugs which have also been treated at home and if no one contacts me I will be forced to dispose of the bed myself.
