Optima Tax’s management has made contact with the client to
discuss her concerns as outlined in the complaint. Although Optima Tax advertises
that it may be able to reduce a taxpayer’s outstanding liability, it also
clearly discloses that every tax payer will not qualify for a reduction. Moreover,
our contract, which every client receives and signs, also discloses that not
every tax payer will receive a reduction and any reduction must be accepted by
the tax authority. To assure that every client we represent fully understands
the nature of our services, each client will go through a recorded Verification
Call that thoroughly covers all legal disclosures to which they must
acknowledge their understanding of these representations.
Optima
Tax is disappointed that the client feels as though we have not been
forthcoming in our communications. Optima Tax understands that client’s are anxious
about their tax liability and we work hard to keep them informed at all times.
However, there will be times when Optima Tax is not able to update the client
with new information because we are waiting on the IRS to respond to our
communications. This does not mean Optima Tax is not working the case as
outlined in the agreement. It’s unfortunate that the client feels as if Optima
Tax scammed her but, after our initial conversation the client has a better
understand of our services and we are confident that we have changed her
perception. More importantly, we are working towards a mutual resolution that
will satisfy both parties involved.

Optima Tax’s management has made
contact with the client to discuss her claims, as stated in the complaint. Although
Optima Tax is capable of preventing garnishment/levy of our client’s accounts, we
cannot be successful unless our clients maintain their filing compliance
with the IRS, as instructed. Optima informed the client of her need to make
Estimated Tax Payments because she is self-employed. Unfortunately, the client
did not make these Estimated Tax Payments, which has resulted in the IRS
levying the client. Therefore, Optima informed the client of the $1,250.00 she
needs to pay to the IRS in order to be current with her Estimated Tax Payments.
Once the client makes these payments and is in compliance, Optima Tax can
continue servicing the client’s account to achieve a resolution with the IRS.
Moreover,
in contrast to the client’s belief that Optima has not contacted the Revenue
Officer, we recently sent the IRS a packet of financial information so we can successfully
resolve her case. In addition, we have informed the client of the status on her
case and also provided her with some options in lieu of her dissatisfaction so
that we may continue our relationship. The client is weighing her options and
she will advise Optima Tax accordingly.

I am writing to you on how much I appreciate what Optima has done for me @ my time of need. I was in a difficult situation & I was listening to the radio & heard Mr [redacted] explain what Optima can do & can assist on back taxes. I heard of a few services out there & decided overall to move forward with Optima. I only did not receive great assistance, but overall great customer service & knowledge of what I was about to face. As our Govt moved us back to British Colonial times & are taxing the crap out of us, sometimes we are backed against a wall & tend to move in any way we can to achieve a peace of mind. I was struggling & couldn't pay my taxes, I knew I would need help & Optima was there. I didn't have time to figure what I should do with the IRS but Optima assisted where I couldn't. I thank them & would do it all over again. The price & the pymt methods were perfect & everything tweeked out at the end. I am satisfied & I am overall looking to move on with my life in a more affluent way. This Govt is squeezing my wallet & giving it to everyone else but me ! Im just tired how I ended up & optima was all I had.

discuss his concerns as outlined in the complaint. In order to clarify, Optima’s
services are separated into a two phase approach, Investigation and Resolution.
As outlined in our Client Services Agreement, the client engaged Optima to
perform an investigation of his tax liability. As the client identified, after
we completed a thorough investigation, we presented him with our findings and
the proposed services that we could provide in our resolution phase. As in this
case, before Optima Tax begins its service, each client goes through a voice
recorded Verification call which thoroughly discloses the services we will be
performing and all legal disclosures.
Upon
contacting the client, we reiterated the structure of our services to which the
client understood. However, we are sympathetic to the fact that the client may have misunderstood our approach to
servicing his case. As a result, we provided the client with some information that
may help him resolve his liability. Moreover, we were able to come to a mutual
and amicable resolution that satisfies both parties.

Optima Tax’s management has been in communication with the
client to address his concerns as outlined in the complaint. As the client stated,
he initially contacted Optima Tax to address his tax liability. After we
concluded our Investigation, we presented the client with a formulated strategy
to resolve his tax liability and the client decided to sign up for our
Resolution Services thereafter.
Although
Optima Tax is extremely successful in negotiating a reduction of our client’s
liability, ultimately the IRS has to approve any reduction we attempt to
negotiate. This is explained to all of our clients as we ensure to be very
transparent regarding our services. The client completed a voice recorded
Verification Call that covered all disclosures, including the fact that any
reduction we seek to obtain on the client’s behalf must ultimately be accepted
by the Tax Authority. With each specific disclosure given, our clients must
acknowledge they fully understand the disclosure by saying yes before they are
able to move on to the next disclosure. After reviewing the Verification Call,
the client acknowledged they understood and accepted all legal disclosures.
Additionally, we do not advertise nor does our agreement stipulate that we can
reduce the accrued interest. We make it clear to our clients that until their
balance is paid in full, they will continue to accrue penalties and interest. Each
case, no matter the circumstances, will be fully evaluated to ensure that we
have taken every step possible to reduce our client’s liability.
It’s
unfortunate that the client feels as if we lost his paperwork and or stalling
on his case. What the client may perceive as us losing documents is actually
Optima Tax requesting updated documents. Optima Tax cannot determine the
client’s financial capabilities off three to four months worth of documents nor
can the IRS for that matter this is why we request a substantial amount of up
to date documents from the client. It’s important to understand our client’s financial
situation for negotiation purposes and to strengthen their case.

I was very pleased with the service provided by Optima Tax Relief. They were upfront about their fees. After paying their fees, Optima arranged an offer in compromise that saved me over $19,000. Staff members were friendly and helpful.

I went to them for help. Before they would do anything, they need 900.00. I paid the money. This was phase one. Three month later, they told that to start phase two, they needed 8000.00, I told them did not have it. So the want to do a payment plan of 1440.00 down payment and 500.00 a month. I told them I did not have the money and to give me 30 days. Before the 30 days was up, I told them that I did not have the down payment and did not know what to do. On the 30th day, they drafted my bank account for the $1440.00.
And they will not return it. I ask them, if I told you I did not have the down payment, why did you draft my account., They have offer to give me back 1000.00. When they drafted my account, it was overdrawn for over ten day. The overdrawn late fees from my bank put me deeper in the hole. They are worst than the IRS, they take your money and do not care if they hurt your finances. The reason I went with them was to help. If I had that type of money, I could pay the IRS. Beware

We sought representation because we firmly believed Optima is honest,honorable and willing to help. It is impossible to totally resolve IRS audit but to somehow ease the suffering and pain how IRS deal with clients like us. Now Optima is firing back the disclosure requiring a “yes” before moving forward. Yes, after the lastinstallment payment was collected, for clients like us this is just a point of no return and hoping for the best. Somehow in the process of reviewing our case and after few documents submitted, they knew by then they could not help us. Optima should have advised us of this, instead of continuing with our case, prolonging the process which took a year and therefore ended up adding to the penalties and interests.They set up a payment plan for us which we could have done ourselves with the form 433D. Just like our inquiry for our Franchise tax Board, Optima refused to take our case because they know there is no money for them with this one.We took their advise and save $1000 fee. I disagree with the statement that they negotiated a favorable payment plan claiming it is lower than we declared on the complaint. Again, I remember my words in this matter. "Hey are you on my side of the case this is much higher than the IRS auditor request?" There was a desperate move in our case to avoid lien to our house and penalties as part of the resolutions. We even forced ourselves to raise money as to renegotiate with IRS and hoped that they could help us. Optima refused and advised us to put the money to our down payment as part of our payment plan. Optima’s statement indicated that they spent a lot of time and energy in this case, unfortunately , the IRS unwilling to adjust audit determination. This result comes out after 12months of waiting just to increase my debt and fees by 26% (Optima fees+interests+penalties) on top of the audit amount by the IRS. Instead it added to our frustrations. We believed we were strongly represented through Optima's CPAs and Tax Lawyers but we never heard from any of them. The times Optima communicated with us was with a generic message left on our phone machine. Needless to say we did our part calling which most of the time unable to talk with the contact person. At this point we stand firm on our request for a refund.

Optima Tax states in their response on paragraph 1 that they negotiated a favorable installment agreement. This is false the installment agreement they were suppose to negotiate was to include the tax years 2010,2011,2012.2013, & 2014. The installment agreement they submitted to the IRS only included 2010, 2011, 2013. The did not submit 2012 & 2014. On their response on paragraph 2, Optima states that once they finalize a resolution for a client the IRS will no longer initiate any enforcement action. Again, this is false or better yet they did not do their job right because I have received multiple notices in which the IRS is seeking to enforce action by putting a lien on my property in I don't pay my taxes owed for 2012 & 2014. Tax years that should have been included in the resolution. Furthermore, effective 2/3/16 the IRS will be withdrawing the installment agreement because of the taxes owed for 2012 & 2014, again tax years that should have been included in the installment agreement. Optima is also stating in this same paragraph that I am not making my monthly payments as agreed and that this is the reason why I have received theses notice. This is not true. If Optima has proof that my payments have not been made as agreed then please present you evidence because unlike Optima I have copies of every single payment check that has cleared my bank paid to the IRS since my first initial payment of 9/28/15. Contrary to Optima's statement of IRS practices to put a lien to protect their interest, the real reason the IRS is threatening to put a LIEN on my property us once again for taxes owed for 2012 & 2014 which were not included in the installment agreement. With regards to Optima's statement in paragraph 3, I disagree. All balances with a liability were not included in the payment plan. Optima claims that the 2012 tax year had no outstanding balance but I cannot understand how they are making this statement. First of all Optima requested from the IRS my history for the past 10 years. This history would have included my 2012. Secondly, Optima was preparing to file my 2012 tax returns when I informed them that my 2012 tax returns had already been prepared there was no need for them to do it. I emailed them a copy of my 2012 tax returns and unless they are blinded, my tax returns clearly state how much I owed the IRS. Even the copy of the 2012 taxes they were preparing indicated I would owe taxes for 2012 (I have copies of this as well & the emails). So for them to sit here and state there was not liability balance for the tax year 2012 clearly indicates they do not know what they are doing.
For these very reasons stated above I do not accept their response and I am seeking the refund amount I have indicated. Optima did not provide the service they were contracted to do. As I have stated, I do not have the confidence to work with Optima any longer to resolve these additional problems that have arise due to their mistakes.

Optima was essential and did a great job helping my significant other with his tax debt...he had a stroke in 2013, on ss disability, limited funds, and Optima really stepped up to the plate....made it very easy thru the entire process...it was well worth the $3000 to save him over $25,000 in debt...THANK YOU OPTIMA for all your help
I found Optima Tax to a very refreshing business. They do what they say with no hidden costs. They are up front with you every step of the way. They took a lot of stress out of my life dealing with the IRS. I would recommend them to anyone needed their help.
