Furthermore, we looked into all claims made and feel as though any potential problem areas were corrected in a timely fashion.  It is regrettable the consumer was faced with such issues and we sincerely apologize for any inconvenience experienced by the consumer. At Optima tax we strive to uphold the philosophy that "clients come first" and all of our representatives go through rigorous training to assure we abide by that philosophy. My wife and I had several tax issues with the IRS dating back to 2001. We tried a different tax relief agency in 2009 who did absolutely nothing for us except drain our savings account. We heard about Optima, read the reviews and decided to talk to them. From day one they actively acted on our behalf and in our best interest. It ultimately took approximately 11 months but they got our $70K + tax debt completely eliminated and for the first time in many years relieved a lot of stress and anxiety from our lives. Our only regret is not contacting them sooner. A lot of tax relief company's promise a great many things and do nothing but Optima does what they say they will.
If you have tax issues, don't try and deal with the IRS alone. Believe me, they will eventually come after you and without professional help you will be overwhelmed. If you need help, call Optima. We did and we highly recommend their services.

Optima Tax’s management has made contact with the client to
discuss their claim as outlined in the agreement. We are still working towards
a resolution and, their concerns are being addressed accordingly. As part of
our representation, it is our job to build a case and present it to the IRS
and/or state tax authority in hopes of negotiating a favorable resolution. Part
of our process consists of gathering important financial and tax documents in
order to determine the best available services that we can provide to the
client. Unfortunately, during this process the IRS expressed serious concerns
with certain filings that the client had previously made prior to engaging our
services. The client could not locate the tax documents unfortunately and this
resulted in a delay of servicing.
It’s
unfortunate that the client feels that the actions taken by the state taxing
authority were a direct result of Optima’s representation, or as they stated
the lack thereof. However, the actions that the state taxing authority took
were a result of collection activity that the state had begun prior to the client
contacting Optima Tax Relief. In contrast to what was stated in the complaint,
Optima Tax does not guarantee that engaging our services will prevent any and
all collection activity from being initiated by the IRS or state taxing
authority. This is clearly disclosed to the client and each client acknowledges
this, in writing and verbally, prior to beginning our service. Although the
client did eventually provide us with the documents we requested from them, unfortunately,
the documents they would provide were sporadic and often incomplete.  The delays we experienced in receiving the
requested documents from the client prevented us from having an opportunity to
prevent any action being initiated by the state and/or IRS.
Furthermore,
the IRS and/or state taxing authority will often take several months to process
tax returns. As a result, this required us to ask the client for updated
financial information in order for us to negotiate with the IRS and state
taxing authority. We are disappointed that the client feels that this is due to
poor servicing on our behalf because we always strive to keep the client
informed of the progress on their case.

It’s unfortunate that the client did not express his concerns to Optima Tax prior to filing the complaint because we feel as though this situation could have been easily resolved. However, once communication is established we’re confident that we’ll come to an amicable resolve. As the client stated in the complaint, he hired Optima Tax to conduct a thorough Investigation into his outstanding liability. Once we completed the initial Investigation, the client was presented our formulated strategy to help resolve his case. During the initial consultation, the client was presented with a quote of the costs associated with our Resolution Phase based on the information the client provided his Tax Associate. However, after completing the Investigation it was discovered that the client’s case is more complex then initially believed which required an adjustment to the quoted price in order to resolve his case.   After thoroughly educating the client on our process and the fees associated with our Resolution Phase, he now has a better understanding as to the reason for the increased cost of the Resolution Phase. The client’s case is currently being reviewed by management in an effort to present any potential options that will bring this matter to a close and in good standing with all parties involved. Optima Tax’s management has reviewed the case and we feel that
there may be a misunderstanding to the end result of our investigation of the
client’s tax liability. Although the IRS may have yet to assess an ending
balance of the client’s tax liability, based off what was reported to the IRS
it appears that there may have been errors in the client’s tax reporting which
would subsequently delay the IRS’ reporting of the client’s ending balance.
Thus, when proper reporting is completed we are confident a true and correct
balance will be reflected. As the client stated, this cannot be determined
until his 2014 tax year is filed along with any scheduled write offs. Taking
all things into consideration we feel that we have done a fair assessment with
the information given to us by both the IRS as well as the client and we are
confident that we may continue to assist the client.
 
Although
there may have been initial issues with communication attempts with the IRS,
Optima Tax nonetheless obtained all the necessary information from the IRS
agent on March 10, 2016. As we previously offered to the client we are more
than happy to provide the client with the details pertaining to the exact IRS
agent we communicated with along with additional information to solidify our
efforts made on behalf of the client. Furthermore, we have also attempted and
will continue to attempt to provide the client with further details outlining
our formulated strategy that was presented to the client in an effort to
resolve their liability. Solutions were presented to the client to solve any
initial communication issues that may have arisen with the IRS and we are
confident that these issues will be fully resolved, if they have not already
been resolved.
 
As the
client mentioned in their complaint, their tax balances have yet to be assessed,
and this is a direct result as to why he has yet to receive a payoff amount
letter. However, as explained to the client, once his complete and correct
information is received by the IRS he will receive multiple letters from the
IRS until the balance is paid in full.

As stated in the complaint, the customer submitted information on our website
and as a result he opted into receiving phone calls from our representatives. Upon
receiving notification from the customer that he would like to discontinue receiving
any future phone calls, Optima Tax notified the customer that the request was
submitted and to please allow for up to 24 hours for the system to be updated
to reflect the request. Optima Tax always strives to provide effective customer
service and we are truly saddened that the client experienced disappointment with
our processing; however, Optima Tax believes it took reasonable measures to
effectuate the customer’s request. Additionally, Optima Tax is taking action to
increase the effectiveness of its system to prevent future occurrences and we
reiterate our disappointment with any inconvenience this caused.

From start to finish, my team at Optima Tax Relief was phenomenal! They were extremely professional, compassionate, and helpful. They walked me through each step of process in a very timely manner and the whole process was completed within 2.5 months. As the client stated in the complaint, he hired Optima Tax to represent him in reference to an IRS matter. While Optima Tax made numerous attempts, both verbally and through email, to establish contact with the client prior to receiving the complaint, we were unsuccessful in such attempts because it had been brought to our attention that we had the wrong phone number on file. The client also advised us that he could no longer access his emails.  Although the assigned representative advised the client that Optima Tax would be closing his case as we could not establish contact, we also mentioned that all lines of communication will remain open if he chooses to reach us at a later date and time. Optima Tax’s management has been in communication with the
client to address his concerns as outlined in the complaint. To clarify, Optima
Tax approaches each case in a two phase approach. Phase one being the
Investigation Phase and Phase two being the Resolution phase. Per the initial
intake call, the Client Services Agreement, and the voice recorded Verification
Call, the client confirmed and acknowledged their understanding that Optima Tax
does work in two phases and each phase requires a separate set fee.
Although
the client claims that Optima Tax did nothing regarding his case, this is an
inaccurate statement. Upon enrollment, Optima Tax immediately made contact with
the IRS and began the Investigation services the client contractually hired
Optima to conduct. Once we completed our Investigation the client was presented
with our findings as well as our formulated strategy to help resolve his case.
At no point is the client obligated to sign up for our Resolution services. In
fact, the client is more than welcome to close out their case with no
obligations and utilize the information we obtained to help resolve their
liability as a whole. It’s unfortunate that the client never informed our
management of his concerns prior to filing the complaint but, we do understand
that this is a stressful time and we will do what we can to provide our
assistance.

In addition, there is another tax year that needs investigation (2015).
