As you know, LAZ Denver, operates private parking lots in downtown Denver. The surface lot which is the subject of your complaint is operated on an honor system; this lot is not manned, but is set up with a payment machine, and parking customers are expected to pay if they park in this lot. Unfortunately, many parking customers do not payIn addition, some parking customers even attempt to defraud the parking companies by creating paid receipts and bank statements, monthly parking permits, and sharing payment receipts and monthly permits. This is a significant and substantial problem for LAZ Denver, as it is for all parking companies who operate surface parking lots. LAZ Denver has retained our office's services to assist them with monitoring their parking lots, dispute resolution and collections.LAZ Denver has had a lot of problems with this parking lot by parking customers not paying to park, sharing receipts, creating bank statements, ect. The owner/operator of this parking lot has determined they want their lot set up where a parking customer needs to pre pay for their parking session, input their license plate into the machine to pay for the parkingThe owner/operator has gone to great expense to post these requirements on the lot and at the pay stationWhen the lot attendant enters the parking lot, they go directly to the pay station and retrieve a report of all the license plates that have paid for parking. When the lot attendant got to your vehicle, your license plate number was not listed on the report. The lot attendant issued you a notice for wrong license plateWe believe the notice is valid and due. I see in the notes of this notice that you have disputed this notice with our office and our agent has extended a reduced settlement offer. I highly recommend you pay the reduced amount at your earliest convenience

Unfortunately, many parking customers do not payIn addition, some parking customers even attempt to defraud the parking companies by creating monthly parking permits, sharing tickets, ect. This is a significant and substantial problem for Town Park, as it is for all parking companies who operate surface parking lots. Town Park Parking has retained our office's services to assist them with monitoring their parking lots, dispute resolution and their collections. As you may also know, property owners have the right to protect their property from trespassers. Specifically, private parking companies, as the owners/authorized managers of these private parking lots, have the right to establish terms and conditions under which a customer is permitted to park their vehicle or use the parking lot. A customer is permitted to use the parking lot only if they fully comply with the terms and conditions established by the parking company. If a parking customer does not fully comply with the terms and conditions, they are trespassing. Town Park has clear and prominent signage posted at this parking lot detailing the terms and conditions of using their lots, including payment rates, rules and general guidelines (pre-paying for the space utilized, prepaying for the amount of time they will park). Issuing parking notices is one way for Republic Parking to enforce their property rights. Towing or booting vehicles would be alternative ways for a parking company to enforce their property rights. I have carefully read the consumers complaint. I have reviewed the parking notice written by our attendant and I have reviewed his photos taken on the day in question. First of all I would like to say that Parking Revenue Recovery does not own this parking lot, it is operated and managed by Town Park. We do not believe this consumer is forced to park anywhere and specifically not this lot. The consumer is choosing to park in this lot and is free to find parking at alternate lots of their choosing. On 4/28/at 6:47pm, this consumer’s vehicle was parked at Town Park’s parking lot located at Glenam Place. This parking lot is unmanned and has a pay station in which the consumer needs to pay for their parking. When the lot attendant enters the lot, they immediately go to the pay station and get a report of all paid vehicles. They then check the parking lot, each vehicle and verify payment has been made for each vehicle parked in the lot with the ticket face up in the dash so they are able to verify payment, vehicle and time. When they arrived at the consumer’s vehicle, the ticket in the dash had a plate number of 0000000. Due to the ticket not displaying the proper license plate number, a ticket was issued for “Wrong License Plate”. We believe the notice was valid in being issued and is due. The rules and regulations clearly explain that you must enter the plate number. The consumer has stated they did not follow the rules and regulations when they stated they entered instead of entering the plate number. This means they were aware of the expectation to enter the plate number and choose to not follow the rules and regulations of the parking lot when making the decision to enter instead of their actual plate number. If this happens, consumers can then pass the ticket from one person to another because the ticket is not attached to a vehicle. This is why it is written in the rules and regulations that you MUST ENTER YOUR PLATE NUMBER. Here at Parking Revenue Recovery Services, we respond to all communications within hours whether the communication comes in via phone, fax or email. Our phones, fax and emails are working and we continue to receive communications. We also document every form of communication in our system. I am not showing a phone call that was not returned or any form of communication that was not returned by our office. In the interest of customer service, I will offer a one-time curtsey of $20.00, making the current due $55.00. This ticket was issued as a valid ticket; we have the documentation to show that this ticket is valid. We are offering a reduced amount in the spirit of customer service. why here

This particular parking lot is a pay and display lot which requires the user to prepay for their parking space and display a prepaid receipt on the dash. When the lot attendant checked this vehicle, there was no receipt displayed, he was unable to verify payment so a notice was issued for NO TICKET ON DASH. The pay station directs the user to display a receipt on the dash and there is additional signage advising the user they must display a receipt on the dash and if you view the receipt submitted by this consumer, it clearly states PLACE FACE UP ON DASH. The reason for this is that this is the only way the attendant is able to verify payment when checking the vehicles on the parking lot. This consumer emailed our office 3/3/17, the same day she received her notice. She states that she called our office, however our phone logs do not reflect a call from her on 3/3/and she did not state if she called another day. We have realized that we had a problem with our fax line and this has since been corrected. I apologize for the inconvenience of not being able to get a fax through to our office. On 3/10/17, our agent reviewed this consumer's dispute and determined that this was a first time violation and offered a reduced settlement via email and this consumer did pay the notice. We believe this matter is resolved. This consumer has stated that every other car on the lot had a parking notice which really has no bearing on her notice. There were other notices issued on that lot that day, some for no payment, one for parking in multiple spaces and some for expired receipts. On 3/10/17,

A week after parking in the *** *** *** lot at California and 22nd, Parking Recovery Services acknowledges receiving in the mail, at their request, their $ticket and the $parking receipt from their machineThe receipt had been on the dash at the time the ticket was given
I want them to acknowledge the ticket is void or account is paid in full or that the account has been cleared and there will be no further attempt to collect

Our office does not have a record of receiving anything regarding a receipt for this parking notice so that is why we have not responded. We do have another dispute from this consumer for another notice issued in 2015. I did review the parking notice and attached photos taken by
the lot attendant and see that this consumer parked in a Towne Park Pavilions lot on 10/15/16. While he paid for a session of parking, that session expired at 4:59pm. At 6:08pm our attendant checked the vehicle and did not see a valid receipt so a notice was issued for EXPIRED RECEIPT. We believe the notice is valid and due in full

I am rejecting this response because:After speaking with ABM managers, it was determined the notice was infact issued in errorABM had had removed everyone's payment from the box after I paid, then PRR came to write ticketsIf you look at the photo of the payment box it shows on car paid to parkHow does PRR think this is normal? Out an entire parking lot of about spaces, one car paid? ABM was very helpful with resoling this issueThey dismissed the niticeI have received an email from PRR confirming the notice was dismissedSo the person who responded to this complaint obviously has no clue what is going on and did not take the time to look into the matter thoroughlyThis is a true reflection of how this company is ranThey do not care, they just want moneyIf it were not for ABM, I would be ***.

The owner/manager of this parking lot has set rules that each vehicle MUST have a DPS issued pass displayed on their dash each time they park in this parking lot. On 10/31/when the lot attendant checked this lot and this vehicle, there was no pass or permit displayed on the dash and a notice was issued for NO PERMIT. We believe this notice was validly written. This consumer contacted our office with her dispute and supplied several photos showing a pass on the dash of her car. Unfortunately the photos taken by our lot attendant do not reflect the same image. I have attached a copy of the dash photo taken by our attendant and you can clearly see there is no parking pass present. In addition, our office DID return an email to this consumer on 11/3/offering a reduced settlement which this consumer has yet to pay. The pass distributed to these employees by the management of DPS is a large white placard and very easy to see

This consumer parked his vehicle in the Justice Center. This notice was issued by the manager of the Justice Center so we had to reach out to the
Justice Center. The manager responded that the Sheriff's have been advised that they MUST park on the 4th floor. This consumer parked on the 2nd floor. When we reached out to the Justice Center Parking manager he stated that this consumer is a repeat offender and he's too lazy to park where he's supposed to. They will not allow us to reduce this notice and want the notice upheld in the full amountThat this consumer stated that we have failed is incorrect. He sent an email to us on 2/3/16. We had to wait for the response from the Justice Center but responded to him by email on 2/8/16.We do not believe this consumer has any right to file a complaint against our office with the Revdex.com and this should be deleted. that this notice was probably not paid or disputed with Central Parking within days so it was sent to our office for collectionWe would not have any information regarding problems on the lot or the pay station on the day in questionThis is why you have days to notify the parking company of any problems

This response further infuriates meI was told by *** *** or it is now *** *** that I had to work with Parking Revenue Recovery to resolve the issueI called *** *** Monday, June 1st and they said I had to take it up with Parking Revenue RecoveryAdditionally, I did submit an appeal to Parking Revenue Recovery and first response was that my appeal was denied, then another email from Parking Revenue Recovery asked for a receipt and I providedThen I received another email that stated I paid for the wrong stallI explained that I only park in two parking spots at the *** *** location, stalls *** and *** I actually have a handful of receipts that shows those parking stall numbers and no other stallsThis is starting to feel like they are running some sort of scamMake people go in circles until they give up and pay the fineI wouldn't be so adamant if I hadn't prepaid my parking stall like I was supposed to and always doI used to park there every Saturday and Sunday because I work Downtown across the streetI can try again to submit some sort of dispute with *** *** but it probably won't go any where

When the lot attendant checked this vehicle, there was no receipt displayed, he was unable to verify payment so a notice was issued for NO TICKET ON DASH. The pay station directs the user to display a receipt on the dash and there is additional signage advising the user they must display a receipt on the dash and if you view the receipt submitted by this consumer, it clearly states PLACE FACE UP ON DASH. The reason for this is that this is the only way the attendant is able to verify payment when checking the vehicles on the parking lot. This consumer has stated that he paid and displayed the receipt on the dash however the lot attendant took photos of the dash ( I am attaching copies of photos) and as you can see there is nothing displayed on the dash. We believe the notice is valid an due in the full amount of $75.00. As for our poor customer service, our out of office email message and voice mail states that all inquiries will be responded to in days. This consumer received the notice only days ago

there are directions posted at the parking lot advising how to pay for parking at this parking lot. This consumer clearly did not follow the directions on how to pay and
because the correct digits were not entered into the pay station which resulted in the attendant being unable to verify for the correct plate with payment. We do recognized that this consumer has submitted multiple proof of payments and as a one time courtesy we are voiding the notice. If he repeats this same action and does not pay for the correct digits any new notices will be upheld

I am rejecting this response because:Though I do not argue with their assertion that the owner can make whichever rules he likes for the parking lot, I still dispute that their was appropriate signage up at the time I was issued the penalty fee. Parking Revenue Recovery Services still has not addressed the issue that there were no signs up on 1/23/when the penalty was issued. Further the pictures they provided do not appear to have been taken in January. Also they claim there were three signs, but the pictures they provided were of one sign, another copy of the previous picture just rotated degrees, and the third which is where the parking is paid, and I did pay for my parking, does not even state that a receipt must be placed upon the dashboard of the vehicle. Since PRRS has still not adequately addressed the issue, I still assert that this penalty fee was issued under invalid circumstances, and should be voided immediately.
