The business, Poloniex, makes various claims in its response that are both misleading and untrue. The first claim that it makes is that the STR giveaway is a "marketing program", this is incorrect. The best way to think about it, in traditional finance terms, is as a financial dividend for holders of Bitcoin. Poloniex, as an exchange and custodian, support BOTH Bitcoin and STR (this is a critical point as it invalidates their claims that they are not responsible. They are responsible for any dividends paid by their supported cryptocurrencies.). Therefore, when STR presents a dividend for holders of Bitcoin, it is Poloniex's fiduciary duty as custodians to do what is in the best interests of their clients and pass on these dividends to the clients. They say that the sum of money chosen by Stellar is "arbitrary". This is correct, but is also irrelevant. It is EXACTLY the same as done in traditional finance with dividends. Finally, Poloniex states that the dividend is "not related to Bitcoin". This is completely false. The dividend is paid DIRECTLY to the owners of the Bitcoins. As the custodian of the Bitcoin at the time of the payment, Poloniex has a responsibility to claim the dividend and pass it on to its clients. Poloniex is operating in a currently unregulated space, but this incident has direct comparison to traditional finance and securities where precedents have been set. If this was a regulated exchange they would be acting illegally. If Poloniex continues to refuse to pass on the dividend to me, who else could I escalate this incident to in order to ensure that regulators are aware of Poloniex's illegal actions?
