We were...

told that after calling in again, we never received the "package" that they claimed was sent to our address.  We've called numerous times asking for the tracking number for it to track it but they never provided it.  The key was never sent to us I believe, especially since they won't provide any tracking info or anything, we've received everything but the key from them (bills, old plates, etc).  So I know they have the correct address.  I got the feeling that it was never sent after calling and the sales manager came on the phone and said "are you looking for your tracking number? Go [redacted] yourself."  If they could supply the tracking #?

Hello,      Our site stated at time of order that the item would be shipped within 3-5 days, prior to being added to the cart.  (See attached screenshot). Item did in fact ship within that time frame and was received by the customer. The customer seems to have looked up and ordered the wrong part for his vehicle. We have a contact support service and respond to messages right away. We never received a message. We paid his return shipping and the item was returned to us. Upon arrival we gave the customer a full credit. We do ask that if a customer is unsure of the correct item (there are virtually thousands of parts per vehicle) to please contact us. We stand behind every sale and offer a refund or exchange if a wrong part is sent. Regardless of who is at fault. We do not send out free items because a customer ordered a wrong part. Thank You,

Good Afternoon,  I am responding to the complaint for [redacted]. I spoke with Mr. [redacted] and he came in this morning 09-18-2017 and picked up his brand new 2018 [redacted].

Daniel J Quirk, Inc. dba Quirk Pre-Owned asks the customer to make a service appointment if there are any remaining service / mechanical issues with the vehicle.  We encourage all customers who purchase used vehicles, to purchase an extended warranty.  This was offered at the time of...

sale.  Approximately 1 1/2 years since customer purchased vehicle so Quirk Pre-Owned cannot take vehicle back.  Please let customer know that if they would like to trade vehicle in, we would be happy to give them the best trade price possible.

that statement is false on the website the business posted the wrong item at least look for the part not just be interested in the return  return  only .this will not end till you make me a satisfied customer and I will place warning for futere customers  .

Dear Seller:The second tracking number provided does not show any movement on the [redacted] site. It was obviously not shipped out. Please arrange a refund for the broken part. Attached are pictures of the broken part, you can see the crack on the larger piece and on the smaller piece you can see were all the tabs broke off. Regards,

[If you are rejecting the business's response please enter your rejection comments here.]The agreement I made with the sales person and the sales manager, was for Quirk [redacted] to pay everything remaining on the lease and/or any other fees  [redacted] and trust may charge. Like I've stated before, I only got into a new lease because it was assured to me several times, that I was not going to be responsible for any payments of any sorts owed on the lease of the 2012 [redacted] as stated by the sales person several times "  The [redacted] 2012 it is our responsibility now and you are not liable for any charges whatsoever. By Quirk [redacted]  paying half of the charges assessed by  [redacted] and trust, they are clearly in violation of our agreement for not holding their  end of the bargain. I hereby do confirm that, I did receive a refund for the inspection sticker($35) about 2 weeks ago but they still have not paid the outstanding balance on the account. I have no proof of this but I truly believe Quirk [redacted] was expecting to make the profit from auctioning the car to turn and around and pay off the balance owed to  [redacted] and trust. but they probably did not earn the money they were expecting and that's why they don't   want to honor the agreement we had in the first place. I want to reiterate that Quirk [redacted] is lying by saying we agreed to pay half of the balance  as the only agreement I made with them was for [redacted] to be responsible for any charges incurred once they took possession of the vehicle.

I am aware of Mr. [redacted]'s situation and have spoken to him multiple times. I have advised him to try and work with KMA and consumer affairs and I have also acted as an advocate on his behalf in communication with KIA.   The last time Mr. [redacted]'s 2007 [redacted] was in for service with us was...

back in April of 2017 where we addressed a check engine light concern. The vehicle needed an oxygen sensor replaced. He also requested we remove the running boards from the [redacted] as the mounting brackets where rusted and broken, which we did at no charge as complimentary service for Mr. [redacted].   Mr. [redacted] has an open consumer affairs case with KIA and has been granted GOODWILL repair at no cost to him. I have reached out to my DPSM and also to consumer affairs to help in any way that I could.   I have looked through all of Mr. [redacted]'s scanned repair orders and have found nowhere in any of his history/repair orders or paperwork any mention of rear axle damage/concern and or notations.   When I spoke to my DPSM he informed me that the vehicle is out of its "perforation/corrosion" warranty and they are not granting any coverage of the "rear axle issues" due to the vehicle being out of warranty. Since we have never done any "rear axle" work on the vehicle and have absolutely no documentation of any rear axle issues, there is no way for us to warranty and/or cover any repairs the 10+ year old [redacted] is in need of.  We also have a High Mileage Release signed by customer

Customer was shown equipment in vechicle before purchase and on delivery. Then customer signed a delivery check list with the equipment in the vechicle.

Unfortunately, Quirk [redacted] disagrees that Mr. [redacted] was unaware of the satellite radio not being available in the model he purchased.

I have looked into what has exactly happened. It appears that your extended warranty "The warranty group" is asking for maintenance records. We are...

not. Quirk only sells the warranty during the car sale. We do not make any decision regarding coverage. All of those decisions are made by the warranty company. In your case they are asking for maintenance records because the failure of the camshaft and timing could be a result of lack of oil changes. If you look at your contract from when you purchased the vehicle, you will see they have the right to ask for these. I am sorry you do not have these receipts but it is a very common practice to save any maintenance records. Most customers do this. I would recommend contacting places that you have gone for service and asking for copies of your maintenances. I know this probably seems like a ploy to not cover the repair but please understand that it does not matter to us who pays for the repair. if it was covered the extended warranty company pays us. so there is no conflict of interest. We paid off the lease and during that two month period there were no payments made by [redacted].  We only processed the lease return.

May we please have some additional information?  Where did you purchase/lease your vehicle - at which Quirk Auto Dealers location?  Thank you

Please add your rejection comments below.  Quirk [redacted] said they were paying off my current lease completely and not counting any negative equity against me so clearly that is a fabrication of the events to say that my trade caused the payment on the deal to increase.  They even showed me this on a line by line quote sheet, showing they were paying off my current lease without adding to the new lease cost.Also I was never offered $375mo on the white Sedona SX in stock.   When did this happen?

To whom it may concern.  I [redacted] spoke with [redacted] 12/21/15 and worked out this issue with him.  He is happy and will continue to get his Volkswagens from us. [redacted]Quirk VW[redacted]

I am unaware of such a lease process.  The [redacted] was my first lease and I have never returned a car that has damage.  I pointed out the damage and the [redacted] salesperson said to me, "we'll take care of it."  He did not say, "we'll assess it and send you a bill in 30 days."  I do have a number of friends and a brother who lease cars on a regular basis and they have never heard of receiving a bill in 30 days.  They have always resolved any issues at the time that a new lease agreement is signed.  However, they have never leased from Quirk [redacted] so your policy might be different than most dealers.  Also, the bank stated that they did not receive any phone calls from Quirk [redacted] until April 30, which is well past the 30 days you would "normally" hold a car to assess damage.  It is also surprising to me to hear that you knew of a discrepancy in the final payment, within the 30 day window, when the bank was not called until two and a half months after the car was turned in.  If [redacted] knew about the discrepancy, how did it come to your attention and why was I not notified?  Again, I take responsibility for not knowing my lease agreement.  I have certainly learned that lesson and I suppose I can thank you for that.  It is clear to me that there has been a great deal of covering up going on by [redacted] and that there was not one single point, in this entire process, where you had the buyer's best interest in mind.  I am one person who made a mistake but there are multiple people on the dealership's side that made mistakes and it's me who is left paying (literally) for them.
