relocating, we will cancel the member's agreement upon receipt of a payment in the amount of 10% of their total contract price If the 10% payment is approved by the member and processed after the 1st of the month, the membership will be cancelled at the end of that month No refund will be issued for payments received prior to that date However, we do understand that *** * *** *** is not able to use the facility for the remainder of January due to relocating We have issued a credit card refund in the amount of $for the January membership dues paid by *** *** We have issued a credit card refund in the amount of $for the January membership dues paid by *** *** If *** * *** *** are ever back in NJ we would love to have them be part of the Jersey Strong Family again!

I am rejecting this response because:
I was not given an opportunity to read that contract, never received a copy of the contract, received a contrary oral representation from Stephanie (who, upon information and belieg has since been fired bc of issues related to dealing w customers), and therefore that provision is legally not enforceable I signed a electric pad I did not agree to pay this fee I believe this is not only a violation of the Consumer Fraud Act but is also a deceptive business practice Wow recently settled a class action lawsuit involving similar claims The contract is not legally binding I was not advised and did not agree to pay any such fee, and in fact was told it was $a month plus tax, no contract, no other fees, and it could be cancelled at any time Again, I am respectfully requesting the annual membership fee be refunded Thank you

We have revisited ** ***'s complaint, and although she was not paying for her membership because she was on a freeze she was allowed access into the clubIf ** *** checks her bank statements, she will see that she was only charged $a month for her regular monthly membership that was on a medical freeze and was not being billed for personal training because that is always a $freezeAs previously stated, when a member is in term with a contract, and are forced to cancel due to moving they are responsible for 10% total value** *** was billed accordingly, please know that our customer service has changed to better assist our members as wellWhen a member requests a phone call by emailing our support team, they will receive one within 1-business days

I am rejecting this response because:As far as the personal training contact goes, a manager had me contracted under separate contracts at one time, not including a standard membership for $a month. This began in when I was being charged for the two contracts, one that was done with out my knowledgeMy name was signed as OTP to the contract from 10/10/for payments of $a month. NOTHING was done over the phone, the employee took it upon himself to do this.When you say I have completed out of training sessions, I do not even know which contract they are going by.My account was placed on freeze as of February 1st I was charged $for the remainder of my contract plus the extended months that their policy requires. In January I paid the amount of $in full and an additional $to release me of all ties to Jersey StrongSo at this time I have fulfilled my remaining months out of for my membershipSo why do I need to pay $to cancel? I have already bought out my contract.My inquiry is due to the fact that at the time of me buying out my contract I spoke to the personal training manager TimHe had been given the OK from this manager to write a ticket to corporate for reimbursement for the personal training sessions I had paid for in the pastWhich according to you would be out of I have not received this paymentIf a manager was to ok reimbursement why is corporate not releasing payment after they ok’d it?

sales tax on month #of his membership and then annually thereafter According to our records, *** *** was billed for his Annual Membership Fee and February membership dues on 2/1/2012, in the amount of $ On 2/1/*** *** contacted the local WoW and was advised of the Annual Membership Fee billed to his account On 4/17/WoW was in receipt of a credit card dispute filed for the payment of $received on 2/1/ As *** *** was responsible for payment of this charge, the balance was added back into his account with us No further payments were received for *** ***'s account with WoW Due to the outstanding balance remaining on his account with us, *** *** was sent to collections on 7/25/2012, in the amount of $ Although no prior request was received and we could have easily helped *** *** out at anytime, we will be happy to make an exception and waive 50% of the balance due Upon receipt of a payment in the amount of $we will be happy to remove *** *** from collections At that time, he will be able to remain cancelled- or join under one of our current promotions We hope this helps!

We have thoroughly looked into *** *** WoW membership account and we have been in correspondence with our billing department, *** ***We have found no evidence that indicates these charges were causing by our billing methodAs a courtesy, we will give *** *** one free month of
membership to keep her as a happy member

I appreciate the waiving of the late feesIt still does not seem fair that I have to pay more to use less of your gym, especially since I was told I could do it anytime, no problem, with NO chargeAnd, you failed to address the main problem- the forging of my signature on a contract I never signed off on when I paid the mid annual feeYou can take a signature from a credit card payment and slap it on a lengthy contract the following dayIf I was paying to just use the equipment, my year would be paid upI will pay what im obligated toIll pay the something dollars

I have thoroughly investigated Ms***s WoW membership account and billing history On July 31, Ms***s membership was cancelled and sent to collections due to an outstanding balance of $ A total of $was sent to the collections agency As stated in Ms
***s agreement with us, a $fee will be applied when an account is cancelled and sent to collections for non-payment According to our records, on August 28, Ms*** made a payment in the amount of $for the past due balance on her WoW membership account An exception was made to waive the $collections fee applied At that time, a Work Out World representative notified the collections agency to close Ms***s file, as payment was received Ms*** then enrolled in a new Work Out World membership account. Upon receipt of this inquiry, I have personally contacted the collections agency to ensure that Ms***s file has been updated and she will no longer be contacted by the collections agencyWe do apologize for any inconvenience caused to Ms*** We would like to offer Ms*** one month free of membership We hope this helps! Ms*** will not be billed for her May membership dues. Have a strong & healthy day!***

I am rejecting this response because I have explained several times through the online support system offered by Jersey Strong- I was informed that a formal cancellation was not needed once my membership contract endedI consulted the Jersey Strong front desk staff during March to ask if any further action was needed on my end to ensure my membership would be cancelled prior to May Therefore- I did attempt a formal request to cancel my membership except I submitted it in person and was told no formal documentation was neededIt is a shame that the Jersey Strong gym cannot reimburse me the annual fee or fee for the month of May.

I am the Administrative Operations Manager and Assistant to the OwnerI personally have been handling *** *** correspondencesI have addressed each of *** *** concerns and have given him multiple options One of our District Managers spoke to *** *** over the phone
regarding his feedback about the gymWe greatly value feedback and addressed his concerns with our staffChanging membership dues does require the purchase of a new agreement and *** *** was given three different price optionsI also offered to give him unlimited access to our XLabs at no extra charge*** *** requested to cancel his membership because he was not satisfied with any of the options availableI set his membership to cancel as he requested and even offered to remove the cancellation if he changed his mindBy no means was this account stopped without authorization nor did I prevent him from continuing his membership We did everything that we could to keep *** *** as a happy memberFitness and health is very important to us and we wish him nothing but the best at his new facility

I apologize if *** *** was given any impression other than WoW valuing the business she chooses to do with us We are a family owned and operated business since and have over 70,membersIn this day and age of computers, we typically accept and reply to member inquiries through our
online help desk We have found this is the best way that we can properly track and respond to all member inquiries. I have thoroughly reviewed *** *** and *** ***'s memberships with WoW On 6/20/2017, they upgraded their memberships to our current VIP+ membership plan When upgrading their memberships, the prior agreements were cancelled and they were each enrolled under a new membership agreement The VIP+ membership plan that they each enrolled under includes a new Annual Membership Free months from enrollment, a 12-month initial term, new access permissions and an entirely new billing structure Please note, the Annual Membership Fee is something all WoW members pay on a pre-set date each year The fee is not applied to the prior or future year of membership Our Team Training class is not included in the VIP+ membership plan At this time, Team Training is available to all members who purchase a separate Personal Training package Although *** *** and *** *** have not enrolled under a personal training agreement, we will be happy to make and exception to add Team Training to their memberships, at no additional cost We hope this helps! *** *** and *** *** now have access to our Team Training classes

Rich also verbally cancelled the contract from 11/as he stated to me on 11/Interestingly enough, I have requested the personal training contract but *** *** was only able to produce the contract from 11/Angel, the representative, told me he was able to view the personal training agreementI have requested the 2nd agreement on two separate occasions however no one will provide access to what I signed on 11/10.
