Ms. [redacted] account was opened with a billing address of [redacted]. The billing address has not changed since the account was opened. Midnight Velvet has no record of receiving returned mail for the account statements mailed to Ms. [redacted] attention. Midnight...

Velvet is responsible for mailing account statements to the address provided by the consumer. It is not responsible for ensuring their delivery. Moreover, attempts to contact Ms. [redacted] by telephone regarding her delinquent account were unsuccessful. As a courtesy to Ms. [redacted], Midnight Velvet will credit her account to remove the late payment fees, reducing the outstanding balance on her account to $73.22.  Ms. [redacted] can arrange payment of her account by contacting Merchant's Credit Guide at [redacted].

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not...

resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Regards,
[redacted]I disagree because if they believe there's some fraud going on when the representative told me it was due to fraud why did the super visor I spoke to deny that there was any fraud. I also offered to send in my ID and Social Security Card and any other paper work they need. As far as others using the address and phone number, there are 8 people in my home. We all use one cell phone as our home phone and of course we all have the same address. The adults names are my name which is, [redacted]. So, if there's any other names besides these then they may have fraud. I don't see any excuse not to send out my order, because they could just ask for verification. Thank You.

Mr. [redacted] accounts have been coded to stop all calls.

The order form received by Swiss Colony in this matter was altered to delete the name and address of the intended recipient. The information that replaced the original name and address was used to process the order, resulting in an account in the name of Mrs. [redacted]. Swiss Colony has elected to...

request deletion of the account information from Mrs. [redacted] credit file. This change may take up to 30 days to appear on a consumer credit report.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  Thank you for your assistance with this matter. I do find it puzzling as to how an original order for two items that with shipping added up to less than $100 somehow ended adding up to a bill for $187 for an alleged single item? No copies of any USPS, FEDEX,  or UPS deliveries with a date or time stamp signed by me or even delivery confirmation. These guys are as shady as can be. Thanks again for your help here.
Regards,

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me if the company makes the request for deletion and Ashro is removed from my credit file, from each credit bureau.  Thank you

Mr. [redacted] opened a Home at Five credit account in April of 2014. The account balance was paid in full on June 2, 2014. On June 10, 2014 Mr. [redacted] placed an order in the amount of $396.92. He proceeded to make payments on the account in July, August, November and December of 2014 before placing...

another order in the amount of $141.11 on December 10, 2014. One additional payment was made on the account in March of 2015 before Mr. [redacted] allowed the account to be charged off as a loss in August of 2015. Home at Five received payments totaling $169.76 on orders totaling $538.03, resulting in a balance at charge off of $621.55, including finance charges and late fees.
The account was referred to a collection agency for recovery on August 22, 2015. Home at Five recalled the account on August 27, 2016 with the intention of placing it with another agency. Apparently the agency had received a payment for the full balance from Mr. [redacted], but had not reconciled the account with Home at Five at the time of the recall. In this instance, the collection agency should have retained Mr. [redacted]’s account and closed it when the payment was remitted to Home at Five. The agency failed to do so and, as a result, the account was referred to a secondary agency on September 1, 2016.
On September 7, 2016 Home at Five received a payment from the original collection agency for the full balance on the account. Unfortunately, the account had already been referred to the secondary agency. Mrs. [redacted] called Home at Five on September 26, 2016 and stated she had received calls from a collection agency regarding the account. Home at Five recalled the account from the agency. Home at Five regrets any inconvenience Mr. and Mrs. [redacted] may have experienced as a result of this matter.

We received your correspondence
from the Revdex.com regarding Order #[redacted] placed via phone
11/19/2014. We apologize for your receiving unsatisfactory
merchandise.
Our records indicate your return
of the Animal Massage Slipper/Dog 12/9/2014 was processed 12/9/2014, and a...

credit of $23.95 ($19.95 merchandise credit + $4.00 associated shipping and
processing) was issued to your account.
Your return of the Lumbar Pillow
was processed 1/13/2015 and merchandise credit of $39.95 was issued. Our
guarantee states: “When you receive your order, if you are not completely
satisfied you can return any unused item in its original packaging within 60
days of its receipt for a full refund of the purchase price (excluding shipping
and processing charges).” It is a standard practice in the catalog industry that
the customer is responsible for any return postage if an item is returned
because the customer changed his or her mind, the item didn’t fit, or that the
customer just did not like the item. Likewise, shipping and processing is not
automatically credited. As a courtesy, the remaining shipping and processing on
this order has been credited, and your account now reflects a zero balance.
As requested, your account has
been closed and your name removed from our mailing list. However, it is still
possible that you may receive another catalog from us. Some catalogs are already
at their shipping destinations, to be released at a later date. The entire
process can take six to eight weeks. If any are received you may
discard.
We hope this information is
helpful to you. We appreciate the opportunity to explain. Sincerely, Montgomery
Ward

Mr. [redacted] placed an internet order with Swiss Colony on November 27, 2016. It should be noted that Swiss Colony did not pre-screen Mr. [redacted], nor did it send him a pre-approved credit offer. After reviewing his credit history, Swiss Colony determined that payment of the order would be required...

in advance of shipment. Mr. [redacted] made the required payment on December 19, 2016, at which time only one of the three items Mr. [redacted] ordered remained available. Mr. [redacted]'s overpayment was refunded on December 28, 2016. Swiss Colony offers its apologies for any inconvenience he may have experienced as a result of this matter, but it is not responsible for any decision Mr. [redacted] may have made to remit funds that were not actually in his checking account at the time the payments were made.

Seventh Avenue received an internet order in Ms. [redacted] name on August 28, 2016. The individual who placed the order provided Ms. [redacted] full name, address and social security number. This order proved to be one of a number of orders used the names and real addresses of their victims, then contacted...

the company in an effort to change the shipping address after the fact. Seventh Avenue was able to stop the shipment of the item to Ms. [redacted]' home and refuse to ship the item to the substitute address.
Ms. [redacted]' does not need to complete and return the identity theft affidavit, as this order has been identified as part of a larger fraud ring. Ms. [redacted] should be aware, however, that her personal information, including her SSN, has been compromised.

We received the correspondence from the Revdex.com in regards to your order #153881-18 placed 4/30/2015 by phone.  We are sorry for any disappointment with your purchase of the RCA Mini 400 Watt Stereo.

We are sorry if you experienced any phone delay when you attempted to...

contact us. Our statements show up to three contact numbers for your convenience, one for Credit Counseling, another for Customer Service and a third for placing an order.  These are shown under the first fold of the statement. We wished you had contacted us right away if you were unhappy with your purchase. Our records indicate the first communication regarding your order was 9/17/15.   Our guarantee states, “When you receive your order, if you are not completely satisfied you can return any unused item in its original packaging for a full refund of the purchase price (excluding shipping and processing charges) or exchange.”

Our goal is to present new and unique products with the best combination of value and service to you.  To do this, we always try to obtain the best cost from our manufacturers and craftsmen, keep our expenses low, price our products fairly, package them properly and mail them to you when you desire.  Unfortunately, we do not price match from “warehouse” companies, Ltd, Amazon, Lowes, Home Depot, QVC, FingerHut, WalMart, or any direct manufacturer.  We do understand that at times, one can find the same or similar item at a lower price than us.

As a courtesy, we will issue UPS call tags to return the Mini Stereo.  Please package the stereo and remove all outside labels.  UPS will have a return label and make three attempts for pickup within the next three to five business days.  Upon the returns processing, credit will be issued and a refund of payment will be returned.  Please allow from seven to twenty one days for the complete process to be completed.

Late fees and finance charges accrued on the account as the one payment received 6/24/15 was not made in accordance with the credit agreement.  PAYMENTS: Each month you must pay at least the full Minimum Payment Due (Minimum Monthly Payment plus any past due amount) on or before the due date shown on your monthly statement. Your Minimum Monthly Payment is determined based on the highest new balance ("HNB") of your Account, in accordance with the table below or, if the HNB exceeds $2,400, then 3.34% of the HNB. The HNB is the highest principal balance of your Account since it was last paid in full. This means that the Minimum Monthly Payment will not decrease unless your Account is paid in full, but we reserve the right to recalculate the HNB based on returned merchandise or Account adjustments. We can apply your payments to fees and charges or amounts financed in our sole discretion, subject to applicable law. Payments in excess of the minimum will not reduce future Minimum Monthly Payments. This information is also available online.

We regret any inconvenience or disappointment, but appreciate the opportunity to explain.   Montgomery Ward

Ashro has two accounts at Ms. [redacted]s address, one under the name [redacted] (ending in [redacted]) and one under the name of [redacted] (ending in [redacted]). The [redacted] account was opened via the internet on January 12, 2015 and has payments made in February and March of 2015. The...

[redacted] account was opened in October of 2012 and is the account for which Ms. [redacted] has been receiving notices for non-payment. If both of these accounts belong to Ms. [redacted], Ashro will be happy to combine them into one account, with one billing statement. If they are separate accounts for separate individuals, Ms. [redacted] will need to ensure that she is paying on the account in her name.

Seventh Avenue's records indicate Ms. [redacted] placed an order on September 4, 2014 that increased her account balance to $1,582.96. Ms. [redacted] then made regular, timely payments that reduced her account balance to $1,112.36 by March 3, 2015 - a reduction of 30% in only five months. Seventh Avenue's...

records indicate Ms. [redacted] then placed an order in the amount of $263.85 on March 6, 2015, which undid much of the balance reduction. Had Ms. [redacted] simply continued to make payments on her account her balance would now be less than $900. Since the purchase, Ms. [redacted] has been assessed two late payment fees for failing to make the required payment on  her account on time, which has slowed the reduction of her account balance. As a courtesy to Ms. [redacted], Seventh Avenue has credited her account to remove the late payment fees and adjusted her account to remove the last six months of finance charges. Ms. [redacted]'s account has been closed to new purchases, as she requested. However, finance charges will continue to be assessed in each month that a balance remains on the account. Please note that the monthly payment on Ms. [redacted]'s account is based on the Highest New Balance and will not decrease as the balance goes down. As the account balance goes down, a larger portion of each payment goes to reduce the principal balance and less goes to pay interest. As a result, if Ms. [redacted] makes regular, timely payments in accordance with the terms of the account she will be able to pay the account in full in less than two years (assuming no further purchases or late payment fees).
