I am rejecting this response because: First it wasn’t until I started to question Tate about the refund and forwarding the emails between Ms [redacted] and myself that they responded asking for my Contract, which I found strange since they should have a copy of said contract as wellHence my response and I also have sent them the email attached as well wherein it was discussed the retainer would be refundedThat’s when they came back about it was a misunderstanding and refused to respond to many emails sent afterwards including about asking for their legal details to send a legal letter addressing the sameSecondly, THAT Facebook page that they are listing in question WAS NEVER created by Tate I personally setup that Facebook page myself It wasn’t until August 10, (see attached) that Tate finally contacted me about a Facebook page; almost a year and month AFTER I had already created oneThird, I have attended almost all book signings set by Tate and have bene doing all the marketing and promotional work by myself Including a book tour to South America and buying TV slots that saw my book being advertised, with absolutely no help from Tate Publishing.All Tate Publishing does is send out emails every Friday with various hooks to buy books for one reason or another, but nothing about marketing and promoting and I have always worked with them and have email proof to show the sameHence Tate is in violation of their Contract and I would like my retainer to be refunded as now they are also falsely claiming to BB and I that MY Facebook fab page, created by ME was in fact done by them If this isn’t proof as shown by many complaints that they lie, I do not know what this is But unfortunately, this time they have bene caught in the said lie in public

Tate fulfilled the contract the book was through productionThe author received a guide to marketing and in addition the questionnaire in which the author stated they would need to attend eventsThe author did not attend any events As with any new author, the success of their book in today's market is largely dependent on the efforts the author puts into marketing not only the book but themselves as the author If the author wishes to terminate their contract we can send the documents but it is with no refund

This author purchased from Tate a movie pitch with an actual producer and was NOT promised a specific producerAt the time we had been scheduling with Dr [redacted] but he took a lengthy project and has been traveling and unavailable Tate works with several Producers, this not uncommon for projects to come up for one and & another be available [redacted] did have a call with Ms [redacted] on September 21, at 2:PM CST to 3:PM CSTThe call was one hour in duration, as previously agree to by all partiesMr [redacted] spoke with Ms [redacted] at length about her book and it's contentMs [redacted] had a lot of questions for Mr [redacted] and he feels he answered them all for herHe also stated he felt it was a good call and expressed an interest in taking this on as a project but he already had several ahead of herMs [redacted] indicated to Mr [redacted] she wanted her book made into a film even if it was a lower budgetMr [redacted] wanted to help her out so while they were on the phone he looked up AZ Film Rebate Commission and discussed with her avenues to get her film made without a big Hollywood budget by attending local film festivals which he again looked up for herHe encouraged her to market herself on social media & meet with the locals in AZ to create a buzz about her bookThere are no refunds and all sales are finalWe do not consider this to be a valid complaint and author clearly pitched her book to a movie producer and was able to discuss her ideas and ask the questions she needed to know to get her book into a film

A representative of our Customer Service team spoke with this individual at approximately 4:PM CDT on Thursday August 25, shortly before this complaint was received We are unsure why Ms [redacted] alleges she had no contact from us regarding the order, when that is clearly not the case.Per the conversation between our representative and Ms [redacted] , the product was originally shipped July Unfortunately, for some reason the product was not delivered and are working with our partners to determine what happened We decided yesterday that the best course of action was to replace the product for Ms [redacted] , and have placed and subsequently expedited the order so that it will arrive in approximately 3-business days Ms [redacted] was notified of this during her conversation with our customer service team, and was sent an email receipt/confirmation of the replacement order A copy of the receipt/confirmation for the replacement order is attached to this response.We again offer Ms [redacted] our sincerest apologies for the delivery issues regarding her order, and hope she enjoys the book when the replacement arrives next week Should Ms [redacted] have any questions regarding her order, she is encouraged to contact our customer service team directly for the most up-to-date information

You have to handle things in a professional matter no matter what and she isn't equipped to handle things. Secondly, I do not have any interest in any advertising from Tate. Please let me know what will be credited on my credit card. Nothing short of a credit will work for me, so please let me know what will be credited asap. All books ordered are now in Ms. [redacted] 's possession, and she also has charged back with her credit card company half the purchase for the books in the amount of $760. Since the books are now in her possession and she is able to sell them and make a significant profit, we request payment for the books to be remitted. We do apologize to Ms. [redacted] for the delay, and we are contacting her directly. The printer had some equipment problems that caused the delay with printing, and we are more than glad to help and compensate Ms. [redacted] . She may choose from either a free book trailer or free website, and we will... create that for her.Regarding contacts to be made, we do serve a wide array of authors, so it is normal to have a few weeks pass from the time contacts are requested until they are finalized and the report is sent. Once the report is received, it is normal that we pass the leads and any correspondence on the author's behalf to the author. We encourage the author to follow up and then to pass their contacts back to their marketing consultant so the publicists can continue to follow up. It can take 3-5 rounds of contact from us and the author before we reach a desired result or even a clear response. We team with the author because many times the venues want to hear directly from the author and are making a decision about the author, not just the book.We will be glad to reach out to Ms. [redacted] personally to assist and clarify, and we will be happy to offer the free book trailer or website due to the printing delay.

Complaint: [redacted] I am rejecting this response because:First, it was not Tate that refunded the charge I was told by Tate "we don't know what that is, there is nothing I can do" and then ignored It was the credit card company that refunded the money, not Tate I have the e-mails to prove this.Second, I was aware this was the first printing of the hard cover books I was told in July when I ordered them to allow "a couple extra weeks" for printing above the 4-weeks When I contacted in September, I was promised the order was expedited and the books were due to ship on September 16th and shipment should take 2-days That means, they should have arrived on September 19-20th I am fine with the shipment taking longer, but I was constantly told a different date or completely ignored, so I came to the natural conclusion they would never arrive, especially when I began being ignored I do have the e-mails to prove this as well.The books did finally arrive yesterday, and look great, so this part of the response I do accept However, my original receipt and amount agreed to pay was $162, but the receipt enclosed with the books show I owe $ This is not the amount I agreed to and paid I also have these receipts as well Sincerely, [redacted]
