I am rejecting this response because: They conveniently left out the fact that they shipped the books to me without the augmented coverThat is the only reason I told them to cancel the coverI had no choice in the matterThe deed was done because of
miscommunication between their departments after I tried repeatedly to call and e-mail them to make sure the augmented cover would be complete before they shipped my orderI believed *** ***'s verbal promises to me that the books would be placed in bookstores (not their legalized jargon)He was very clear. He also promised Tate would pay for television and radio interviews that they would set up for meThis is all a moot point because they specifically protected themselves from having to keep verbal promises in their contract with me that I signed because I believed in *** *** so much that I did not read the contract carefullyThat was my fault. When they told me they would require me to leave the $that I paid for the augmented cover in my account and I could use it as a credit, I believed I had no choice and did not push it because at that time I thought the company would do what they promised me verbally that they would doIt was before I found out that it was all a bait and switchIf I had been told the truth in the beginning, that it was up to me to sell my book, I would never have paid to have it published in the first placeI ordered business cards and used $of the $credit that was in my account for an augmented cover when I was still thinking I actually might be able to sell my booksI have tried to sell my books and am not having much luck because I really do not have the time that is requiredI certainly do not want any more books to sit in boxes in my officeAll I am asking for is the $credit left in my account that I paid specifically for an augmented cover on my book that was not done through no fault of mine

You are a "vanity Publisher/self-publisher a matter in which was one of my concerns that I address with my marketing person, after numerous professional bookstores would not purchase because it was listed as P.O.Dd (Prino On Demand) very easy to proveYou say that you have seven pages of notes, contacts and emailsWhat does that mean, because if you did not provide the services that you agree to in the contract, it's just words of what you were suppose to do and never executedI was contacted by a staff from Tate Publishing and her response was this, We have not been Able to contact you for one whole yearMy response was that it was a lie! I have copies of emails from myself , as well as email responses from staff and some email voice recordingsMy emails address the very same issues that I have filed a complaint aboutThen she went on about how they were going to start setting up venue's for my bookThat along with a list of other services were suppose to be done when I first signed my contractWhy should I have to start from scratch and she never even address the other services that were not providedThen she made three offers which were no way compatible to the 4,Marketing& PR Package I paid forThe options were 1.) a professional review for my book2.) I never received a royalty statement in February as statedI haven't received anything from Tate except for emails on how I can spend more money to promote my bookI can't afford to sink more money in, and since it is the only thing offered to me,I haven't had a need to consistently speak to Mr*** I also never received any email about a speaking engagement as stated by Tate PublishingI don't want a long drawn out battle with the company because maybe it works for others, but not meTate should be willing to offer unsatisfied authors some form of partial refund, or other compromise, out of good faithI understand the need for marketing, but I don't understand why an author has to constantly spend hundreds of dollarsIt would take a lot for an author to sell 5,copies of a book in order to get a refundI don't want to bash TateI just want Tate to consider compromising instead of automatically saying no refund

I am rejecting this response because:The items stated in the business response are and I am proving attachments that show proof of my grievancesWithin the contract it states I would be assigned a marketing representative and publicist who would work closely with me to come up with a marketing plan as well as a media blitz near the time of my releaseThe only marketing that was done by the publisher was contacting a few local retailers who either did not respond or rejected their proposalOne retailer, *** and ***, expressed they had no knowledge of any contact from the publisher at the time of my followupThis was the beginning and end of any marketing attempts with no alternative ideas or even attempts to contact me. I have also included the welcome email that shows the date my signed contract was accepted and the congratulatory email that shows the date six months later, which is three months after the release I was promisedThat delay alone cost me inclusion on that year's summer reading list and a book signing which I scheduled and attended on my ownAlso, the contract states that my book would be released in Ebook format, which never happened, costing me even more in sales. The terms of the contract and promises of the company were not fulfilled and whenever these concerns were voiced via email or phone, we received a promise of future reply or no response at allFor further evidence, my agent *** *** at Del Corral can be contacted at ***I am asking for a full refund of $(open to some negotiation) and the complete removal of my materials from any and all Tate Publishing distribution chains and websitesI would like a complete disassociation with the company
