I am rejecting this response because: First it wasn’t until I started to question Tate about the refund and forwarding the emails between Ms [redacted] and myself that they responded asking for my Contract, which I found strange since they should have a copy of said contract as well. Hence my response and I also have sent them the email attached as well wherein it was discussed the retainer would be refunded. That’s when they came back about it was a misunderstanding and refused to respond to many emails sent afterwards including about 3 asking for their legal details to send a legal letter addressing the same. Secondly, THAT Facebook page that they are listing in question WAS NEVER created by Tate.  I personally setup that Facebook page myself.  It wasn’t until August 10, 2016 (see attached) that Tate finally contacted me about a Facebook page; almost a year and month AFTER I had already created one. Third, I have attended almost all book signings set by Tate and have bene doing all the marketing and promotional work by myself.  Including a book tour to South America and buying TV slots that saw my book being advertised, with absolutely no help from Tate Publishing.All Tate Publishing does is send out emails every Friday with various hooks to buy books for one reason or another, but nothing about marketing and promoting and I have always worked with them and have email proof to show the same. Hence Tate is in violation of their Contract and I would like my retainer to be refunded as now they are also falsely claiming to BB and I that MY Facebook fab page, created by ME was in fact done by them.  If this isn’t proof as shown by many complaints that they lie, I do not know what this is.  But unfortunately, this time they have bene caught in the said lie in public.

June 13, 2016 Case #: [redacted]   To Whom It May Concern,   We have let Ms. [redacted] know that we have never promised that her books would be sold on bookstore shelves. They operate solely on supply and demand: once there is an outstanding demand, they will then supply them in-store. We have no control what they decide to sell on their shelves, but we are still more than happy and willing to work with the author to create the demand for her books. We've placed her two books in the spring 2016 New York Times ad as promised; this will be the first New York Times ad that we've run since she was promised the placement of both of her books. The proof is being configured, but her two books have been included in the ad to be run in the next month; we are still awaiting confirmation for a date from our advertisement representative. I am rejecting this response because:We don't agree with most of what was said. Most importantly, we still haven't received a single royalty check after 14 months of sales, 3 quarters of sales reports and a month and a half after their database was "updated" with current information. I am attaching a detailed response to our rejection of their rebuttal. As previously, we have provided both a .doc file and a .docx file to make opening the files easier. Please read that in it's entirety and offer a solution we can agree to.

I am rejecting this response because: This is not what I asked for or what it will take to resolve this issue. I clearly stated to show us all the actual Amazon sales reports. If they have nothing to hide, they will have no problem showing them to us. Trying to get me to trust your word and believe your accounting is further proof of fraudulent reporting, which my document attached to my last complaint clearly demonstrates. There is (without a shadow of a doubt) fraudulent reporting on the part of Tate Publishing. I proved it and so can hundreds of other authors, many of which I have spoken to. Turn over the actual Amazon sales report (straight from them) to myself and the Revdex.com and then pay me my royalties for all book sales (which you haven't) and pay me back my initial investment of $3990 - then and ONLY then will this complaint be resolved.

This author purchased from Tate a movie pitch with an actual producer and was NOT promised a specific producer. At the time we had been scheduling with Dr. [redacted] but he took a lengthy project and has been traveling and unavailable.   Tate works with several Producers, this not uncommon for...

projects to come up for one and & another be available. [redacted] did have a call with Ms. [redacted] on September 21, 2016 at 2:00 PM CST to 3:00 PM CST. The call was one hour in duration, as previously agree to by all parties. Mr. [redacted] spoke with Ms. [redacted] at length about her book and it's content. Ms. [redacted] had a lot of questions for Mr. [redacted] and he feels he answered them all for her. He also stated he felt it was a good call and expressed an interest in taking this on as a project but he already had several ahead of her. Ms. [redacted] indicated to Mr. [redacted] she wanted her book made into a film even if it was a lower budget. Mr. [redacted] wanted to help her out so while they were on the phone he looked up AZ Film Rebate Commission and discussed with her avenues to get her film made without a big Hollywood budget by attending local film festivals which he again looked up for her. He encouraged her to market herself on social media & meet with the locals in AZ to create a buzz about her book. There are no refunds and all sales are final. We do not consider this to be a valid complaint and author clearly pitched her book to a movie producer and was able to discuss her ideas and ask the questions she needed to know to get her book into a film.

While I do understand your frustration, and we were told from the printer that the books would make it in time, we can also avoid these situations by ordering and allowing plenty of time in the future as well, especially for hardcover books, which take significantly longer to produce.
[redacted]'s role is to process the orders in, but it is not her role to print, package, ship, or track the books. She has no control over those details. [redacted] is actually not your contact for seeking updates once books are ordered. Those questions are to be directed to [redacted] your Author Service Representative. Perhaps those emails or calls were sent to [redacted] and if so, I do apologize if you did not receive a response, and I will look into those concerns to ensure you receive a timely response in the future.
[redacted]'s role is to help you with book purchases and discuss avenues for marketing and sales. You are in excellent hands in that respect, as [redacted] does know the industry very well and can assist you in finding more events or directing the publicists to make additional contacts on your behalf.
Per our company policy, we do not issue refunds on books purchased. This is because we ourselves must pay for materials and printing. I would be glad to increase the order quantity or deeply discount additional copies of another of your titles (or this same title) if you'd like. We did reduce your cost on this order of books by $400 when you placed this order as well.
We can and will re-imburse you for the shipping fees you incurred. I received that email as well and we will cover the additional expenses.
Again, we want your best long-term, and my understanding is that the remaining books will be arriving today.

Thank you for your kind words, but as you know this situation is an epic failure. Today, I called Ms. [redacted] and she cannot even respond via email. I would strongly urge you all to hire people who can handle these situations. Avoiding people really does cause more problems in the long run. It builds angst, tension, breaks trust, and bottom line it's bad for business. THIS COULD'VE BEEN FAR LESS STRESSFUL! If the only time you return calls is to take orders ... that is bad business.
I truly am a reasonable person, but being avoided after you all ran my credit card for over 1500.00 is unacceptable.
So let's recap
There were no books for an event ( where celebrities were - BTW) Thank God I had a few extra.. [redacted] was able to leave with books in hand. ( NO THANKS TO YOU ALL)
I phoned and no one answered
I emailed and no one answered
Fast forward- I receive an email saying books shipped. Again, no apology for the failure.
I check the tracking number says it was just shipped! (THAT DAY) Not the day it was supposed to
Then receive only half- to the wrong address !!!!!!!!!!!
Still have not received other books!!!!!!!!
So on that note, I would like someone else to handle my business marketing/ book orders from here on out. I have no respect for her anymore and wouldn't let her handle another large order for me in the future.. when so much is on the line..
You have to handle things in a professional matter no matter what and she isn't equipped to handle things.
Secondly, I do not have any interest in any advertising from Tate. Please let me know what will be credited on my credit card. Nothing short of a credit will work for me, so please let me know what will be credited asap. I understand the books have been sent, however I also know business management 101 and I know you have room to offer a discount and credit my account. I also know there was some profit made and that should be credited to my account. So, please don't offer me any items, etc.. I would like a credit. ASAP!

Also, I have sent the other books to the other address and will send you the receipt for shipping that you requested on the next email for reimbursement.
If you can't manage to get this done, please forward to someone who can. As, I am out of patience and don't want to deal with this anymore! I have contacted my credit card company and they understand the severity of this situation. I have also contacted the Revdex.com.
I need you all to make this right with a credit/discount on these books immediately and credit my account!

They did not fulfill their promise and they did not offer a refund/discount on the books. Everyone has profit margins and they could at bare minimum offer that. Their "so- called" events department cannot guarantee I'll sell the books at any event. That's a complete lie. And not to mention they have done so little in this department anyway, as I have been the sole marketer for special events

I am not sure I understand the response above, as portions are not showing correctly on this site. However, we did provide a $400 discount to Ms. [redacted] on the initial order, we also offered additional free books and an advertising package to her at no charge due to the delay experienced. We also have offered to assist Ms. [redacted] in finding avenues for sales.
All books ordered are now in Ms. [redacted]'s possession, and she also has charged back with her credit card company half the purchase for the books in the amount of $760. Since the books are now in her possession and she is able to sell them and make a significant profit, we request payment for the books to be remitted.

I am rejecting this response because: If Tate cannot produce the books in a timely fashion, it is impossible for me to reach the goal of 1,000 sales to get my $4,000 reimbursement.  They have still not mentioned the reformatting of my book to enable Amazon to fill orders directly, nor have they sent the 100 books ordered on April 4, 2016 which was supposed to be delivered in 4 weeks!  Tate has not met their end of the contract by not making my books available in a timely manner to customers who order from them, to other vendors, or to me!

Tate fulfilled the contract the book was through production. The author received a guide to marketing and in addition the questionnaire in which the author stated they would need to attend events. The author did not attend any events.  As with any new author, the success of their book in...

today's market is largely dependent on the efforts the author puts into marketing not only the book but themselves as the author.   If the author wishes to terminate their contract we can send the documents but it is with no refund.
