I don't receive them quarterly.Again, you have not given me what was guaranteed That I paid for.Refund my money for services not rendered or make this right by giving me what I paid for.

Ms. [redacted] contacted our company and requested services which we offer. She was given a lower price as a courtesy. We provided the service. She then called some time later and wanted her money back because she informed us that her sister was...

now getting married and she wanted the money for the wedding. The funds are NOT refundable since the service has been provided. However. We refunded her money to her credit card even though we did not have to contractually.

Again we are researching with our bank to verify if any checks have been cashed and if not we will be re-issuing the checks. If any of the checks have been cashed we will obtain copies and forward to Revdex.com.  This research is done in conjunction with our bank and will require some time to complete.

All TV campaigns have already aired, these were completed. We stopped using Dish Network for the ads in 2014 as they had stopped reporting details to us of the ads and airtimes run. As frustrating as that is for us and Mr. [redacted], all...

advertising has been completed.
To be clear, the $3990 retainer fee Mr. [redacted] paid was for the lifetime use of Key Marketing and the services of our publicist. The TV ad and impressions were included at no charge to Mr. [redacted], and are paid for entirely at our expense.
We would be glad to provide additional impressions for Mr. [redacted] via mobile app advertising campaigns to gain additional ad impressions due to his concern. Mr. [redacted] may contact [redacted] the assigned Marketing Consuktant to Mr. [redacted]' project, to proceed with the additional advertising at no charge.
We did provide marketing from Key Marketing in the form of publicity and venue contacts made, and the report on those contacts is below. We are glad to pursue more or revisit any contacts at any time for Mr. [redacted] ongoing.

I do not believe Tate Publishing on anything at this point.
I would like to see the channels and dates that were selected for the TV campaigns. The contract that I signed stated that I would be included in the selection of the channels to air the Ad for my book, and that I would have an opportunity to review the Ad for my book prior to airing. None of which ever occurred, despite several requests by me for information on the status of the plan for airing TV spots for my book for years.
I was told to be patient over and over again for nearly three years. I have an e-mail response from [redacted], Executive Director of Marking at Tate Publishing, regarding my last inquiry of the status of the TV Campaign for my book dated October 24, 2014 wherein he stated:
"The ad time is paid for by us and included at no charge to you. Dish Network is our partner for the ads, and they have limited space. The ad time is still in the queue with them...."
So am I to believe that in the final two months of 2014 after nearly three years of delays and calls for patience that Tate Publishing was able to develop TV Ad campaigns for my book, get them scheduled and run the TV campaigns in less than two months, when they couldn't give me an update in nearly three years of waiting? In addition, Mr. [redacted] thought so little of one of their authors to let me know of the campaigns starting when I had just asked about the status at the end of October 2014?
Sorry, I don't believe that any TV Ad campaigns were ever planned, let alone that the TV campaigns ever occurred on any network let alone Dish on or before 2014 or since. The documentation and evidence is all to the contrary.
I am only aware of two events in the years working with Tate Publishing that did not involve additional costs to the author, two coffee shop events. One I did, no luck there, the other I was not available for the date that was offered. All other events that I have been informed of by Tate personnel required an additional cost to me, like web-site services, web/blog targeting services, speakers bureau services, and I had to fight to get a Barnes & Noble event, which that single event makes-up about ten of the events that they list in the contact list over the years.
If you delete the duplicated event references and the events that I personally had to find and push, there is only a handful or less of events provided by Tate Publishing. After that experience, I have just gone directly to small local independent shops and bring my own stock with me. I am not aware of much in the way of identification of events by Tate publishing as noted above, when you eliminate the duplicate references to the same events.
So, to summarize, I do not feel that the Key Marketing retainer has yielded much of anything over the years, and the only campaign that Tate Publishing has provided is a campaign of deception with regards to the TV Ad campaigns. I can provide the October 24, 2014 e-mail wherein Tate Publishing stated that no advertising campaign had occurred and none was schedule at that time either.

Again, due to the fact that Dish Network stopped providing the reports, we discontinued using them. All ads aired, and we are disappointed as well that we did not receive more details on the aired ads.
However, we are glad to provide a new and more effective campaign to Mr. [redacted] using mobile app advertising at no charge.
Our contract does not promise any level of events or sales, as we do not control bookstores or other venues and which authors or books they will host or shelve.
Many stores do wish to start with local consignment events. Bookstores are struggling in the market right now, and they account for only 25% of all books sold. We encourage authors to find their fit pursuing niche markets, where they can target their audience, control their inventory, and make significantly higher profits from direct sales than through bookstores. In addition, authors do not build their name in bookstores but in these niche markets, which can help the author build a following and can lead to increased bookstore interest. We search for venues with high traffic such as coffee shops or libraries as well to find avenues for sales.
We cannot promise results or success - no publisher can. What we can provide is a team to assist long-term with authors until they find where their books sell and sell best. We can have Key Marketing reach out to more locations - bookstores and otherwise - anytime, and Mr. [redacted] is more than welcome to provide a list for our team to contact.
We desire Mr. [redacted] to have success, and again, since we did not receive the details from Dish Network on the ads aired, we are happy to provide another campaign to gain exposure for Mr. [redacted] and his fine book.
If he would like to take advantage, Mr. [redacted] may contact [redacted] his assigned Marketing Consultant, and we will initiate those processes for Mr. [redacted].

We can address any problems Ms. [redacted] is experiencing, and it appears we need to discuss elements of the contract, which we are glad to do. The contract does not state that the website, book signings, social media sites, or 2500 sales would occur within 30 days. There is no element of the contract that promises sales volume in any specific length of time. In fact, our contract states that we cannot guarantee sales, as we do not control bookstores or the general reading public at large.
Per the terms of the signed contract, there are no refunds once work has begun.
Ms. [redacted] signed her content approval forms on her first book on November 12, 2013. We have scheduled events that have been cancelled due to a lack of response from Ms. [redacted], noted below:

On the current projects signed in 2015, these projects are on track in our production schedule, and we need Ms. [redacted] to be responsive. We are indeed providing the services to Ms. [redacted] that she has contracted with us for.
Our team also attempted to get the errors Ms. [redacted] spoke of corrected in September on her latest project:

I just spoke to the author. Apparently she wants to cancel all of her books with Tate. She say's that she's disappointed with how the digital proofs were done. She says she's seeing a lot of grammar issues and typos and whatnot. I tried pushing back and told her that at this stage is the time we can do corrections and revisions and we can go over it one by one until she's satisfied. Is now bluntly asking for a refund. I'm not sure if this truly is an issue of how the proofs were done since she did sign off on the content approval form for the manuscript, might be just plainly asking to get her money back. She say's she wants to talk to someone who could assist her in cancelling and getting the refund.

As you can see above, the production process we are in is where changes and typos are being addressed. This is the nature of publishing for all books with all publishers. As we work through the manuscript as our staff is working to do, those are corrected and nothing moves forward until the author fully approves.

You are certainly free to terminate the contract at any time. Unfortunately there is not a policy in place in terms of refunding when you terminate the contract. The only way your payment becomes refundable is when you've sold 2,500 books through distribution.
We will always uphold the contract, and we really hate to see all of the hard work on the book go to no use. Again, if there is some way we have not met your expectations or that you are unhappy with about the book, please let us know because I am sure it can be easily corrected.

We expect that Ms. [redacted] may be in financial crisis, but there are no issues with staff being non-responsive, as we are repeatedly working to contact Ms. [redacted] and are fulfilling the contract to walk through the production process. Our contacts to Ms. [redacted] have been met with silence.

We are here to assist Ms. [redacted] in marketing with her current book, and we are here to walk through production and finalize the current books under contract through to completion and serve Ms. [redacted] at the highest level.

We want nothing more than to proceed ahead with all contracts and all books. We absolutely can allow Ms. [redacted] to make corrections, and we have staff assigned to her help in every way to ensure that the book is exactly as she wants. That process can take time, but we are confident that we can serve and meet Ms. [redacted]'s needs long-term. Our goal is to help Ms. [redacted] with every single book and ensure she is pleased with the entire process.

I am rejecting this response because:They are in breach of contract. No one has called me or emailed me at this point. The contract says that they can break contract if I don't do what I said I would do but I can't do the same???  Who is the contact person that I should reach out to? [redacted] isn't responding and does not respond to me which is why we are having this problem. When is someone going to contact me? Can they answer that question.
