We were able to get in touch with Mr. W[redacted] and have provided a full refund to him. After our conversation, Mr. W[redacted] sent the following email:To whom it may concern,       My name is Jake W[redacted]. I filed Revdex.com complaint #[redacted]egarding a refund for lack of services from Upright Law. I am writing this to have this complaint closed as I was able to talk to the company and resolve the complaint. I was unable to close this complaint myself and ask that it be completed. I have CC'ed a representative with the company in question. To address this issue I would like the money refunded back to my account so I can look for a local lawyer and or to pay the creditors I had to negotiate with. I ad more help with paying less in the past. I feel since I had to negotiate and had called seeking help since I was paying these FEES. I feel im entitled to my money back. [redacted]

I am rejecting this response because:I called weeks ago to have some one call the number I gave the lady and she said a closing manager would call in seven days which was the 17th, got no call and frankly very frustrated . Understand paying for services etc but I spoke to attorney for twenty min and was told basically sh it out of luck. Considering no paper work was filed for my bankruptcy and all my debts are now been sent to collection and such. I'd just like to settle this and get a refund. I gave my updated number and still no call .

left you a voicemail and I am writing you now so that you have my contact information written down.     I just received the Revdex.com complaint that you filed against our firm.  To be quite frank, I'm stunned that you felt that your incarceration was the product of anything that our firm did or did not do for you.  Your child support arrears are being paid through your bankruptcy which you paid us to file for you after you were arrested.  And on that note, we discounted your pre-filing fees from $1550 to $50 so that you would not be arrested again and we could file your case for you more quickly.  To date, you have paid this firm a grand total of $50 for attorneys' fees and you have received thousands of dollars worth of [redacted] work.     Please give me a call back to discuss this.  Kind regards,Xxxx X. I am a managing attorney at UpRight Law.  Upon receiving this complaint, I immediately looked into this file.  As a preliminary matter, we would like to say that customer service is an extremely high priority for us and, as such, this former client was issued a full refund well in advance...

of this complaint.  That being said, there are numerous things about this complaint with which UpRight Law disagrees.  First, attorney time, after the initial free consultation, costs money.  Law firms are not retail.  There is no t.v. or refrigerator that one can return if they change their mind about moving forward.  Once the time is spent in preparation of a case file, it is gone.  Second, the work that goes into a case file, especially in the initial case file preparation stages is mostly not done with the client on the phone.  We understand that this former client feels like nothing was done on her case other than those phone calls, but lawyers use the information they collect on those calls to prepare and file cases.  That takes work and most of that work is done by the attorneys and staff without the client on the telephone.  Third, most people have to pay their fees in full prior to filing their cases.  While this former client did eventually do so, her fees were not paid at the time she asked us about filing her case early to stop the Court action.  Lastly, preparing a bankruptcy is not instantaneous.  We cannot press a button and it's over.  We need to collect documentation, interview the client and analyze the facts of any given person's financial situation.  That is the only way a successful bankruptcy can work.  We're very sorry that this former client had a less than ideal customer service experience and we hope that she has better luck working with the next attorney that she hires to find her fresh start.

responded to our many attempts to reach him.  I sent him this email in an attempt to resolve his concerns:Dear FORMER CLIENT,     I just left you a voicemail and I am writing you now so you have my contact information written down.  Please call me back at your convenience.     I would like to discuss with you the Revdex.com complaint that you filed against our firm.  It seems from your complaint that your biggest concern is that you no longer want to file for bankruptcy and you felt as though we haven't been responsive to your desire to cancel our representation.  However, your cancellation request came in on 2/16/16.  We called you back that same day to discuss that cancellation.  When we didn't reach you, we emailed you the direct number for one of our enhanced services managers to go through the process with you.  From our notes, it appears that you never called that enhanced services manager back.  We called you again on 2/19/16 to take care of this, but we didn't reach you again.  One of the attorneys in our enhanced services department left you a voicemail and emailed his direct contact information to you.  You never called him back.  On 2/25/16, we called you again.  When you didn't answer that phone call, we left you a detailed message explaining that we had closed your case.  We then emailed you a close-out letter explaining that your case was closed and letting you know that you can contact us back directly at the contact information that we provided.  We have no record of the 48 calls you claim to have made to us on 3/2/16.  The only call that we have record of on 3/2/16 was one call at 8:36 a.m.  Your case is closed and it has been closed for more than a week.     You can contact me back directly at my information listed below.     Thank you and have a great day!Managing Attorney for Enhanced Services      This complaint contains numerous factual inaccuracies and a blatant mischaracterization of our firm's many attempts to reach him and comply with his requests.  Like we do for all of our former clients, we have made all reasonable attempts to contact him and close his case.  Failing his response to UpRight Law, we closed his cased and communicated the same to him on at least six different occasions.  Even with all of this, we are still willing to discuss a partial refund of the money that he paid us to do the job that we started and only stopped at his request.
